This is the time heretofore noticed for hearing on the appeal by Winton and Nathalie Jones from the decision by the Contra Costa County Planning Commission on the request (LUP 2042-92 ) of Valley Waste Management (applicant) and MGM Construction Company (owner) for approval for a Land Use Permit to operate a truck maintenance and parking facility for its own refuse disposal trucks on a 4. 334 acre parcel of land in the Concord area. Dennis Barry, Community Development Department, described the location of the request site and the uses for the site. Mr. Barry commented on the Planning Commission' s added conditions of approval and the appeal before the Board today. He also commented on a letter from Ellman, Burke, Hoffmann and Johnson, dated January 8, 1993 , requesting on behalf of the appellant that the hearing be rescheduled since they have not had adequate time to prepare their client' s presentation. Mr. Barry commented on the staff recommendation that the hearing be held and he commented on the two options presented by staff for Board consideration. The public hearing was opened and the following persons appeared to testify: Desi Reno, 1990 N. California Suite #20, Walnut Creek, representing Valley Waste Management, commented on material he had presented to Board members (not presented to the Clerk) , spoke in concurrence with the conditions, and requested that the Board deny the Jones' appeal. Supervisor Bishop asked how quickly Valley Waste Management would occupy the site if the Land Use Permit were approved. Mr. Reno responded that vehicles could be on the property by the end of the month. Ben Castro, 45 Winding Glen, Danville, MGM Construction Company, submitted a card in favor of the project. Jeff Johnson, One Ecker Building, San Francisco, Ellman, Burke, Hoffman & Johnson, representing Winton and Nathalie Jones, requested more time to prepare a presentation and he proposed that the Board take testimony and continue the matter. Mr. Johnson advised that there were specific concerns about the operation including noise, odor, increased traffic and health and safety issues. Mr. Johnson commented on various environmental impact issues including creation of objectionable odors, discharge into surface waters, exposure of people or property to water related hazards, increases in existing noise levels, generation of substantial vehicular movement, increase in traffic hazards, creation of health hazards or potential health hazards, exposure of people to potential health hazards, and he advised that he did not see how a Negative Declaration is supported based on the record he has seen. Winton Jones, 1949 Arnold Industrial Way, Concord, presented pictures for Board consideration and spoke in opposition to the Land Use Permit and he requested further time to study this matter. Supervisor Bishop commented on a traffic study by Abrhams and Associates. Mr. Jones commented that he had not seen a traffic study. Mr. Johnson commented that if the matter were continued for two weeks that perhaps they could satisfy themselves that proposed language in the conditions on the traffic issue would be acceptable. Mr. Barry commented that there was a traffic study in the file. Supervisor Bishop inquired if Mr. Jones resided on the property adjacent to the subject property. Mr. Jones responded that he did. Supervisor McPeak clarified that it was a residence in a light industry area. Supervisor McPeak commented on the condition of approval relative to on-going traffic monitoring. Mitch Avalon, Public Works Department, responded on the impacts of the operation and the traffic monitoring study. Supervisor McPeak indicated a need to look at the traffic circulation in the North Concord area, the past conditions on signalization, and the enforcement of traffic conditions. Supervisor McPeak commented on yards where packer trucks are parked in existence in Contra Costa County and she inquired as to whether staff had visited one. Mr. Barry responded that he did not know. Supervisor Smith requested clarification on the reason for the appeal being an objection to Valley Waste Management wishing to have a transfer station on the site. Mr. Johnson responded that the CEQA objections had been raised before, and he clarified the reasons for the Jones ' appeal. The Board discussed the use of Mr. Jones ' 25 acre parcel at the present time. Desi Reno spoke in rebuttal. Supervisor McPeak inquired as to whether Mr. Reno had objection to conditioning the Land Use Permit approval with the prohibition of a transfer station at this site. Mr. Reno responded that there was no objection to that at this site. Supervisor McPeak inquired as to the reason for moving the corporate yard further north from the service area. Mr. Reno responded that there were no sites available in Walnut Creek and Danville. Supervisor Bishop inquired as to the possibility of landscaping or a row of trees for odor and noise reduction. Mr. Reno responded that the noise study would address this issue. Supervisor McPeak recommended that the decision be continued for two weeks and that the conditions should be amended to include the prohibition of a transfer station on this site and landscaping for a visual impact separation on the east side of the property, and that staff, the applicant and the appellant should do a walk around of at least two other corporate yard sites and do an odor test. Victor Westman clarified that if the Board were going to approve the Land Use Permit that the findings now before the Board were not adequate and additional findings would have to be prepared and that the hearing should be left open for comment on those or the hearing could be left open entirely. Supervisor McPeak moved to continue the public hearing to January 26, 1993 , and she requested that the staff prepare