SUBJECT: REPORT ON THE ROLE AND RESPONSIBILITIES OF THE CONTRA COSTA COUNTY
FIRE PROTECTION DISTRICT'S ADVISORY FIRE COMMISSION
SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. APPROVE in concept the attached report from the Chief Assistant County
Administrator outlining proposed duties and responsibilities for the members
of the Contra Costa County Fire Protection District's Advisory Fire
Commission.
2. DIRECT the County Counsel to prepare, in conjunction with the County
Administrator's Office, a Resolution which would supersede Resolution 80/216
for the Contra Costa County Fire Protection District, outlining the role,
duties and responsibilities of the Advisory Fire Commission and RETURN that
Resolution to the Board of Supervisors for subsequent consideration.
3. DIRECT the County Administrator to prepare a matrix outlining the proposed
role, duties and responsibilities of the advisory fire commission for each of the
dependent fire;districts which provides for appropriate variations in duties
among the advisory fire commissions and PRESENT his report to the 1995
Internal Operations Committee by March 1, 1995, and for this purpose REFER
this matter to the 1995 Internal Operations Committee.
4. REMOVE this subject as a referral to the 1994 Internal Operations Committee.
BACKGROUND:
On May 3, 1994, the Board of Supervisors discussed the report from our Committee
on abolishing the fire commissions affected by the consolidation and agreed to form
a new seven-member fire commission. As a part of this discussion, the Board
referred back to the Internal Operations Committee the issue of whether there should
be any amendments to the existing Resolution which sets forth the duties, roles and
responsibilities of the fire commissioners.

On November 14, 1994, in discussing filling the last at-large seat on the Contra
Costa County Fire Protection District's Advisory Fire Commission, our Committee
asked that this item be reported back to our Committee prior to the December 6, 1994
Board meeting at which an orientation of the new Advisory Fire Commission is
planned.
On November 28, 1994, our Committee met with Chief Allen Little from the Contra
Costa County Fire Protection District; Chief Paul Hein from the East Diablo Fire
Protection District; Sue Noe, Commissioner from the Moraga Advisory Fire
Commission; Charles Glynn, Commissioner from the Orinda Fire Protection District's
Advisory Fire Commission; Chief Assistant County Administrator Scott Tandy;
Special District Analyst Terry McGraw; and County Counsel Vic Westman.
Mr. Tandy reviewed the attached report with our Committee. Sue Noe asked what
affect this report would have on the Moraga Fire District and pointed out that the
Moraga Advisory Fire Commission has certain specific responsibilities and duties in
connection with the fire flow tax in the Moraga Fire District. Mr. Tandy responded
that this report was intended to cover only the newly constituted Contra Costa
County Fire Protection District's Advisory Fire Commission.
Our Committee agrees that we need to move ahead with a revised Resolution to set
forth the role, duties and responsibilities of the Contra Costa County Fire Protection
District's Advisory Fire Commission. At the same time, we believe that it is
appropriate to take a look at Resolution 80/216 and revise it for all of the other
dependent fire districts. We are, therefore, recommending that we move ahead with
a Resolution for the Contra Costa County Fire Protection District and also prepare
a matrix which individualizes the role, duties and responsibilities of each of the
dependent fire district's advisory fire commission, taking into account Commissioner
Noe's comments regarding the Moraga Fire Protection District's Commission's unique
responsibilities in regard to their fire flow tax.

SUBJECT: ROLE AND RESPONSIBILITIES OF CONTRA COSTA COUNTY FIRE
ADVISORY COMMISSION
The Board of Supervisors is the Board of Directors of the dependent Contra Costa County
Fire Protection District. State law authorizes the appointment of fire advisory commission
by the Board of Supervisors to advise the Board on fire district matters, provide liaison
between the Board and the communities served by the districts and perform certain duties
as may be delegated by the Board.
The role and responsibility of fire commissions was defined by Resolution 80/216 adopted
by the Board on February 26, 1980.
As a result of the recent reorganization of the Contra Costa County Fire Protection District
effective July 1, 1994, it is necessary to amend Resolution 80/216 and adopt a new
resolution to reflect the reorganized Contra Costa County Fire Protection District and
specify the duties of the fire advisory commission.
It is proposed that the Contra Costa County Fire Advisory Commission be delegated the
following functions and responsibilities:
• Meet jointly with the Board of Supervisors and provide advice as needed.
• Liaison between the Board of Supervisors and the area served by the
District.
• Serve as the Appeals Board on weed abatement matters.
• Periodically review district expenditures.
• Advise the Fire Chief on district service matters.
• Assist in Fire Chief selection process as required.
• Review and advise on annual operations and capital budgets.
• Review and advise on long-range capital improvement plans.
• Communicate with other fire district advisory commissions on services and
functional integration.
The duties and the relationship between the Board of Supervisors, the County
Administrator, the Fire Chief and the Fire Advisory Commission are outlined in
Attachment A.
We recommend that County Counsel be requested to prepare an updated resolution
regarding the role and responsibility of the Contra Costa County Fire Advisory
Commission for submission to the Board of Supervisors on December 6, 1994.
