SUBJECT: ACCEPT LETTER FROM THE STATE DEPARTMENT OF TOXIC SUBSTANCES CONTROL
AND AUTHORIZE ENVIRONMENTAL REVIEW SERVICES FOR THE WEST CONTRA COSTA
SANITARY LANDFILL CLASS I CLOSURE

RECOMMENDATIONS
Accept letter (attached) from the State Department of Toxic Substances Control
(DTSC) and authorize Environmental Review Services to be carried out by the County
Community Development Department (CDD) on the closure of the Class I West Contra
Costa Sanitary Landfill (WCCSL) pursuant to the terms of the 1989 Agreement.
FISCAL IMPACT
None to the County General Fund. The costs for the environmental review and related
staff services will be paid by WCCSL as part of the closure application and review
process.
BACKGROUND/REASONS FOR RECOMMENDATIONS
In 1989, the Board of Supervisors approved and authorized an Agreement with the
State Department of Health Services (DHS) for the Community Development
Department to carry out the environmental review work for DHS projects located in
Contra Costa County. As part of that Agreement in October, 1990, the Board
specifically authorized CDD to "manage the preparation of EIR" for closure of the
Class I unit of WCCSL. The Department of Toxic Substances Control (DTSC) has
taken over the responsibilities for Class I Landfill closures previously handled by the
State Department of Health Services (DHS).

The attached letter serves to clarify the original 1989 Agreement with the State
Department of Health Services (DHS), including the scope of work for County
services. More specifically, the attached letter acknowledges that (1) DTSC succeeds
to all the duties and responsibilities of DHS, (2) the 1989 Agreement remains in full
force and effect, and (3) the County Community Development Department will assist
DTSC in carrying out the environmental review for the Class I West Contra Costa
Sanitary Landfill closure pursuant to the terms of the 1989 Agreement.
CONSEQUENCES OF NEGATIVE ACTION
If the Board does not authorize CDD staff to carry out Environmental Review Services,
considerable delay in completing the environmental review work will be likely. Such
delay could impede construction of transfer, material recovery, and composting
facilities planned for the West County area.

Dear Ms. Fujii:
Pursuant to our telephone conversation last week, this is to
confirm that the Department of Toxic Substances Control (DTSC) ,
as the successor agency to the Toxic Substances Control Program
of the California Department of Health Services (DHS) , succeeds
to all the duties, powers and responsibilities of DHS, including
those as provided in the Environmental Review Services Agreement
entered into between DHS and the county of Contra Costa (County)
in 1989 (Agreement) . This Is also to confirm that said Agreement
remains in full force and effect between DTSC and the County. A
copy of this Agreement is enclosed herewith.
By letter dated August 31, 1994, DTSC has requested the
County's assistance in the implementation of the California
Environmental Quality Act (CEQA) p including the preparation of
the Environmental Impact Report, for the closure of the West
Contra Costa Sanitary Landfill Hazardous Waste Management
Facility project, pursuant to the terms of the Agreement. DTSC
looks forward to working closely with the County to complete the
CEQA process.
