SUBJECT: DRAINAGE AREA 104-SAND CREEK BASIN - ANTIOCH AREA

SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A. ACCEPT side letter agreement dated October 8, 1993 from OXY USA, Inc.
B. AUTHORIZE Chief Engineer to execute said side letter agreement on behalf of the District.
II. Financial Impact:
Cost savings to the Flood Control District as OXY USA, Inc., has agreed to remove its pipelines
from District property at its own expense.
III. Reasons for Recommendations and Background:
This property was purchased for the Sand Creek Basin. OXY USA, Inc., has agreed to
relinquish their surface rights under their existing Oil & Gas Lease and has agreed to remove
its pipelines at its own expense when required to do so by the District in exchange for an
indemnification by the District.
IV. Consequences of Negative Action:
District may incur cost to remove said pipelines. .
