Recommended Action: ACCEPT report. II. Financial Impact: The estimated cost for the Initial Study for the Acme site should not exceed $20,000. This will be paid for out of the Airport Enterprise Fund with support from the helicopter operators at Buchanan Field Airport. The cost of construction of the off-airport site is anticipated to be a maximum of$10,000. This would also be funded out of the Airport Enterprise Fund. Other costs involved are unknown at the present time. These unknown costs could include fees for approvals and costs associated with agreements with appropriate landowners. III. Reasons for Recommendations and Background: The attached report is self explanatory. Of primary concern have been the increasing levels of helicopter traffic and associated noise exposure to noise sensitive uses in proximity to the airport. Also of concern has been the increasing impact of helicopter training activities on overall operations of the airport, Most recently, safety has been an emerging concern expressed by area residents, heightened by three unrelated accidents. While it,appears that these accidents did not occur as a direct result of helicopter training operations, they have raised the level of concern of area residents about the art. As recently as March 26, 1991, the Contra Costa:County Board of Supervisors directed the County Public Works Director to enter into discussions with various landowners regarding the potential for locating a remote helicopter landing site for training purposes. The remote pads would consist of several prepared landing areas that would be utilized to allow training in landing, take-off, hovering and auto-rotation procedures without impacting local air traffic and residents near Buchanan Field. A number of locations have been discusser) including the Praxis site, Acme Landfill site, Byron Airport, and the Marin County heliport as well as several others. Of the above sites, the most promising seemed to be the Acme landfill and the Praxis site due both to their relative proximity to Buchanan Field and the lack of adjacent noise sensitive residential land uses. P&D Aviation prepared a preliminary safety study to determine whether a route could be developed for traffic to and from the Praxis/Acme sites without impacting noise sensitive residential uses and without overflying refinery facilities in the area. The results of this study indicated that the use of bath the Praxis site and the Acme site could be accomplished with minimal impact to surrounding properties and without direct overflights of the refinery facilities in the area. Cutler January 12, 1993 Chief of Comprehensive Planning Page 2 In response to the Board's request concerning the overall suitability of the Praxis site, we have reviewed the data contained in the FOR for a business park originally proposed to be located on the Praxis site.' The intent of this review was to evaluate the potential constraints to locating the proposed remote helicopter training facility on the Praxis site. As a result of our review, we offer the following comments. Of primary concern regarding the Praxis site is the presence of several bird and one animal species that are considered by the State and Federal government to be either endangered, threatened, or listed as species of special concern. The following list details those species and their status that have been observed on, or in direct proximity to, the Praxis site:2 a Salt Water Harvest Mouse Federal & State Endangered Species California Black Rail State Threatened o Northern Harrier Species of Special Concern Black Shouldered Kite Fully Protected Species By State o Salt Marsh Common Yellow Throat Considered Being Listed as Species of Special Concern o Suisun Song Sparrow Species of Special Concern Although the site has been significantly disturbed through grading and scraping, there is a high probability that the above species may still utilize the site as habitat due to the remaining adjacent salt water marsh environment. it seems that, had the site not been disturbed prior to the analyses undertaken during the preparation of the EIR for the Maritime Business Park, more vital habitat would have been found on the site and the site has the potential to revert to such if left alone. Although not thoroughly documented, there appears to be some potential that rare or endangered plant species may also be found on the site. Small stands of Mason's lilaeopsis (Ulaeopris masonit), a state-listed "Rare - Candidate 2' species, have been • observed on the site near the mouth of the Pacheco Sloughs While Soft bird's beak (Cordylanthus mollis mollis), a state-listed "Rare- Candidate 1" species, was not observed on the site during the biotic survey, the EIR does acknowledge that the survey 1. Cutler January 12, 1993 Chief of Comprehensive Planning Page 3 was undertaken near the end of the specimen's flowering period at which time it is difficult to identify,• As part of the review process regarding the EIR a number of environmental organizations expressed concern over development of the Praxis site. The Sierra Club, as part of their comments indicated that their organization was *deeply concerned that development was being considered on this site" and that the site "should never be developed".3 The letter goes on to state the Sierra Clubs view that, despite any grading and scraping that has occurred on the site, their organization considers the site to be wetlands and should be protected as such. The Mt. Diablo Audubon Society has also commented on the proposed facility and has indicated that the Board should deny any permit to use the Praxis site for helicopter training aCtivities.6 Mr, Brian Hunter, Region 3 Manager for the California Department of Fish and Gaine has indicated that his agency is ";reatly concerned" over the use of the Praxis site for helicopter training. He has also indicated that the proposed use "would have (a) severe