additional conditions for Board consideration at that time that would include a prohibition on transfer station at this site, additional landscaping on the eastern border for a visual buffer, and she requested that Public Works review any other traffic studies or conditions that had been done on other projects in the North Concord area and determine if any of those improvements should be called out and she requested staff, the applicant and the appellant to visit at least two other existing corporate yards where packer transfer trucks are kept. Supervisor Bishop seconded the motion. The Board discussed whether or not to leave the hearing open. Public Works-Mitch Avalon BY , DEPUTY ME:df FISCAL IMPACT None BACKGROUND/REASONS FOR RECOMMENDATIONS The background for this project is reviewed in the December 8 and November 10, 1992 staff report to the County Planning Commission. The Commission reviewed an appeal of the Zoning Administrator's approval of the application filed by the adjoining property Winton Jones Development Company (Winton S Nathalie Jones) . The Jone's own seven nearby parcels including one with their residence. The Jones current appeal is based on the objection that Valley Waste Management will use the site for a transfer station. The Jone's raised additional concerns when they appealed the Zoning Administrator's decision. Those concerns were addressed by the Planning Commission when they added additional conditions to the project approval. On September 28, 1992, after taking testimony, the Zoning Administrator approved the application for LUP 2042-92. The Zoning Administrator modified Conditions of Approval based on testimony from Winton and Nathalie Jones. On October 6, 1992, Winton and Nathalie Jones, adjacent property owners.appealed the Zoning Administrator's decision to the Planning Commission. On November 10, 1992, the Planning Commission continued the appeal hearing to December 8, 1992 in order to obtain additional information. On December 8, 1992, the Planning Commission denied the appeal by added additional condition of approval to the project. On December 14, 1992, Winton Jones Development Company, appealed the Commission's decision to the Board. The appeal states that the applicant wants a transfer station at the site. The applicant has not requested to use the site as a transfer station. An additional permit would be required to allow use as a transfer station. The request for a land use permit for truck maintenance and parking facility at 1781 Arnold Industrial Way as depicted on the site plan dated received July 28, 1992 by the Community Development Department. The following conditions of approval require compliance prior to use of the site unless otherwise indicated. 2. The term of this use permit is until March 1 , 1995 unless the Parcel Map for MS 35-91 is recorded. In the event that the Parcel Map is recorded, the terms of the use permit shall expire 30 days after the date of recordation of the Parcel Map. 3. Prior to the issuance of building permits, the applicant shall submit a detailed TDM Plan for review and approval of the Zoning Administrator (unless otherwise required by a TDM Ordinance). 4. No solid or liquid waste originating off the subject site shall be brought on site, stored or transferred on the subject site. 5. No solid or liquid waste, or recycled or other material, not related to the development of the site or the maintenance of its facilities and equipment, shall be sorted, composted, or otherwise processed or stored on the subject site. 6. Landscaping: A. Submit a landscaping plan for the frontage along Laura Alice Way to continue the landscaping scheme installed along the other properties fronting the roadway. B. Submit a landscaping plan for on site planting. Landscape plan shall provide landscaping within the front setback area in order to provide partial screening of the site from off-site views. C. Said plans shall be submitted for approval by the Zoning Administrator with 30 days of the use permit approval. Bonding shall be provided for the installation of the landscaping within six months of the Zoning Administrator's approval of the landscape plans. Plans shall comply with the County Water Conservation Guidelines. 7. Submit an implementable plan for complying with the intent of EPA Clean Water Act (NPDES) for reducing pollutants entering into off-site drainage systems. Said plan shall be submitted to the Flood Control District within 30 days of the use permit approval. 8. Storage of containers, roll off boxes and carts shall only be allowed in the area shown on the site plan for their storage. Fencing shall be provided between the truck parking area and the storage area. 2. 9. We believe Leptein, Cronin & Cooper originally performed an ALTA land survey which apparently Valley Waste Management has now taken and drawn a site layout in an attempt to distort the actual feasibility of the site. The existing application by Valley Waste Management states that the property is currently "being used" for a similar purpose. The current site has been used to park approximately ten trucks for the last 1-1/2 years. At no time has that use been permitted by the County. No current land use permit is issued for this site. This site has never been used to store, house, wash or maintain garbage trucks or waste disposal bins. At the time of hearing, we reserve the right to present additional matters to the Planning Commission to demonstrate that this project may have a significant affect on the environment and that an environmental impact report may be required in order to allow the land use permit to issue. Odors and filth from garbage trucks and container bins (20-30 yard sizes) will attract birds (sea gulls-Hawks ) and rodents (rats - mice - possums) and flies and mosquitoes which will affect the environment of 150-200 people who work and live downwind of this lot. 2. Human sickness and disease from chemicals and pesticides especially during temperature inversions and industrial acid rain periods will affect the human environment in this area. No EIR has been prepared. 