Accept the report of the Director of Community Development.

BACKGROUND/REASONS FOR RECOMMENDATIONS
This is a report on the status of compliance with the Conditions of
Approval for Subdivision 6333, in the Oakley area, specifically the
conditions related to parks and recreation, Conditions #4 and #6.
Staff has been in discussion with representatives of the Hofmann
Company in order to clarify how and when the company plans to
comply with the Conditions of Approval related to construction and
arrangements for maintenance of the 6 acre park site.
Staff has informally notified the company that no further final map
phases would be accepted for filing, and no further building
permits would be issued pending resolution of the issues
surrounding compliance with the park dedication condition.
In discussions with Supervisor Torlakson, Mr. Ken Hoffman
represented that the following resolution would be acceptable to
the Hoffman Company:
1. Either the Company will (A) pay the County $358, 358. 00 in the
immediate future to build the park, or (B) the company will
build the park itself, at the company's expense commencing
construction in the immediate future and;
2 . The remaining $210, 000. 00 cost associated with acquisition of
the land for the park will be recovered through Park
Dedication fees on the remaining approximately 300 units in
the subdivision.
Staff has reviewed the company's proposal for consistency with the
General Plan which was in effect at the time the project was
approved, as well as for conformity to the Oakley Parks Master
Plan. Staff will utilize the Parks Plan documents prepared by Site
Development Consultants, which were submitted to the Hofmann
Company on January 4, 1993 as the blue print for implementation of
the site improvements of this neighborhood park and staff will
pursue details of the timing, construction start up and conclusion
of both option lA and 1B and clear definition of how work quality
and timing will be assured under option 1B if that option is
exercised. In reference to #2, staff will pursue the final
definition of the amount of funds to be collected with each will
permit. Staff will report back in two weeks on status of above.

Dennis Barry, Community Development Department, presented the
report to the Board.
Supervisor Torlakson commented on a typographical error in the
second line from the bottom of the background/reasons for
recommendation, and that it should read "with each building permit. "
Supervisor Torlakson also advised that he would work with staff
on the correct amount of the work left to be done and the previously
agreed total amount.
Mr. Barry suggested a modification that the amount to be
collected through the park dedication fees be the residual of the
actual cost of site construction per the SDC specifications as opposed
to the $510,000 that was represented in 1988.
Supervisor Torlakson added that as an amendment and he moved
approval.
Mr. Heightmeyer commented on the protection issues for the school
district.
Victor Westman, County Counsel, suggested that the school
district indicate whether it is acceptable to them to have the work
done on that property and if not, what are their concerns.
Supervisor Torlakson suggested a third item to work with the
school district to resolve any timing and use of their property issues
and to note the total amount that was agreed to by the Hoffman Company
was no more than the $510, 000 as outlined in the 1988 letter outlining
conditions.
