Dear Board of Supervisors:
Pursuant to Education Code Section 5020, the County
Committee on School District Organization has adopted Resolution
92/93-1 approving the proposal to reduce the John Swett Unified
School District's Board from 7 member to 5 members. The action
of the County Committee constitutes an order for election.
Education Code Section 5020 provides that the issue of
reducing the number of Governing Board members be placed on the
ballot within the District not later than the succeeding election
for District Governing Board members. The Board of Supervisors
is requested to consolidate this ballot issue with the general
election to be conducted on November .-?-, 19W. 4/

Members.
WHEREAS, the John Swett Unified School District Governing Board
pursuant to California Education Code Section 5019 has adopted'Resolution
No. (91-92) 40 requesting the Contra Costa County Committee on School
District Organization to conduct a hearing concerning the matter of
decreasing said Governing Board from seven members to five members; and
WHEREAS, the said Governing Board Resolution states that the
Board is in favor of decreasing the number of said Governing Board
members from seven members to five members; and
WHEREAS, the County Superintendent of Schools has determined that
the John Swett Unified School District Resolution is sufficient for
consideration; and
WHEREAS, the Committee has conducted hearings in the John Swett
Unified School District on these dates, December 15, 1992, and May 27,
1992, to consider the matter;
NOW, THEREFORE, BE IT RESOLVED by the Contra Costa County
Committee on School District Organization that the proposal contained
in the John Swett Unified School District Resolution No. (91-92) 40,
concerning decreasing the number of said Governing Board members from
seven members to five members, be approved; and
BE IT FURTHER RESOLVED, pursuant to Education Code Section 5020,
that this Resolution 92/93-1 shall constitute an order of election, and
that the proposal to decrease the number of said Governing Board members
from seven members to five members must be presented to the electors of
the John Swett Unified School District not later than 'the succeeding
election for members of said Governing Board; and
BE IT FURTHER RESOLVED that the County Superintendent of Schools
is directed to perform all of his statutory duties in arranging the
above-referenced election in the John Swett Unified School District.

A special meeting of the County Committee on School District Organization was called to
order at 6:31 p.m. with the recitation of the Pledge of Allegiance.
ROLL CALL: Paul Williamson (arrived at 6:45 p.m. ) , Alpha Quincy, Florence McAuley, Daniel
Borsuk,' Pamela Mirabella
Absent: Sherry Johnson
Others: John Hendrickson, Pat Meehan, County Office staff; Jon Frank, Al Jusaitis, Jim
Delgadillo, Gail Nichols, Kay Nelson, John Swett Unified School District. A
partial list of attendees is on file in the County Office.

APPROVAL OF MINUTES
The minutes of July 8, 1992, were inadvertently left out of the Committee members' packets.
Copies were distributed and members took time out to read the minutes. It was moved by
Mrs. McAuley, seconded by Mr. Borsuk, and passed unanimously, to approve the minutes of
.July 8, 1992, with the correction of a typographical error (Williamson. Johnson, absent) .
PUBLIC HEARING
John Hendrickson, Deputy Superintendent, County Office of Education, gave background on
the hearing of May 28, 1992, which was being continued this evening. He referred to
County. Counsel's opinion regarding Education Code section 35012(a) , which discusses terms
of office for school district governing board members. Mr. Hendrickson pointed out that a
County Committee resolution had been prepared (copies of which were distributed) should the
Committee decide to approve or disapprove the John Swett Unified School District Board of
Education Resolution No. (91-92) 40 to reduce its Board from seven to five members, and
that such proposal be placed on the ballot. Adoption of the County Committee Resolution
No. 92/93-1 approving the reduction would constitute an order of election, and the proposal
to decrease the number of board members would have to be presented to the electors of the
district not later than the succeeding election for board members; in this case. November,
1994.
Chairperson Mirabella reopened the public hearing. Those speaking against the reduction
were members Al Jusaitis and James Delgadillo, John Swett Unified School District Governing
Board. Reasons cited were the diversity of the area which included four different
communities, .better representation with seven members, cost of putting the issue on the
ballot, and insignificant savings that would be realized.
Those speaking in favor of the reduction of Board members from seven to five were members
Gail Nichols and Kay Nelson, John Swett Unified School District Governing Board.
Proponents of the five-member board cited cost savings over the long term, the fact that
only two communities are currently represented by the seven members, and that they would
like the issue placed on the ballot so that voters could indicate their choice.

Chairperson Mirabella then closed the hearing to public input and Committee members asked
questions of several of the speakers. After deliberation and statements from several
Committee members indicating their agreement with 'the reduction of Board members and/or the
right of the voters to make their own decision, it was moved by Mrs. Quincy, seconded by
Mrs. McAuley to adopt the County Committee on School District Organization Resolution No.
92/93-1 in the matter of approving the proposal in the John Swett Unified School District
Governing Board Resolution No. (91/92) 40 concerning decreasing the number of governing
board members from seven to five, and that adoption of Resolution 92/93-1 constitutes an
order of election. • A suggestion was made that, in order to avoid confusion to the
electorate, the district should consider placing this issue on a ballot prior to the
election of Board members, perhaps in June, 1994. Jon Frank, Superintendent of John Swett
Unified School District, and members of the district's board questioned the advisability of
this since the district would incur the costs of the additional election.
AJOURNMENT
There being no further business, the special meeting was adjourned at 7:10 p.m.

Re: Request for Public Hearing
WHEREAS, Members of the community have stated that the Board of Education of the John Swett
Unified School District should be reduced to decrease expenses and increase efficiency; and,
WHEREAS, Education Code 5019 provides that the County Committee . on School District Organization
has the power to place a resolution on Board reduction on the ballot;
NOW, THEREFORE, BE IT RESOLVED: That the John Swett Unified School District Board of Education
be reduced from seven to five members, that a hearing be conducted by the County
Committee in this regard, that the County Committee approve this proposal, and that such
a proposal be made to the voters.
PASSED AND ADOPTED this fourth day of May, 1992, by the Governing Board of the John Swett Unified
School District by the following vote:
Ayes: Zoe Lighty, Kay Nelson, Diana Schleich, Karen Werth
Noes: Al Jusaitis, James Delgadillo, Steve Palmer
Absent: None
I HEREBY CERTIFY that the foregoing Resolution No. (91-92)40 was duly introduced, passed, and