3. Excessive noise and noxious orders will affect allergy and sinus irritations and nausea day and night to area workers and increase workers compensation insurance costs. 4 . Discharge of pollutants from the truck wash rack of Hazmat certified refuse container and hauling vehicles will create the run off of hazardous materials into nearby Walnut Creek since No flood control plan is available . 5 . We are disinclined to believe that Chemical and Valley Waste Management will not transport medical and hospital waste along with service station and commercial and industrial contaminated hazardous material in their vehicles. 6 . We cannot determine the drainage pattern of oil & diesel surface pollutants into contained remediation facilities before entering Walnut Creek Channel. 7 . The negative declaration compares 80 trucks and 80 employee vehicle and 80 waste container roll off boxes and bins to the current and previous tenant operation of 10 trucks and 10 employee vehicles as being a no change Situati'Iz - NO Way. 8. The cur-rent small septic tank and land field is over 30 years old and handled 10 people previously. Now it cannot handle 100 plus people without health hazards. go 9. The trucking ingress and egress is currently inadequate for 100 mixer trucks and welding yard trucks and vehicles. This poorly designed access cannot accommodate 200 additional vehicles in and out day and night. No traffic survey or report has been made. 10. The signal light at the intersection was promised us by Bedford Properties when the North Concord Industrial Park was approved. It' s still in limbo and should now be included in a detailed . traffic study to plan future growth and to avoid more of the many accidents and near misses. This should be mandated under EIR requirements. 11. Pesticides - chemicals - paper - hazardous materials and contaminated residues in trucks and roll off container bins and boxes could be inflammable and explosive and cause hazardous emissions, and airborne pollutants degrading the local environment. 12. The hours of operation have not been addressed and should be limited to 7AM to 7PM weekdays to control noise and emissions. 13. This huge operation would deteriorate the air quality in our area. The over crowding of vehicles and bins will not provide adequate access for fire and emergency equipment. The noxious vapors and .emissions and odors would be overwhelming. The contaminated run off and storm water discharge would contaminate the aquifer and many wells in this area. 14. A trashy rubbish operation in this location could impede and upset the orderly growth of commercial and light industrial development in North Concord. No increased property taxes are proposed. Due to a significant effect on our environment we object to the usage of this site for operating a chemical waste and garbage truck terminal and recycling center and storage and equipment washing facility without an EIR. REVIEW OF ZONING ADMINISTRATOR HEARING The Zoning Administrator hearing was held on September 28, 1992. Mr. Winton Jones (appellant) provided the testimony against the proposed project (letter attached). The Zoning Administrator took his testimony into consideration and added two conditions to the project, new 9 and 10, concerning noise and fire safety. The Zoning Administrator believed that the other concerns expressed by Mr. Jones had been addressed in the proposed conditions of approval. IV. APPEAL Mr. & Mrs. Winton Jones filed an appeal of the Zoning Administrator's approval of LUP 2042-91 on October 6, 1992. The filing of the appeal was within the statutory time limits. Winton Jones Development company owns 23.22 acres in seven parcels (APN #159- 090-013, -015, -028, -030, -032, -034, -036) located easterly of the proposed LUP 2042-92. Parcel #159-090-015 is the only parcel that adjoins the proposed project. The Jones' residence is on Parcel #159-090-032 and that property is approximately 800 feet from the easterly property line of the proposed project. The appeal contains 16 specific items listed on Attachment A of the Notice of Appeal and the appeal states: failure to appropriately address environmental impacts caused by the project such as noise and odor, use of drawings not prepared by the engineer who prepared the original drawings, that the existing use of the property is not similar to the proposed use, and that there is no limit to the number of vehicles that can use the facility (only the number that can stay overnight). Response to the objections in the order listed on the appeal's Attachment A: A. Odors and Filth: Conditions #4 and #5 impose requirements on the applicant to not bring waste material back to the storage site. It is not in the applicant's best interest to allow the storage containers to accumulate debris in between uses. B. Sickness and Disease Exposure: See response A. above. C. Noise and Odors: Condition #9 was added by the Zoning Administrator requiring a noise attenuation study prior to the issuance of any building permits (this condition would apply to tenant improvements too). D. Pollutant Discharge: Conditions #4 and #5 limit on-site material storage. Condition #7 requires pollutant reduction plan for drainage system. E. Use by Valley and Chemical Waste Management for Transport of Medical and Hospital Waste: Chemical Waste Management does not have permit to use site. F. Drainage Pattern: See response for D. above. G. 80 Trucks vs. 10 trucks in Environmental Assessment: Current use does have fewer vehicle trips but increase