reappointed each term thereafter. Mr. Fischback had held one of
the industry seats on the Commission until his retirement from Dow
Chemical last year. At that time, the alternate seat was created

We believe that it is only appropriate to undertake a complete,
open and public recruitment for these seats, recognizing that Mr.
DeFalco wants to be reappointed.
