MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: November 8, 1994 SUBJECT: TRANSFER OF DEDICATED FEES FROM THE DELTA EXPRESSWAY DEVELOPMENT FEE FUND TO THE STATE ROUTE 4 BYPASS AUTHORITY SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION I. Recommended Action: Approve transfer of the dedicated fees, deposited in the Delta Expressway Development Fee Fund from various Areas of Benefit in the East County for the construction of the State Route 4 Bypass, to the State Route 4 Bypass Authority trust fund for project purposes. II. Financial impact: Transfer of the dedicated fees to the State Route 4 Bypass Authority will have no financial impact on the General Fund. The transferred fees will be deposited in the State Route 4 Bypass Authority trust fund account to be specifically used for State Route 4 Bypass project purposes. III. Reasons for Recommendations and Background: The County has been collecting fees from various Areas of Benefit (Oakley Area of Benefit, Discovery Bay Area of Benefit, and the East County Region of the Countywide Area of Benefit) for the improvement of east county transportation facilities. Included in each Area of Benefit was a fee dedicated for the construction of the Delta Expressway, since renamed as the State Route 4 Bypass. The dedicated fee is deposited in the Delta Expressway Development Fee Fund quarterly. This dedicated fee would fund the County's share for the construction of the facility. If this recommendation is approved, the fees that have been previously collected and are currently held in trust for the Bypass from the various County Areas of Benefit will be applied towards the ongoing activities of the Bypass Authority in their work towards project development, design and construction. The County as well as the Cities of Antioch, Brentwood, and Pittsburg have entered into an agreement to form the East Contra Costa Regional Fee and Financing Authority. This initiates a fee program on new development in the East County for construction of three projects, including the State Route 4 Bypass. All new fees for this program will be collected by the four agencies and transferred to the Fee Authortity for disbursement on the three projects. IV. Consequences of Negative Action: If the funds are not expended towards the Bypass project, State law requires they be returned to the original applicants for building permits. They cannot be used for any other project or purpose except the State Route 4 Bypass.
