AUTHORIZE the County Probation Officer to execute an agreement with the County Office of Education for the provision of probation services from September 15, 1993 through June 15, 1994. The agreement would require the increase in hours of a 20/40 deputy probation officer position to 28/40 and to be dedicated to the Community Schools Program, the costs for which would be offset by fees charged to the County Office of Education. 2. ADOPT the personnel adjustment resolution increasing the hours of one 20/40 deputy probation officer position to to 28/40, to be funded directly from fees to be charged to the County Office of Education. FINANCIAL IMPACT: This agreement will result in a zero net county cost impact. BACKGROUND: The Probation Department has had an ongoing, in-kind relationship with the Community Schools Program (administered by the County Office of Education) for many years. This agreement proposes to accelerate referrals of pupils to the Program and when appropriate, designate those pupils as W&I Code Section 601 status offenders. The Probation Department would continue to monitor each pupil's progress in the Program and make recommendations on future disposition of each pupil. Since part of the Community Schools Program funding is based on the average daily attendance, the increased number of pupils referred to the Program will generate additional revenues which will be used to fund the part time deputy probation officer. Buck, County Office of County Probation Officer Education / Probation Agreement Last March we entered an agreement with County Schools in which they paid for a 20/40 deputy probation officer to work with Community School referrals and students . The agreement was approved by the Board of Supervisors and ended with- the school term. We 're now ready to enter another agreement for the 1993-94 school year in which they will pay for a 28/40 deputy probation officer from September 15, 1993 to June 15, 1994 . (See attached. ) My question is this, does the new agreement have to be Board approved? If so, will you place it on agenda. Term. The effective date of this agreement is September 15 , 1993 and it terminated June 15, _1994 unless sooner terminated as provided herein. 2 . Termination. This contract may be terminated by either party upon 30 days written notice to the other party. 3 . Pavment Limit. CCCOE' s total payments to County under this Agreement shall not exceed $31, 126 . Subject to the payment limit, CCCOE shall pay County $3 , 459 per month by the 10th day of each month of service as described below. 4 . Provision of Deputy Probation Officer_. County shall provide CCCOE with one (1) County Deputy Probation Officer (DPO) for 28 hours per week who shall perform the services designated in paragraph 5 below. County shall assign the DPO to work at CCCOE' s Community Schools . S . Deputy Probation Officer' s Duties . The DPO shall screen pupils, grades 7 - 12, referred by school districts, who are truant, runaway or out of control, and when appropriate designate them as status offenders under Welfare and Institutions Code section 601 and when appropriate, refer them to the CCCOE' s Community Schools for enrollment pursuant to Education Code section 1981 (c) . Upon the enrollment in the Community Schools of a pupil referred by the DPO, the DPO shall monitor the pupil ' s adjustment and serve as a consultant with Community School staff and parents . After the pupil' s sixth month of enrollment in the Community Schools, or reassignment to another program, The DPO shall also perform all of those duties and responsibilities included in Attachment A hereto, "Duties and Responsibilities of DPO assigned to Community Schools" which Attachment is incorporated by reference herein. 6 . Selection of DPO. County shall be responsible for the recruitment and selection of the DPO it assigns to the Community Schools . CCCOE may at any time report to County its concerns about the DPO performing services under this agreement . 7 . Employee' s Status. The DPO employed in the performance of services under this contract is a County employee, and shall not have, and shall not acquire any workers' compensation coverage, employment benefit, pension, civil service, or other status or right which CCCOE confers upon its employees. T 8 . Supervision. County shall provide primary supervision of the DPO. 9 . Work Schedule. County and CCCOE will mutually agree upon a work schedule for the DPO. 10 . Office Space and Supplies. CCCOE shall provide for the DPO at its Community Schools Office, office space, equipment, supplies, and access to California Education and Welfare and Institutions Codes and CCCOE policies and procedures . 11 . Reports. For audit purposes, the DPO will provide CCCOE with quarterly reports regarding referral of students to Community Schools, review of students' status, monitoring of students enrolled in the Community Schools, and number of students served. 12 . Compliance with Rules . While on CCCOE' s premises, the DPO shall abide by CCCOE' s rules . 13 . Indemnification. a. County shall defend, save harmless and indemnify the CCCOE and its officers, agents and employees from all liabilities and claims for damages for death, sickness or injury to persons or property, including without limitation, all consequential damages, from any cause whatsoever arising from or connected with the operations or the services of the County hereunder, resulting from the conduct, negligent or otherwise, of the County, its agents or employees . b. CCCOE shall defend, save harmless and indemnify the CCCOE and its officers, agents and employees from all liabilities and claims for damages for death, sickness or injury to person or property, including without limitation, all consequential damages, from any cause whatsoever arising from or connected with the operations or the services of the CCCOE hereunder, resulting from the conduct, negligent or otherwise, of the CCCOE, its agents or employees . 14 . Appropriations. All terms and conditions of this agreement are subject to the continued appropriation and availability of funds for each party for the performance contemplated herein. 15 . Amendments. This agreement may be modified or amended by a written document executed by County and CCCOE. 16 . Compliance with law. The parties shall be subject to and comply with all Federal, State and local laws and regulations applicable with respect to its performance under this agreement, including but not limited to, licensing, employment and purchasing practices, wages, hours and conditions of employment, including non-discrimination. -2- 17 . Nondiscriminatory Services . The parties agree that all goods and services under this contract shall be available to all qualified persons regardless of age, sex, race, religion, color, national origin, or ethnic background, or disability, and that none shall be used in whole or in part, for religious worship or instruction. 18 . Independent Contractor Status. This agreement is by and between two independent contractors and is not intended to an shall 1 not be construed to create the relationship between the parties of agent, servant, employee, partnership, joint venture, or association. 19 . Stewart County Superintendent of Schools County of Contra Costa By: Chairman\Designee Cc-+t) -3- ATTACHMENT A DUTIES AND RESPONSIBILITIES OF DPO ASSIGNED TO COMMUNITY SCHOOLS The County of Contra Costa (County) for its Probation Department and the Contra Costa County Office of Education have entered into an interagency agreement from February 16 , 1993 , to June 30 , 1993 , in order to better serve students enrolled in the Community Schools. The County DPO assigned to this project will be an integral part of .an interagency team consisting of Community School staff and Probation staff . The primary duties and responsibilities of the DPO are as follows : A. Supervision: The DPO will regularly initiate face-to-face contacts with students enrolled in the Community Schools . The DPO will communicate regularly with the students, staff, parents/guardians, and other concerned parties . The DPO will also conduct student and/or parent conferences, and maintain on-going supervision of the students as needed. B . Monitor: The DPO will monitor students' adherence to their terms and conditions of probation as determined by DPO. Failure to comply with terms and conditions of probation may result in alternative sanctions or return to Juvenile Court . C.. Guidance : The DPO will work with students individually and in small groups to help them develop behaviors and attitudes which will enable them to succeed in school , vocational and community settings . The DPO will also participate in problem-solving and decision-making with students, school and staff, and/or parents/guardian, Issues discussed may include attendance, school performance, school placement and behavior. D. Resource: The DPO will serve as a resource person to Community School staff . The DPO will be accessible to the Community School administrator, students, school staff and parents/guardians of students . .E. Liaison: The DPO will serve as liaison between Community School personnel, county probation department personnel and outside agencies. The DPO will maintain ties with community agencies and law enforcement agencies . The DPO will also refer students to community agencies for specialized services when necessary. F. School Safety: The DPO will work with Community School ' s staff to provide a safe campus environment, and may be called upon to exercise peace officer' s responsibilities insofar as he is authorized to do so by law.
