X3 TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor Costa County Administrator x 'S Ate= o� County DATE: January 26, 1992 A uK SUBJECT: Ratification of Action by County Administrator to Proclaim a Local Emergency and to Request Governor to Proclaim a State of Emergency In Contra Costa County SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Ratify the action taken by the County Administrator on January 22 , 1993 to .proclaim a local emergency within the county, including all political subdivisions therein, and to request the Governor to proclaim a State of Emergency for said jurisdictions. BACKGROUND: The recent storms have caused emergency. conditions throughout the county. Numerous incidents, including flooding and mud slides have resulted in damage to public 'f aicilities and private properties. The Cities of Lafayette and Orinda declared local emergencies within their jurisdictions on January 13th and 21st, respectively. Both of these cities have experienced numerous mud slides, flooded streets and road washouts. .. Debris removal has been extensive in some areas. These kinds of problems have also occurred in other cities and unincorporated areas. Response to these emergencies have resulted in extraordinary expenses to the public agencies involved. Additional 'damage may result from continued stormy weather.' Based on information provided by the. County Office of Emergency Services, the County Administrator, in accordance with .Sect ions 42- 2 .802 and 42-2 .804 proclaimed .a local emergency within the county and requested the Governor to proclaim the county' to be in a State of Emergency. Such action puts the county and its political subdivisions in a position to receive any State and/or Federal financial disaster assistance- which may become available. If our county is included in a State of Emergency proclamation, public agencies would be eligible to receive some reimbursement for their emergency response costs. This action was taken as a-result of storm and/or flood damage which has occurred in certain communities within Contra Costa County. Two cities within the county, Lafayette and Orinda, have declared local emergencies and have indicated that they may be in need of mutual aid. Actual requests for mutual aid will depend upon future storm activity. The attached Proclamation will be ratified by the County Board of Supervisors on January 26, 1993. This action is being taken in order that the county or any of its political subdivisions may request State Mutual Aid as needed and/or receive any disaster financial assistance which may become available. I i PROCLAMATION DECLARING A LOCAL EMERGENCY AND REQUESTING GOVERNOR TO PROCLAIM A STATE OF EMERGENCY WHEREAS, Section 42-2.802 of the County Ordinance Code empowers the Administrator of Emergency Services (County Administrator) to proclaim the existence of a local emergency when the Board of Supervisors is not in session, but only after conferring with one or more members of the Board, including the Chairman, if available, or declaring in writing that such a conference is impossible; and WHEREAS, Section 42-2.804 of the County Ordinance Code empowers the County Administrator to ask the Governor to proclaim a state of emergency; and WHEREAS, the County Administrator does hereby find: That conditions of extreme peril to the safety of persons and property have arisen within this county, caused by storm and flood conditions commencing on January 13, 1993; and WHEREAS, the Cities of Lafayette and Orinda have declared local emergencies within their jurisdictions and have expended extraordinary resources to respond to storm/flood caused damaged and local resources. are now unable to cope with the effects of this emergency; and WHEREAS, continued storm activity may result in additional damage to public facilities and/or private property within the county or the political subdivisions within the county; NOW, THEREFORE, IT IS HEREBY PROCLAIMED that a Local Emergency now exists throughout this county including all political subdivisions therein; and IT IS FURTHER PROCLAIMED AND ORDERED that during the existence of said Local Emergency the powers, functions and duties of the Administrator of Emergency Services and the emergency organization of this county shall be those prescribed by state law, and by the ordinances, resolutions, and approved plans of this county; and IT IS FURTHER PROCLAIMED AND ORDERED that a copy of this proclamation be forwarded through the State Director of the Office of Emergency Services to the Governor of California with a request that he proclaim the County of Contra Costa including all political subdivisions therein, to be in a State of Emergency; and IT IS FURTHER ORDERED THAT Gary Brown, County Emergency Services Director, is hereby designated as the authorized representative of the County of Contra Costa for the purpose of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state and/or federal assistance for the public/private sectors. WHEREAS, finding and determining that a local emergency situation exists as a result of recent storms, that the emergency situation constitutes a nuisance which poses an immediate threat to the public peace, health and safety, and ordering i that the nuisance be abated; and WHEREAS, acting under Government Code sections 865-867 and sections 5-301 thru 8-310 of the Lafayette Municipal Code, the City Council of the Oty of i Lafayette finds, determines. and orders as follows: i 1. There are impending perils to persons and property as a result of I recent and continuing heavy rainfall. When rain falls faster than it can.drain away, i the topsoil becomes supersaturated and results in eartl; movement in various areas of the City causing potential blockage of roads which are normally open to the j 'I traveling p1blic. in particular, earth movement may impair and impeded the passage I of vehicles, pedestrians and cyclists in such manner as'to reduce the traveled way to less than minimum safety standards. This condition potentially jeopardizes the r i traveling public if slide material encroaches on the traveled right-of-way. The condition would threaten property owners with loss of both reasonable and i convenient and emergency access to their properties. Failure to remedy this condition could threaten the stability of the road bed. 1 ) 1 , 2. The condition described in paragraph 1 constitutes public nuisances within the meaning of Civil Code section 3494, Code of Civil Procedure section 731, j I Government code section 38773 and poses and immediate threat to the public peace, fi health and safety. 3. As a result, the City Council determines that appropriate remedial j } ; action to halt, stabilize and abate the impending perils and public nuisances shall consist of removal of slide material from the public properties upon which it exists i and private properties to the extent necessary to protect public properties. 4. This remedial action shall be undertaken and implemented and the City Manager is authorized to have the slide material removed and. to expend City funds for the purpose. The City Manager is further authorized and directed to perform such duties as are delegated to him as Director.of Emergency Services as set forth in section 8-306 of the Lafayette Municipal Code. ii 1 I �i I`._.._...... .. . . .. The City Council determines that to the extent that public nuisance exists on the properties in the City and that the owners of the property from which the slide material originated and upon which the slide materials exist are responsible for the abatement of the public nuisance. However, because the condition which constitutes the nuisance poses an immediate threat to the public peace, health and safety, it is therefore necessary under the circumstances for the City to undertake action to abate the public nuisance. 6: Upon completing the work necessary to abate the public nuisance, the cost shall become a special assessment against the zeal properties upon which the public nuisance existed. The assessment shall continue until it is paid, together with interest at 10% a year computed from the date the work is complete until payment. The assessment shall be collected at the same time and in the same manner as ad valorem real, property taxes-are collected, and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided.for ad valorem real property taxes. All laws applicable to levy, collection and enforcement of ad valorem real property takes apply to this special assessment. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lafayette does hereby proclaim a local emergency on January 13, 1993. It should be noted that a significant portion of the repair costs listed in this 'and my previous memorandum are due to deferred maintenance and/or provide improvements above the cost of actual damages. State and Federal relief agencies may dispute this r portion of the costs. Mark Lader, City Engineer' ` RE: Report on Storm Damage, January 12-15 As you and the City Council know, the,Bay.Area was hit by severe rainstorins beginrrirmg Tuesday night; January 12, and .lasting`.throughout 'the,week: The rains caused numerous flooding and slide problems withiin 'the City of Lafayette, culminating in a declaration- of emergency on the afternoon of the 13th. The Public, Works Department, with t3;e assistance of contractors, put in extremely, long hours before stabilizing the numerous problem areas: Ilie Public Works Superintendent pout in an 80 hour week ( I put in a.mere.£0 Hours). Maintenance worker Gary Pernich put in a 21-hour day from 11 p.m. January 12 to 8 p.m. January 13. Casts expended to date for cleanup and stabilization, including contractual services, overtime, and materials, -probably reach $50,000,and will likely increase. This does not include the regular salaries of numerous employees who spent most of the week performing storm related work instead of normal activities. It does not include die cost of claims, of which some are certain. It sloes not include the cost of long term repairs to some of the i trouble spots. { 1 have attempted to estimate some of the long-term costs below, The list is not all-inclusive, as additional problems aro uncovered on an almost daily basis. Ms. Tracy Mein-Silva Contra Costa County I Office of Emergency Services 50 Glacier Drive l Martinez, CA 94553 RE: Circumstances leading to the Mayor's Proclamation of Local Emergency,in Lafayette i I Dear Tracy: f � i The following events occurred on January 13, 1993 which led to.a declaration of emergency: 3 1 o The City's EOC was activated at 11:00 a.m, after receiving notices of I i sliding or flooding in over 50 different locations. o Heavy rain fell during a twelve-hour period ending at 10:00 a.m. on January 13. o Las Trampas Creek raised to within four feet of flooding between 9:00 I I a.m. and 10:00 a.m. o Preparations for evacuation of 72 homes in the low lying areas of Moraga Blvd. and vicinity were begun. (No evacuations were needed ' as the rain subsided and the creek water level dropped.) o Blocked storm drain at Pleasant Hill Road and Olympic Blvd. causing i flooding on Andreasen Drive. I o Mud slides closing parts of Moraga Road, Deer Hill Road, Pleasant Hill Road, Reliez Valley Road and St. Mary's Road. These are all j 4 major commute routes for adjacent communities. j o Reliez Valley Road was closed from 2:00 p.m. until 10:00 p.m. o St. Mary's Road was closed between No. Glenside and So. Glenside i at 2:00 p.m. It was reopened January 14 at 5:00 p.m. � ! o Pour-person maintenance staff was not able to keep up with the overwhelming demand for services. One crew member called had been out since 11:00 p.m. on January 12, and we were not able to relieve ' him until 8:00 p.m. on January 13. The rest of the crew was out from 5:00 a.m. until 12:30 a.m. on the 14th. o Arrangements were made with other agencies for back-up public works ! � crew capability. At least one lane suffered major damage due to,slides. . o. There were incidents o isolated oo m—g of public streets and p1lyate ,,gara ems. o Highway 680 was re-routed to Lafayette due to flooding at the 680/24 interchange. o Acalanes Road off-ramp westbound 24 was closed.due to flooded conditions. o Trees fell in Las Trampas Creek restricting flow and causing concern of damming and related flooding. Such conditions have been cumulative, finally requiring a -declaration proclaiming the existence of a local emergency by the City Manager/Director of :. Emergency Services on January 21, 1993, which was .ratif ied by the orinda city Council on that same date. Enclosed is a listing of the damages and posts currently estimated, incurred or expected, as a result of the storms. This list will be updated as our staff continues to conduct our site investigations. Based upon the information known to us at this time, I am requesting a countywide declaration of a state of emergency, and a declaration by the Governor of the State of California. The damages caused by these storms have exceeded the ability of our agency's budgeted capacity, 'necessitating assistance from the States Natural Disaster Fund.
