SUBJECT: Execute Program Supplement No. 19 for the Widening and Signalization of Oakley Road
from Empire Avenue to Live Oak Road.

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE and AUTHORIZE the Chair of the Board to execute Program Supplement No. 19
which provides State-Local Transportation Partnership Program funds for the widening and
signalization of Oakley Road from Empire Avenue to Live Oak Road in Oakley.
II. Financial Impact:
Program Supplement No. 19 entitles the County to receive $117,399.00 from the State-Local
Transportation Partnership Program for expenses related to construction of the project.
III. Reasons for Recommendations and Background:
On June 26, 1990 the Board authorized the Public Works Director to apply for Senate Bill 300
funds for various road improvement projects. The widening and signalization of Oakley Road
from Empire Avenue to Live Oak Road is one of the projects submitted in the third funding cycle
of the State-Local Transportation Partnership Program (Senate Bill 300).
On August 14, 1991 the application for funds for the project was accepted by the California
Department of Transportation.

III. Reasons for Recommendations and Background: (Continue)
On February 12, 1991 the Board approved the State-Local Entity master Agreement No. SLTPP-
5928 between the County and Caltrans. The agreement entities the County to receive the State
share of funds for road projects that were accepted in the Transportation Partnership Program.
IV. Consequences of Negative Action:
The County will not receive the Transportation Partnership funds for this project.

This Program Supplement is hereby incorporated into the State-Local Trans-
portation Partnership Program Agreement for State Share Funds which was
entered into between the Local Entity and the State on 03/15/91 and is
subject to all the terms and conditions thereof . This Program Supplement
is adopted in accordance with Paragraph 3 of Article I of the aforemen-
tioned Master Agreement under authority of Resolution No . ,
approved by the Local Entity on (See copy attached) .
The Local Entity further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with any covenants or
remarks setforth on the following pages .

SPECIAL COVENANTS OR REMARKS
1 . It is mutually understood between the parties that this
contract may have been written before ascertaining the
availability of legislative appropriation of funds, for
the mutual benefit of both parties, in order to avoid
program and fiscal delays that would occur if the
agreement were executed after that determination was .
made.
The total amount of State-Local Transportation
Partnership funds payable by the State shall not exceed
$0 to be encumbered and reimbursed as follows :
FY 92-93 $ 0
FY 93-94 117399
FY 94-95 0
Any increase in State Partnership funds will require a
revised program supplement .
Any decrease in State Partnership funds will require a
revised finance letter.
2 . The State Funds Share is calculated based on the lower of the
approved eligible application amount or the eligible award
amount .
3 . The Reimbursement Ratio for this Cycle 3 (92/93) project is
21 . 57% .
4 . In accordance with the State and Local Transportation Partnership
Program Guidelines dated April 1992, Section IV, Project
Eligibility, the 100-. allowance for construction engineering and
contingencies is not eligible after Cycle 2 . Only state/agency
furnished materials can be added to the contract item cost for
State Partnership funds eligibility.