detrimental effect on the use of this valuable habitat by migratory waterfowl and shorebirds". He goes on to state "We encourage the Board to deny such a request. However, should the Board decide to consider It further, a comprehensive Environmental impact Report (EIR), in compliance with provisions of the California Environmental Quality Act, should be prepared and circulated through the State Clearinghouse".' While construction of the proposed remote helicopter landing pads would not likely, in and of themselves, result in major disturbances to the site, their use by helicopters with the associated noise would most likely be seen as detrimental to the area habitat. The impacts of noise on animal species is somewhat difficult to document but is conceptually understandable and it would be difficult to counter the argument that the noise would impact endangered or threatened species living in proximity to the landing areas. In addition, one could also persuasively argue that low flying helicopters could present a hazard to bird species (and vice versa) due to the possibility of birds being flushed out by the noise and, in a state of disorientation, corning into contact with the helicopter. The site is currently designated as "Open Space" in the Land Use Element of the Contra Costa County General Plan. Under the "Open Space" designation, the Land f. Nd,pg. 121 S. Cutter January 12, 1993 Chief of Comprehensive Planning No 4 Use Element defines "appropriate uses" to include "resource management, such as maintaining critical marsh and other endangered habitats."s The designation includes the exclusion of any permanent structures "not oriented towards recreation or resource conservation". While no permanent structures are proposed, helicopter training activities would appeu to be inconsistent with the intent of the "Open Space" designation. The Conservation Element of the Contra Costa County General Pian contains policies dictating that "ecologically significant lands, wetlands, plant and wildlife habitats" shall be protected and that the preservation and restoration of"Bay/Delta estuary and adjacent lands" is encouraged.9 The Conservation Element also dictates that "avoidance, minimization and/or compensatory mitigation techniques" be employed for any project having the potential to affect a wetland.10 The element also permits the County to quire a 3:1 compensatory mitigation for any project affecting a wetland area. The element also requires the County to identify and protect seasonal wetlands'1, recognizes the "ecological value of wetland areas" and encourages the restoration of "degraded wetlands".12 Basad on the above referenced policies, it is apparent that any development of Praxis site would require a detailed environmental review, most likely an EIR, and that it would be extremely difficult, if not impossible, to reconcile the helicopter training use with the limitations dictated in County General Plan, An additional concern to be considered is the compatibility of the proposed use with the current Martinez General Plan. The current designation dictates that the site is to remain "essentially unimproved and devoted to open space". It does not appear that the proposed use would be compatible with open space type of use in that it appears the intent of the designation is to preserve the natural marsh setting. While recognizing that the site currently has been significantly degraded as a marsh, the use must still be considered in relation to the General Plan. In summary it seems apparent that from an environmental standpoint, as well as a political standpoint, there are serious constraints associated with the use of the Praxis site. The potential harm to endangered, rare, or threatened species is a valid concern. It is apparent from a review of the record that several organizations are intimately familiar with the potential habitat issues and would, most likely oppose the use of the property for helicopter training. Due to the potential environmental impacts and the potential public controversy, it is apparent that an EIR would be required to address the noted issues and extensive mitigation could be required at potentially great cost. In addition, given the regulatory requirements of both Federal and State agencies, the possibility of said agencies approving the project is remote. 8. As I discussed with you and Jim Simmons recently, we are still attempting to find an off airport site for our helicopter training activities. This is not unlike the plans that we discussed some time back with Jim Cleary and Jim Simmons. As discussed with you, the flight paths planned for the helicopters will not be flying directly over any of Tosco's sensitive areas. The nearest it will come will be when it transitions past Tosco along Waterfront Road to either the Praxis or the dump site. While the training activities are occurring in those areas they will not be flying over any of the Tosco properties. It is my understanding from our telephone conversation that this is a satisfactory explanation. I understand that you may be in contact with me at some future date to actually view the flight tracks or, if you prefer, we can arrange for a helicopter flight along the proposed flight tracks for you to view the actual planned routes. I will list each of your questions followed by the Federal Aviation Administration (FAA) response. Question 3. Restricting all helicopter traffic (not just training flights ) to non-residential areas and specified routes in and out of Buchanan Field Airport. FAA Response. Aircraft routes are developed by the FAA to ensure the safe and efficient movement of air traffic. Routes for helicopters are often developed as a result of the cooperative efforts of the airport proprietor, user groups, and the FAA. While we do not prohibit overflight of residential areas, cooperative efforts in the design of routes will often minimize such overflight. Question 5.
