Honorable Supervisors :
I am a. Kensington resident of Contra Costa County and I
wish to go on record to object to your granting any'further
Memorandums of Understanding and Transitional 'Permits with
respect to Kensington Community Service District/Bay View
Refuse Service garbage and recycling services . I further
request that you cancel forthwith any existing MOU' s and
TP's with respect to the same . This objection and request
is made because I am satisfied that I am being, and have been,
defrauded by the arrangement between the District and Bay View.
Supervisor Thomas Powers has in his possession document-
ation which establishes my claim that Bay View has overcharged
the Kensington resident. the sum of $25 .50 for recycling
services for the period January 1 , 1991 through June 30 , 1992
and that the District has been requested to secure refund for
the overcharge . It refuses to do so. Bay View has also been
requested and it fails to do so .
Supervisor Thomas Powers has in his possession document-
ation which establishes my claim that the District and Bay View
have conspired to tax the Kensington resident (in violation of
the Constitution of the State of California) . First , by estab-
lishing garbage and recycling rates out of which Bay View pays
the District thousands of dollars . Second, by agreeing that
the recycling charges collected by Bay View from the Kensington
resident are to be remitted to the District. As to this second
point: (1 ) I have requested an accounting from the District
but it fails and refuses to furnish it, and (2) there is a
conflicting provision that Bay View is entitled to retain the
recycling charges . Request has been made for a refund of said
tax but neither Bay View nor the District have refunded the same .
Supervisor Thomas Powers has in his possession document-
ation which establishes my claim that (1 ) Bay View was under
legal duty to collect the recyclable materials for the entire
term of the contract (June 30, 2009) commencing January 2 ,
1991 , (2) the residential customers were not obligated to make
any payment for collection of recyclables subsequent to June 30 ,
19921 (.3) Bay View was entitled to the revenues from the recycl-
ables , and (4) that these revenues and the payments Bay View
received from residential customers on and before June 30 , 1992 ,
represent the full entire and complete compensation due to Ba
View for tfte entire remaining term of ttle contract commencing
January 1 , 1991 . Notwithstanding the foregoing, Bay View and

the District conspired to defraud the Kensington resident
by entering into an agreement to charge the Kensington
resident for recycling services for the period July 1 , 1992
through June 30 , 1994. Request has been made for a refund for
the excessive payments but no refund has been made .
Supervisor Thomas Powers has in his possession document-
ation which establishes my layman' s claim about "franchises" .
I question whether the Board of Supervisors is properly
using said term in its MOU's , TP's , resolutions and ordinances .

Attached is a Resolution passed by the East Bay
Regional Park District Board of Directors endorsing the
extension of the 1/2 cent sales tax contained in
Prop 172.
Although the District is not designated to receive
these revenues, the Board believes that passage of this
measure is essential to local government funding
stability.

RESOLUTION NO. 1993-10-289
October 19, 1993
APPROVAL OF RESOLUTION REAFFIRMING BOARD SUPPORT FOR
A PERMANENT EXTENSION OF THE 1/2 CENT SALES TAX
WHEREAS, State funding of local government services has been
significantly reduced during the last two budget years; and
WHEREAS, the passage of an extension of the 1/2 cent sales
tax contained in Proposition 172 on the November 2, 1993 special
election ballot is projected to generate $714 million for FY 93-
94 and approximately $1.5 billion in revenue beginning in FY
1994-95; and
WHEREAS, the East Bay Regional Park District Board of
Directors has previously supported legislative measures providing
for the extension of the 1/2 cent sales tax;
NOW, THEREFORE, BE IT RESOLVED, that the Board of Directors
of the East Bay Regional Park District hereby reaffirms its
support for the permanent authorization of the imposition of an
additional 1/2 percent rate of sales and use tax included in
Proposition 172.

Ted Radke and adopted this 19th day of October 1993, by
the following vote:
