SUBJECT: Request for Reconsideration-Symat Hillside Homes (Edward Patmont) -
Minor Subdivision 206-90-Request Approval of a revised tentative map
to divide 1.83 acres into three (3) lots, in the Walnut Creek area.
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
Grant the applicant's request for reconsideration and set a
reconsideration date.
BACKGROUND/REASON FOR RECOMMENDATIONS
On November 24, 1992, the Board denied Minor Subdivision 206-90.
In a letter dated December 2 , 1992 , the applicant requested the
Board to reconsider Minor Subdivision 206-90.
Staff has reviewed the request for reconsideration and a follow up
letter, dated December 8, 1992 and is recommending that the
applicant's request for reconsideration be granted.
In the letter dated December 8, 1992, the applicant asks that the
Board allow the applicant to reapply and waive all of the
application fees. While staff supports the reconsideration
request, staff does not support this second alternative because it
does not supply any method for payment to the Community Development
Department for staff time to process the application.

Dear Members of the Board:
I wrote you a letter dated December 2 , 1992 which respectfully
requested you to reconsider your denial of this Minor Subdivision
(please see attached) . I understand you will be taking this
matter up at you next Board meeting on December, 15, 1992 .
My purpose in appearing before you today is not to reiterate the
information put forth in this attached letter, but rather to
propose an alternate solution in the event you do not find that
reconsideration is appropriate in this matter as follows :
In the event the Board does not desire to reconsider this
matter, I would respectfully request that the Board waive
all fees for a new submittal and I agree to process a
completely new application as follows:
1. The new house would be a single story split-level house
above a garage.
2 . An accurate site model would be prepared showing the
house and the entire site.
I can assure you that I would actively seek the approval of the
adjacent neighbors by modifying the house where ever possible.
This would include at least one meeting with them (that I would
arrange at a facility nearby) in order to minimize concerns .

I truly believe this approach would result in an extremely
attractive and sensitive house design for this site.
Furthermore, it keeps the process moving ahead in a positive
manner that would appear to be beneficial to all parties .
In light of the fact that I have already paid the County over
$7 , 000 in fees processing this one homesite, waiver of future
application fees would seem appropriate and fair. Thank you for
your consideration on this matter.

Dear Chairman McPeak and Members of the Board:
I respectfully request the Board of Supervisors reconsider their
denial of my appeal of this Minor Subdivision. This matter was
last before you on November 24, 1992 .
Due to the complicated and confusing history of this application,
certain facts were omitted from the discussion. of this item. I
wish an opportunity to present new information for the Board' s
consideration. Specifically, I wish to present to the Board
three zoning Compliance forms that were issued in 1988 . Since
such compliance forms have never been rescinded, it appears that
they are still valid and thus three homes could be built on the
site.
Additionally, on March 16, 1992, the Board declared " . . .the
intent to approve an additional lot on the northern or lower
portion of the site is APPROVED. " I wish to know specifically if
the application could be modified to meet the Board' s approval .
