Ratify the Zoning Administrator's decision that Shell Oil Company has complied with Condition of Approval #35A for the Cogeneration Unit, the Cracked Gasoline Depentanizer, the Heavy Gasoline Hydrotreater, the Distillate Hydrotreater, the Boiler Feedwater Treatment Area, the Delayed Coker Unit, and the Sulfur Recovery Unit. 2 . Ratify the Zoning Administrator' s decision that Shell' Oil Company has complied with Condition of Approval #13 which requires an update of the Spill Prevention Control and Countermeasure Plan. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS When the Board of Supervisors approved the Land Use Permit for Shell Oil Company' s Clean Fuels Project (County LUP 2009-92) , the Board specified that the Zoning Administrator' s decision regarding several Conditions of Approval must be placed on the consent calendar for ratification. As directed by the Board at the October 4 , 1994 meeting, this item has been placed on the Zoning Administrator' s agenda for November 7 , 1994 . Any comments received at this meeting will be forwarded to the Board. This noise performance standard assures that the project will not increase noise levels at the nearby residences. Shell Oil Company submitted Noise Calculations for the Cogeneration Unit, the Cracked Gasoline Depentanizer, the Heavy Gasoline Hydrotreater, the Distillate Hydrotreater, the Boiler Feedwater Treatment Area, the Delayed Coker Unit, and the Sulfur Recovery Unit. As required by the Conditions of Approval, the reports were prepared by an individual who is a registered engineer or a member of the Institute of Noise Control Engineering and who has at least five years experience in noise control engineering. The reports submitted verify; that the units will meet the noise control standards. Condition of Approval #13 - Spill Prevention Control and Countermeasure Plan: This Condition requires Shell Oil to update the Spill Prevention Plan to include the Clean Fuels Project and to inc•.lude: * Secondary containment providing 100 percent capacity for all tanks. * Segregation of oil surfaces and surface runoff by physical barriers; * Operational controls such as limited access to gates at discharge locations, logging procedures for gate operation, maintenance and inspection procedures and worker education; Shell Oil submitted their revised Spill Prevention Control and Countermeasure Plan which addresses these requirements.
