A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHMOND SUPPORTING THE CONCEPT OF EXPORTING SOLID WASTES OUTSIDE OF CONTRA COSTA COUNTY WHEREAS, a recent United States Supreme Court case (Fort Gratiot Landfill v. Michigan Department of Natural Resources (1992) 112 S .Ct . 2019) reviewed the waste import restrictions of a state statute which prohibited private landfill operators from accepting solid waste that originated outside the county in which the .landfill operators' facilities are located; and WHEREAS, the United States Supreme Court has decided that such restrictions are violative of the Commerce Clause of the United States Constitution; and WHEREAS, it is in the best interest of the rate payers of Contra Costa County, in general, and the City of Richmond, in particular, to obtain the lowest costs available for the disposal of solid wastes generated within the County; and WHEREAS, the search for the lowest solid waste disposal costs may lead to contracting with private landfill operators located in neighboring counties . NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Richmond expresses its commitment to seeking and obtaining the lowest solid waste disposal costs available . BE IT FURTHER RESOLVED that the City Council of the City of Richmond expresses its intentions to look beyond the boundaries of Contra Costa County in its search for the lowest available solid waste disposal costs . BE IT FURTHER RESOLVED that the City Council of the City of Richmond hereby urges the Contra Costa County Board of Supervisors to pass a resolution which supports the City of Richmond' s endeavors in obtaining the lowest available. solid waste disposal costs for the City of Richmond' s rate payers by stating that the County will not attempt 'to stop the City of Richmond (or any other Contra Costa city) from sending its solid waste out of the County . I certify that the foregoing resolution was passed and adopted by the Council of the City of Richmond, California, at a regular meeting thereof held November 9 1992, by the following vote : Ayes : Councilmembers Niccolls , Corbin, Rogers , Ziesenhenne , McMillan, Powers , Griffin, and Mayor Livingston Noes : None Absent : Councilmember Washington EULA M.
