SUBJECT: CONSIDER AWARD OF CONTRACT FOR LOS ARBOLES HOUSING MODERNIZATION
PROJECT, CA011008, LOS ARBOLES, OAKLEY, CALIFORNIA
I. RECOMMENDATION:
AWARD the contract W.A. Thomas Co.,'!Inc., the lowest responsible bidder, for the Los Arboles Housing
Modernization Project, CA011008,Oakley, in the amount of$1,405,000; DENY the protest of the bid award by MCS
Systems Inc. AUTHORIZE the Executive Director''of the Housing Authority to execute a contract with W.A.Thomas
Co.Inc. pending receipt of satisfactory performance and payment bonds and insurance certificates, as recommended
by the Advisory Housing Commission.
II. FINANCIAL IMPACT:
This contract is funded by HUD's Comprehensive Grant Program (CGP). There are no County general funds
involved in the funding of this contract.
III. REASONS FOR RECOMMENDATION/BACKGROUND
Bids for the above captioned project were received on October 6, 1993. There were four (4) bids received.
Funding for this public housing modernization project is provided through the U.S.Department of Housing and Urban
Development's Comprehensive Grant Program.
The work involved in this contract is the comprehensive modernization of the 30 dwelling units at our Los
Arboles public housing development in Oakley.
A bid protest was received from MCS Systems, Inc., one of the four bidders on the project. The basis of the
protest was the allegation that W.A.Thomas,Inc. did not fulfill the Minority Business Enterprise (MBE)and Women
Business Enterprise (WBE)requirements stated in:,the bid documents. Upon review by staff,it was determined that
W.A.Thomas had fulfilled the MBE/WBE requirements and,it is therefore, recommended that the protest be denied.
This matter was reviewed by the Housing Advisory Commission at its regular meeting on October 18, 1993
at which time the Commission concurred with the recommendation as stated herein.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect not to approve the execution of a contract with W.A. Thomas,Inc.
the Housing Authority will experience scheduling delays which may jeopardize funding allocated to this
project.
