HomeMy WebLinkAboutMINUTES - 12131994 - 1.89 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA SUBJECT: Expanding the License RESOLUTION NO. 94/616 Area of Viacom (C.C.C. Ordinance No. 82-28, Cablevision Section 58-4 . 004 ; Gov. Code Section 53066 ) The Board of Supervisors of Contra Costa County RESOLVES that: 1 . License and Area. By Resolution dated April 24, 1984 (Resolution No. 84/241) the Board granted to Viacom Cablevision a license to construct, operate and maintain a cable television system within the Crockett-Rodeo, E1 Sobrante and San Pablo areas of Contra Costa County. The grantee has requested that the license area be expanded to cover the Port Costa area. The nonexclusive license previously granted to the grantee is hereby expanded to include the territory shown in Exhibit A attached to this Resolution. 2 . PEG Channels and Facilities . The grantee has previously executed an Agreement for the Delivery of Access Programming in Contra Costa County ( "Access Agreement" ) dated July 20, 1993 . As a part of its request for expansion of license area, the grantee has committed to provide an interconnected, dedicated channel on its system, including the area covered by the expansion, for the carriage of PEG programming provided by the County. The grantee' s acceptance of the expansion shall be deemed the grantee' s agreement that the provisions of the Access Agreement shall also apply to the Port Costa system and that such channel shall be activated on the grantee ' s entire system no later than March 1, 1995 . 2 . Remaining Terms and Conditions . Except as modified by this Resolution, all terms and conditions of Resolution No. 84/241 and the Access Agreement shall continue in full force and effect. 3 . Effective Date and Acceptance. The expansion granted herein shall become effective when the grantee has filed in a timely manner its written acceptance of the expansion and its agreement to be bound by and comply with all terms and conditions of this Resolution and the Access Agreement, as well as all of the requirements of Ordinance No. 82-28, as amended from time to time, and has delivered to the Clerk of the Board of Supervisors amended bonds and insurance policies or riders covering the grantee's operations within the above-described territory.
