ADOPT the attached resolution amending the current agreement with the City of Martinez on the sharing of sales tax at the Shell Oil Refinery. BACKGROUND: In 1958, the Board of Supervisors and the Martinez City Council passed resolutions relative to the sharing of sales tax generated by the Shell Oil Company at the Martinez area facility. The agreement provides for a 55% County and 45% City distribution of revenue, which was based on the percentage of Shell property within the County unincorporated and City incorporated areas. The proposed amendment would clarify the 1958 agreement to include sales tax generated by construction contractors working at the Shell Oil Refinery. The Martinez City Council has already approved the same resolution. In 1958, the County of Contra Costa ("County") and the City of Martinez ("City") adopted Resolutions agreeing to a 55% County/45% City distribution of the sales and use taxes generated by the Shell Oil Martinez refinery. 2. The County and City desire to insure that the same distribution apply for the sales taxes on the materials, fixtures and equipment installed at the Shell Oil Martinez refinery during the construction project now in progress at said refinery. 3. The Board of Supervisors of Contra Costa County therefore resolves that it agrees to and approves the same 55% to County / 45% to City distribution for the sales taxes on the materials, fixtures and equipment installed at the Shell Oil Martinez refinery throughout the construction project now in progress at said refinery. 4. This resolution shall be considered jointly with the similar resolution of the City of Martinez and said resolutions shall be forwarded to the State Board of Equalization for implementation.
