'L Contra FROM: Phil Batchelor, C'ounty Administrator •, Costa County DATE: January 21, 19 9 3 °pari SUBJECT: AMEND THE BOARD OF SUPERVISORS ' 1993 LEGISLATIVE PROGRAM TO INCLUDE SPONSORSHIP OF LEGISLATION TO AUTHORIZE THE IMPOSITION OF A BENEFIT ASSESSMENT FOR LAW ENFORCEMENT AND/OR LIBRARY SERVICES SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Amend the Board of Supervisors ' 1993 Legislative Program to add item # 35, providing for the sponsorship of legislation to authorize the imposition of a benefit assessment for law enforcement and/or library services in Contra Costa County. BACKGROUND: As the Board of Supervisors is all too well aware, the budget. for the 1993-94 fiscal year is likely to be the worst ever faced in this County because of the elimination of the AB-8 property tax buy-out and Special District Augmentation Fund. The Board is already considering imposing a benefit assessment for fire service to offset the probable loss of all of the Special District Augmentation Fund. The other two major county-operated services . which are funded at present from the Special District Augmentation Fund are the library and the Sheriff 's patrol services . Assemblyman Campbell has indicated a possible interest in assisting the County and cities in the County by authoring legislation patterned after the existing benefit assessment legislation for fire service to permit the implementation of a benefit assessment for law enforcement and/or library services. BY DEPUTY t 1 The legislation which is proposed would provide the County or any of the cities with the authority to impose a benefit assessment, after notice and hearing, for any law enforcement services . In addition, the legislation would authorize the County to implement a benefit assessment for library services . Initially, it is suggested that the legislation be limited to Contra Costa County. If other counties or cities wish to be included at a later date, that can be considered by Assemblyman Campbell. The legislation, consistent with the benefit assessment legislation for the fire service, would require mailed notice to each affected property owner, a public hearing, an opportunity for filing protests, a requirement for an election if the owners of property which represents more than 5% of the value of the revenue which would be expected from the benefit assessment protest the imposition of the benefit assessment, and all other procedural protections which are afforded property owners under the existing fire service benefit assessment legislation.'
