RECOMMENDATION 1 . APPROVE the Ninth Amendment of the Consulting Services Agreement with Kaplan/McLaughlin/Diaz, and AUTHORIZE the County Administrator or his designee to execute the Amendment which will be effective November 29, 1994 . 2 . AUTHORIZE the County Administrator or his designee to issue written authorization for extra work, provided that the cumulative total extra cost for all such authorization shall not exceed $25, 000 . 00 . II . FINANCIAL IMPACT Funds in the capital account established for the project are sufficient to cover the amount encumbered by this agreement, from bond proceeds specified to the project . Bond financing for the total project cost was secured in May of 1992, in accordance with the Board of Supervisors direction. Bell, CAO PHIL BATCHELOR,CLERK OF THE BOARD OF cc: 'u JSD (Accounting) SUPERVISORS AND COUNTY ADMINISTRATOR BY �/� J�; DEPUTY 1.7 3 III .REASONS FOR RECOMMENDATIONS On March 3 , 1992 , the County entered into an agreement with the project architect, Kaplan/McLaughlin/Diaz, to provide the Design Development and Construction Documents for the proposed replacement County Hospital in Martinez . After executing the original agreement, eight amendments were made for extra services . Construction of the replacement hospital has been broken down into three separate bid packages, the final plans for each bid package have been submitted to the Office of Statewide Health Planning and Development for review. Final approval from the State for the plans for Bid Package 1 was received on May 26, 1993 and the Board directed that bids be received for this work on July 8, 1993 . Final approval from the State for BP2 was received on July 28, 1993 and the Board directed that bids be received for this work on September 9, 1993 . Approval from the State for Bid Package 3 is still pending. The project underwent a comprehensive user review, reviewing the construction documents on a department by department basis . These reviews served as an audit function and revealed "Gap Items" required by the users . These reviews took place between April and May 1994 and at the conclusion KMD was directed to incorporate these items into the contract documents . KMD was concluding their work at such time as the Preliminary Injunction was granted by the Federal Court and at that time all efforts were ceased. This portion of the Amendment represents $20, 707 . 11 . For the project to comply with the Stipulation Order issued by the Federal Court modifying the Preliminary Injunction it is necessary to amend the Consulting Services Agreement and approve an extra work proposal noted as follows : 1 - perform field investigation work and preparation of documents for issuance to the General Contractor for compliance with the "Site Safety and Winterization" work. This portion of the Amendment represents $25, 000 . 00 . Approval of this amendment will revise the payment limit from $4, 273 , 407 . 00 to $4, 294, 114 . 11 representing an increase of $45, 707 . 11 . AMEND9BO.KMD Jc Page 2 of 2
