AUTHORIZE the Chairman of the Board of Supervisors to send a letter to the State Fire Marshal, urging that when there is next a vacancy in the public member seat on the Oil Refinery and Chemical Plant Safety Preparedness Act Technical. Advisory Committee (AB 100 Committee) the State Fire Marshal consider appointing an individual who not only meets the requirements of Government Code Section 51022 (a) ( 1) (G) , but also represents other viewpoints that may not otherwise be represented on the Committee. / 2 . REMOVE this item as a referral to our Committee. BACKGROUND: On July 13, 1993, the Board of Supervisors referred to our Committee a recommendation from. Supervisor Bishop that a new appointment be made for the public member position on the Oil Refinery and Chemical Plant Safety Preparedness Act Technical Advisory Committee (AB 100 Committee) . On October 11, 1993, our Committee met with William B. Walker, M.D. , County Health Officer, who is also a member of the AB 100 Committee. A copy of Dr. Walker' s report is rattacKed 1A so a_t &c,h_ed:a-_is a letter from Mr. Denny Larson, Campaign Chair for Citizens for a Better Environment regarding his organization's objections to the background of the current public member. Walker, M.D. , County Health Officer Denny Larson, Campaign Director, CBE ,DEPUTY I.O.-12 -2- Section 51022 of the Government Code outlines the membership of the AB 100 Committee and provides that the State Fire Marshal will appoint- 15 of the 19 members of the Committee. One of the members is a public member who must have " . . .expertise in hazard analyses, emergency preparedness planning, or environmental protection" . As Mr. Larson' s letter indicates, he and his organization believe that the current public member has a conflict of interest and should be replaced. Our Committee does not believe that it is appropriate for us to ask the State Fire Marshal to fire the individual he has chosen to appoint as the public member and replace that individual with someone like Mr. Larson. We are, however, willing to recommend that the Board of Supervisors write to the State Fire Marshal and ask that if and when there is a vacancy in the public member position that he consider appointing someone who not only meets the requirements of the law, but also represents viewpoints which may not otherwise be represented on the Committee. t , SEL Contra Costa County Health Services Department `= CONTRA COSTA COUNTY ' a _ William B. Walker, M.D. Lt/v6-7 Health Officer DATE: September 7, 1993 SUBJECT: AB 100 COMMITTEE - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - This is in response to your memorandum of August 23 requesting information about the Technical Advisory Committee on Oil Refinery and Chemical Plant Safety Preparedness (AB 100 Committee). This Committee was established pursuant to the provisions of California Government Code . Section 51022. The Committee is advisory to the State Fire Marshall and is charged with three key responsibilities: 1. Providing recommendations to the State Fire Marshall on the adequacy of existing State and Federal statutes and regulations intended to protect communities located near oil refineries and chemical plants and recommendations to resolve overlap, duplication and inconsistencies among State and Federal statutes and regulations governing emergency plans, practices and requirements. These recommendations are to be considered by the State Fire Marshall in preparing a report to the Legislature on these issues. 2. Providing recommendations to the State Fire Marshall on a program of grants to local public agencies and accredited colleges and universities or other entities, to further the public safety and environmental protection goals of the program. 3. Providing recommendations regarding the development of a clearinghouse of information for the purpose of ensuring effective communication among public health and safety agencies, the communities they serve and the operators of refineries and chemical plants. This Committee will sunset January 1, 1997. At your request, I have enclosed information on the Committee's membership. Please note that the information in the "Position" column is directly out of the law which was very specific as to its membership. There are currently two vacancies, neither of which are the public member position. The State Fire Marshall serves as the Chair of the Committee and is the appointing power for all members. As you know, Contra Costa is home to the largest number of oil refineries and chemical plants outside of L.A. There are a number of local residents that OUTDepartment has worked with over the years who are knowledgeable and articulate and would be excellent members of your Committee. Three of them serve on or are alternates to the hazardous Materials Commission and have been recommended to your staff for invitation to the next meetin&which will be held in Contra Costa.
