Martinez, CA 94553 RE: Discovery Bay MAC Moratorium Request The Hofmann Company would like to go on record in response to the Discovery Bay MAC's request for a "moratorium." We believe that we have complied with or intend to comply with nearly every item on their moratorium list. The following are specific responses to the individual items on the list: Item #1 The Hofmann Company intends to have up front agreements for water and sewer service with Sanitation District #19. Item #2 The Hofmann Company already has an agreement with the Byron Union School District. In addition, adequate mitigation of school facility impacts is generally a standard condition of approval in Contra Costa County. Item #3 Discovery Bay West will provide an additional access road by extending Newport Drive to the north. Item #4 Roads and Signals will have to be improved as a condition of approval per the analysis by the EIR traffic consultant and the Public Works Department. Item #5 Widening Kellogg Creek and dredging Indian Slough are measures that are not within the authority of the Hofmann Company. The Hofmann Company does not own either of these two sites. J Item #6 Discovery Bay West residents will have to pay $200 per year towards a P-District as a standard,condition of approval. A portion of this money should be earmarked to provide increased marine patrol of the area. Item #7 The Hofmann Company has no problem with Discovery Bay West paying its proportionate share for a community center. A community center site was dedicated to the County by the Hofmann Company in about 1980. The Hofmann Company, although under no obligation, was prepared to build the "shell" of a community center two years ago. State funding was arranged and everything was ready to go, until the community decided to back away from their selected site. Item #8 The Hofmann Company is and has been making a tangible effort to bring more shopping to Discovery Bay. The increase in population from Discovery Bay West will help make a supermarket much more feasible. Item #9 The residential density at Discovery Bay West is actually less than that at Discovery Bay. The overall density is only slightly higher. (See attached density comparison table.) Item #10 Discovery Bay West will comply with the county's park requirements. The Discovery Bay West plan includes more than 23 acres of parks, whereas the county requirement is only for.15.6 acres.
