SUBJECT: 1993 Great American Smokeout
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
Recommendations :
1 . AUTHORIZE the County to Hold Harmless East Bay Regional Park
District for the use of the Martinez Regional Shoreline Park
on Thursday, November 18, 1993 for the 8th Annual "Cold
Turkey Trot" Fun Run and Walk.
2 . APPROVE awarding of T-shirts and prizes' to County employees
participating in the 1993 Great American Smokeout activities .
Background:
On .Thursday, November 18, the American Cancer Society will
celebrate the 17th anniversary of the Great American Smokeout.
The purpose of this nationwide annual event is to encourage
smokers to give up smoking for 24 hours . The desired goal of
the Smokeout is to convince smokers to quit smoking for life
after participating in the Great American Smokeout. The
successful County participation in the Great American Smokeout
will help work toward the Board of Supervisors ' goal of a
smoke-free work environment.
For the eighth year, the Employee Wellness Program is organizing
County-wide activities for the Smokeout. A Smokeout Coordinator
representing each County department will assist the Employee
Wellness Program to promote the Great American Smokeout. The
goal being to achieve the maximum County involvement.
Planned activities for County employees for the 1993 Great
American Smokeout include:

3 . Adopt-A-Smoker Kits and other Smokeout materials
provided by the American Cancer Society will be
distributed throughout all County departments .
4 . The awarding of prizes to selected participants of the
Great American Smokeout.
To make this a successful event honoring County employees who
have quit smoking and employees who are trying to quit smoking,
the Employee Wellness Program encourages the Board to authorize
the County to Hold Harmless East Bay Regional Park District and
to approve the awarding of T-shirts and prizes to the County
employees participating in the 1993 Great American Smokeout.

Re: Cold Turkey Trot Fun Run at Martinez
Regional Shoreline Park on November 18, 1993
The County of Contra Costa has been self-insured for all
liability risks including medical malpractice and workers'
compensation arising from its operations, owned property,
equipment and leased property and equipment since 1976. The
County's self-insurance program provides for the legal defense of
officials and employees pursuant to Government Code Sec. 825 and
payment of all sums which it is obligated to pay by reason of
liability imposed by law and arising from their acts or failure
to act, excepting exemplary or punitive damages. This protection
covers services performed by officers or employees within the
scope of their official duties in accordance with the conditions
of their employment or services. With respect to workers'
compensation benefits, the County provides workers' compensation
benefits to all of its employees as required by California State
Compensation laws.
The self-insurance programs are prefunded to provide funds
for payment of claims.
Indemnification. The County shall defend, indemnify, save
and hold harmless the East Bay Regional Park District and its
officers and employees from any and all claims, costs and
liability for any damages, sickness, death, or injury to persons
or property, from any cause whatsoever arising from use or
occupancy by the County. . County will make good to and reimburse
the East Bay Regional Park District for any expenditures,
including reasonable attorneys' fees the District may make by
reason of such matters and, if requested by the East Bay Regional
Park District will defend any such suits at the sole cost and
expense of the County.
