Accept.the environmental documentation as prepared for this project as being adequate. 2. Adopt the mitigation monitoring program as prepared for this project. 3. Approve the request to amend the General Plan (4-91-CO) from Agricultural Lands to Single Family Residential - High Density. 4. Approve the request to rezone the site from A-2 (Agricultural Lands) to P-1 (Planned Unit Development) with preliminary development plan. (2958 RZ) 5. Approve the Final Development Plan. (3018-91) 6. Deny the applicant's appeal and approve subdivision (7558)with all the conditions as approved by the Planning Commission. 7. Adopt the findings contained in the planning commission Resolution as the Board's own and the findings provided in the Board's packet. 8. Introduce the ordinance giving it effect, waive reading, set for adoption. Find that the development agreement is consistent with the County General Plan and Conditions of Approval for the development known as Pointe Crockett (County File #2958-RZ, #3018-91 and SUB 7558) 10. Adopt the attached Ordinance for the Wickland Properties relative to the development known as Pointe Crockett. 11. Authorize the Director of Community Development to sign and execute the Agreement after Jt has been duly signed by Wickland Properties.. FISCAL IMPACT None. BACKGROUND/REASONS The background for this project is contained in the staff report provided with the Board Order. The Planning Commission after receiving all the testimony and evidence presented recommended approval of the General Plan Amendment, rezoning with preliminary development plan and Final Development Plan to the Board of Supervisors. Accordingly,the Commission approved the subdivision. The applicant on November 16, 1994 appealed Condition of Approval #58E of the subdivision which restricts the Vista del Rio/San Pablo Avenue intersection to right turns only. In the applicant's opinion, this condition is not warranted by the project. The condition was imposed on the project because adequate site distance is not achievable, according to Caltrans standards, at this intersection when travelling in a westbound direction. To ensure the safety of motorists, staff recommends the condition of approval remain, and no modifications be made. The Zoning Administrator on December 5, 1994, after reviewing all the testimony and recommended modifications by staff and the project applicant, recommended the Board enter into the Development Agreement with the following modifications: A. Developer shall be obligated to provide all the considerations listed in Section 3.1(b). B. Construction of all subdivision improvement to then-current design standards, including roadways and stormwater design standards. C. Delete Section 5.1 (a) and (b) "Amendment of Project Approval". D. Any modifications recommended by County Counsel. E. Dedication of the right-of-way for the Cummings Skyway extension should be dedicated prior to filing the first final map. F. The opportunity for a mortgage to cure a default should be reduced to 60 days. RAdm2:Wicklerd.bod i ADDENDUM TO ITEM H. 6 DECEMBER 13 , 1994 This is the time noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra costa County Planning Commission on the request (County File #4-91-CO) by the Wickland Oil Company to amend the County General Plan to allow for 126 housing units to be built in the western portion of Crockett on a 26 acre site and they have requested the entire site be redesignated from Agricultural Lands to Single Family Residential, High Density; and a request by Jerry Loving Architect (applicant) and Wickland Properties (owner) ( County File #2958-RZ) to rezone 27 . 6 acres from A-2 (General Agriculture) to P-1 (Planned Unit Development) ; and a request by Jerry Loving Architect (applicant) and Wickland Properties (owner) (County File #3018-91) for approval to develop 124 single and multi-family residential units and two homes which will be replaced; and an appeal by Wickland Properties (appellant) on the request (Subdivision 7558) by Jerry Loving Architect (applicant) and Wickland Properties (owner) for approval to subdivide 27 . 6 acres into 124 residential units; and to consider the recommendation of the Zoning Administrator on the request by Wickland Properties to review and approve a development agreement relative to the property known as "Pointe Crockett" , in the Crockett area. Dennis Barry, Community Development Department, presented the staff report on the project . The following persons presented testimony: Dan Hall, no card submitted, for the applicant Wickland; Dick Zampa, 166 Old County Road, Crockett, representing Tormey citizens; Sabiha Gokcen, 2047 Olympic Drive, Martinez; Jane Adams, 720 Kendall Avenue, Crockett; Kent Peterson, 615 First Avenue, Crockett, representing the Crockett-Valona Sanitary District; David Rolley, on behalf of Charlotte Rolley, 612 Placer Lane, Suisun; Dr. Howard Adams, 720 Kendall, Crockett; Kathy Adams, P.O. Box 988, Martinez, representing Industrial Association of Contra Costa County; Scott Anderson, 2709 Mayflower Drive, Antioch, representing the Industrial Association of Contra Costa County; Sherri Anderson, no address given; Kasha Kessler, 565 Clark Street, Crockett, presented written objections to the proposed project; Jerry Loving, applicant/appellant; Gary Rubenstein, Sierra Research, Sacramento; Mark Armstrong, Gagen, McCoy, McMahon, Armstrong, representing the Pointe Crockett Project, responded to issues raised. Supervisor Smith moved to close the public hearing. Supervisor Bishop seconded the motion. The vote on the motion was unanimous . The public hearing was closed. Supervisor Smith expressed concerns relative to UNOCAL and the operation there and how it would affect this proposal in the future and he expressed a desire to discuss the issues further with the applicant, UNOCAL and the staff, and he moved that the matter be set for decision on December 20, 1994 . Supervisor DeSaulnier seconded the motion and requested that Dr. Walker from the Health Services Department be present on that date to answer questions . IT IS BY THE BOARD ORDERED that the hearing on the above matter is CLOSED and the decision is DEFERRED to December 20, 1994 .
