Open public hearing aW receive testimony on proposed plan amendment request. 2. Certify as adequate the Negative Declaration on this project for purposes of acting on the General Plan Amendment. 3. Close public hearing and APPROVE the General Plan Amendment as recommended by staff and the County Planning Commission and to direct staff to include the plan amendment in one of the consolidated general plan amendments for 1994. FISCAL IMPACT Plan amendment costs are covered by a developer fee. BACKGROUND/MASONS FOR RI CQMA )ATIONS The Fifth and Market General Plan Amendment was recommended for approval by the County Planning Commission, by a unanimous vote, on September 20, 1994. At that meeting, the County Planning Commission certified the Negative Declaration and approved the plan amendment as recommended by staff. I CONTINUED ON ATTACHMENT: —YES SIGNATURE ACTION OF BOARD ON 9 4 APPROVED AS RECOMMENDED X OTHER _ This is the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra Costa County Planning Commission on the County initiated general plan amendment request (County. File #13-93-CO) to change the County General Plan land use designation from Commercial to Multiple Family Residential, Medium Density for two commonly owned properties in the North Richmond area. Matt Tomas, Community Development Department, presented the staff report on the proposed amendment, described the site, and commented on the staff recommendation for approval, the Negative Declaration, and the County Planning Commission' s endorsement . The public hearing was opened and no one appearing to testify, the hearing was closed. Supervisor Powers moved approval of the staff recommendation. IT IS BY THE BOARD ORDERED that recommendations 1, 2, and 3 are APPROVED; and Resolution 94/566, determining to amend the County General Plan and incorporate new policy text provisions (Attachment A) , is ADOPTED. Staff Contact: Matt Tomas (646-2036) November 8 , 1994 Orig: Community Development Department ATTESTED. cc: PHIL BATCHELOR, Clerk of the Board of CAD's Supervisors and County Administrator Dept.of Public Works Redevelopment Agency Sheriffs Dept.Deputy Eddie Wright By Deputy C l e r k Attachment A To integrate the Fifth Street and Market Avenue General Plan Amendment into the County General Plan the following new policies are proposed. 1) Amend the County General Plan Land Use Map for the plan amendment area from Commercial to Multiple Family Residential, Medium Density according to Map A, attached. 2) Add a new policy (page 3-79 and 3-80) to the North Richmond Section of the County General Plan Land Use Element - Policy 3-xxx - "The Fifth Street and Market Avenue General Plan Amendment is intended to support up to three residential units. Development of new residential units should be visually compatible with the existing residences which are just south and adjacent to this area. A density bonus is to also be considered as part of potential future development for further implementing the North Richmond Redevelopment Plan." BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on November 8, 1994 by following vote: AYES: Supervisors Powers, Smith, De Saulnier, Bishop and Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 9566 SUBJECT: In the Matter of the Fifth and ) Market General Plan Amendment) The Board of Supervisors of Contra Costa County RESOLVES that: There is filed with this Board and its Clerk a copy of Resolution No. 32-1994, adopted by the County Planning Commission, which discusses an amendment to the County's Land Use Element of its General Plan in the North Richmond area. On November 8, 1994 the Board held a hearing on said amendment was discussed by the County Planning Commission Resolution No. 32-1994. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings called for testimony of all persons interested in this matter and numerous people testified in support and opposition of this matter. The Board finds that the proposed amendment will not have a significant impact on the environment. An Environmental Initial Study and Negative Declaration was prepared and processed in compliance with the California Environmental Quality Act and County CEQA Guidelines. The Board members having fully considered this amendment determined to amend the Contra Costa County General Plan 1990-2005 from Commercial to Multiple Family Residential, Medium Density and to incorporate new policy text provisions which will be added to the County General Plan. The Board further directs the County Community Development Department to incorporate this proposed amendment to said plan into a combined general plan amendment which this Board will consider for adoption during the 1994 calendar year as one of the four permitted amendments to the mandatory elements of the County General Plan.
