SUBJECT: Adoption of Conditions of Approval for 2845-RZ, CEQA Findings and
Mitigation Monitoring Program for same
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Certify that the Final Environmental Impact Report prepared
for this rezoning application is adequate and complete, and in
compliance with provisions of the California Environmental
Quality Act.
2 . Approve the Planned Unit District Findings and the Conditions
of Approval for 2845-RZ as CONTAINED in attached Exhibit A.
3 . Adopt the Mitigation Monitoring Program as shown on attached
Exhibit B.
4 . Adopt findings as set forth in Exhibit C as the basis for the
Board's act``<ion on this proposal as shown on attached Exhibit
C.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
This P-1 rezoning request was heard by the Board on June 7 , 1994
and June 21, 1994 .
On June 21, 1994 the Board closed the hearing and set J e 28 , 1994
for decision.

On June 28 , 1994 the Board declared their Intent to Approve 2845-RZ
for up to 19 lots and directed staff to prepared CEQA Findings and
prepare a Mitigation Monitoring Program for Board approval.
Staff has worked with the applicant to develop proper CEQA
Findings. The Conditions of Approval, Mitigation Monitoring
Program and Findings are presented for Board approval and adoption.

FINDING AND CONDITIONS OF APPROVAL FOR REZONING 2845-RZ
Findings
A. The 19 unit project, as conditioned, is consistent with the County General Plan. The
project site plan and the site as amended by the proposed conditions will assure
aesthetic protection of the hillside areas. Special measures are provided to safe guard
against fire hazards (e.g., interior sprinklers, fire retardant roofs).
B. The project will constitute a residential environmental of sustainable desirability and
stability, and will be in harmony with the character of the nearby community. The
project which proposes lot sizes of approximately 5,200± square feet to 15,000±
square of net area is in character with the general range of parcel sizes located in the
surrounding area. Further, the project is proposing to set aside approximately 40% of
the total gross area of the site (2.71 acres of land, approximately) within an open
space scenic easement. The scenic easement would prevent the erection or
construction of structures within the upper portion of the site.
C. In accordance with the required findings of the Planned Unit District, the County finds
that the development of a harmonious integrated plan like this project as amended by
the attached Conditions of Approval, justifies exceptions from the normal application
of the Ordinance Code, including variations in parcel configuration and design to
provide better conformity with the environmental features of this site.
