MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: November 2, 1993 N,� SUBJECT: CLARIFICATION OF CONDITION OF APPROVAL NO.20D FOR SUBDIVISION 7330 IN THE OAKLEY AREA SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. Recommended Action: ACCEPT report from the Public Works Director and APPROVE clarification of condition of approval for Subdivision 7330. H. Financial impact: None to the General Fund. 1111. Reasons for Recommendations and Background: Subdivision 7330 is located on Oakley Road, approximately 646 feet east of Live Oak Avenue. On October 23, 1989, the East County Regional Planning Commission denied the application for Subdivision 7330. The Planning Commission decision was appealed by the applicant, and on November 14, 1989, the Board of Supervisors heard the appeal and approved the project with modifications to the Conditions of Approval. One of the concerns raised by the Planning Commission was access. There was only one County maintained road proposed to serve the 102 lot development. The Board of Supervisors approved the subdivision with Condition of Approval 20D, which required "a temporary 24-foot wide paved access road shall be built across Lot 13. It shall remain until a second access road is built". At the present, the subdivision is almost built out and all the infrastructure improvements are almost complete. Oakley Road is being realigned and widened at this location. It has been noted that there is limited sight distance for cars using the temporary access road to exit from the subdivision to Oakley Road. Cars that leave the subdivision can not see pedestrians or bicyclists on the meandering sidewalk, along Oakley Road. Their view is blocked by the soundwall. In addition, the temporary road will be steepened with our vertical realignment of Oakley Road. Because of the safety problem arising from the limited sight distance and the steeper grade on the temporary access, it would be preferable to close the temporary access for day-to-day operations and provide it for emergency use only. There is no need, from a transportation perspective, to have two-full access points into this subdivision. The Fire District has reviewed this and concurs that the temporary access is not necessary on a full time basis. Gates could be installed across the temporary access and it could be kept for emergency use only. The Condition of Approval could be interpreted to provide for emergency access to Oakley Road, rather than a full access. It is our recommendation that the Condition of Approval be clarified to provide for a temporary access for emergency use only. This would eliminate the safety hazard to pedestrians and any bicyclists that use the sidewalk. IV. Consequences of Negative Action: A potential safety hazard created by the temporary access would not be corrected.
