HomeMy WebLinkAboutMINUTES - 12201994 - 1.85 1.85 To: BOARD OF SUPERVISORS Contra FROM: Joe Tonda, Risk Manager Costa DATE: December 20, 1994 County SUBJECT: Implementation of U.S. Omnibus Transportation Employee Testing Act of 1991 Mandating Drug & Alcohol Testing of Em•ployees .Who Drive Commercial Motor Vehicles SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION t RECOMMENDATION: ACCEPT report from the Risk Manager on actions being undertaken to implement requirements of the U.S. Omnibus Transportation Employee Testing Act of 1991 mandating drug and alcohol testing of employees who drive commercial motor vehicles. BACKGROUND: Effective January 1 , 1995, new Department of Transportation (DOT) standards require all employees who drive commercial motor vehicles to submit to drug/alcohol testing. The new regulations cover drivers of vehicles in excess of 26,000 lbs and vehicles or vans carrying 15 or more passengers. There are additional requirements for testing pre-assignment, post- accident, with reasonable suspicion, return to duty and return to duty follow-up. In the Contra Costa County workforce, there are approximately 100 employees who may be covered by these testing requirements. To the extent that implementation and impact of these testing mandates and the policies and procedures governing the program are within the scope of representation, the County has formally invited the affected employee organizations to meet and confer. In preparation for program start-up, the County has assembled a task force of representatives from the Risk Management Division of the County Administrator's Department, the Personnel Department, Public Health, County Counsel and Employee Assistance to prepare necessary action steps. Development of a comprehensive County drug/alcohol testing policy is underway with input from Risk Management, Personnel and County Counsel. The impact of this policy will be the subject of meet and confer with the affected employee organizations. Also underway is an evaluation of practical testing methodologies and protocols available through the County and from outside providers. The final program will also contain an education and training component. The Board may expect a recommended final drug and alcohol testing policy for adoption in early 1995. Staff will provide further reports on program development and implementation.
