Martinez, Executive Director DATE: December 13, 1994 SUBJECT: CLAIM AGAINST WILLIAM COURTNEY AND/OR PACIFIC DEVELOPMENT GROUP SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: APPROVE and AUTHORIZE Executive Director and County Counsel to pursue the recovery of Section 8 funds wrongfully obtained in connection with the Pelican Cove Apartment complex located at 515-565 Sunnyview Drive, Pinole, California through all available means, including but not limited to, legal action. II. FINANCIAL IMPACT: Recovery of approximately $19,374 of Section 8 funds, plus interest and costs allowed by law. III. REASONS FOR RECOMMENDATION/BACKGROUND: William Courtney and/or Pacific Development Group, a property owner participating in the Housing Authority's Section 8 program, acquired approximately $19,374 of Section 8 funds by misrepresenting its acquisition and ownership of certain properties receiving housing subsidies under the Section 8 program. The purpose of this action is to pursue the recovery of those funds. IV. CONSEQUENCES OF NEGATIVE ACTION: The Housing Authority's efforts to recover the misappropriated funds may be impeded.