in use was not considered significant when compared to other traffic generators in area (e.g., Ready Mix Plant to the north). H. Septic System: Health Department is required to approve adequacy of the system. If system is inadequate, applicant will be required to connect to sewer system. I. Truck Access: Condition #1 1.C. requires truck turning study and any recom- mended modifications. J. Signal Light: Condition #1 1.D. requires applicant to provide determination of warrant for signal at the intersection. If the signal is warranted, applicant will be required to pay fair share of cost. K. Fire Hazard: Conditions #4 and #5 restrict storage. Zoning Administrator added Condition #10 to require Fire District to review site access. L. Hours of Operation: Appellant.has requested 7:00 A.M. - 7:00 P.M. weekdays. Applicant has requested 4:30 A.M. to 7:00 P.M. due to franchise service requirements. A new condition should be added. M. Site Overcrowding: Site plan shows adequate room for proposed use. Condition #7 addresses concerns about run-off/discharge. N. Impact on Future Land Uses: Proposed use conforms with zoning and general plan permitted uses for Light Industry. 0. Access Rights: Assessor's records show owner also owns adjoining property (APN #159-090-039) that has actual frontage on Laura Alice Way. P. Engineer's Drawings: Applicant did not have Leptien-Cronin-Cooper, Inc. prepare drawings submitted with application. The engineer's drawings were used as a base for the applicant's descriptive notes. Issues stated in the body of the appeal letter were restated in Attachment A and have been responded to in the above analysis. V. OTHER CORRESPONDENCE No other correspondence has been received since the filing of the appeal. VI. ZONING ADMINISTRATOR DECISION Approved with all recommended conditions and added conditions on September 28, 1992. VII. ALTERNATIVE ACTIONS A. Require additional conditions to further control applicant's use of the property. B. Reduce the allowable number of trucks for the site. C. Grant the appeal and require additional environmental review: If actions A or B above were taken by the Planning Commission, then staff has prepared appropriate conditions. The conditions would clarify the proposed use for the property not further restrict it uses. 4 Potential Conditions to Augment Approved Conditions A. Hours of operation for the facility shall be from 4:30 A.M. to 7:00 P.M. No arrivals or departures will be allowed outside of those hours. B. Only those trucks parked (based) at the facility can be serviced at the facility. A maximum of 80 trucks can be based at the facility. C. The facility is solely for the use of Valley Waste Management. No affiliated companies can use the facility. D. If additional wash-up (showers, etc.) areas are added for the employees, then the applicant shall connect the plumbing to the public sanitary sewer system. VIII. FINDINGS Staff proposed that the following findings be used as the basis for denying the appeal: A. The project as proposed satisfies the purposes of the light industry district by bringing in a low intensity industrial use that is buffered from residential districts by other light industrial uses. B. The project complies with the intent of the County General Plan and the County Zoning Code. C. The project utilizes existing structures and does not require the construction of intrusive new structures. D. Mitigation condition of approval will increase the amount of landscaping in the area. E. No variances are requried for this project. Approval of the land use permit would not constitute a grant of special privileges. IX. CONCLUSION Staff recommends that the Planning Commission uphold the decision by the Zoning Administrator 'and deny the appeal by Mr. & Mrs. Winton Jones. Although the approved conditions adequately regulate the use of the property, staff has presented new conditions which may be used to clarify the intent of the application and the Zoning Administrator's approval. The request for a land use permit for truck maintenance and parking facility at 1781 Arnold Industrial Way as depicted on the site plan dated received July 28, 1992 by the Community Development Department. The following conditions of approval require compliance prior to use of the site unless otherwise indicated. 2. The term of this use permit is until March 1 , 1995 unless the Parcel Map for MS 35-91 is recorded. In the event that the Parcel Map is recorded, the terms of the use permit shall expire 30 days after the date of recordation of the Parcel Map. 3. Prior to the issuance of building permits, the applicant shall submit a detailed TDM Plan for review and approval of the Zoning Administrator (unless otherwise required by a TDM Ordinance). 4. No solid or liquid waste originating off the subject site shall be brought on site, stored or transferred on the subject site. 5. No solid or liquid waste, or recycled or other material, not related to the development of the site or the maintenance of its facilities and equipment, shall be sorted, composted, or otherwise processed or stored on the subject site. 6. Landscaping: A. Submit a landscaping plan for the frontage along Laura Alice Way to continue .the landscaping scheme installed along the other properties fronting the roadway. B. Submit a landscaping plan for on site planting. Landscape plan shall provide landscaping within the front setback area in order to provide partial screening of the site from off-site views. C. Said plans shall be submitted for approval by the Zoning Administrator with 30 days of the use permit approval. Bonding shall be.provided for the installation of the landscaping within six months of the Zoning Administrator's approval of the landscape plans. Plans shall comply with the County Water Conservation Guidelines. 7. Submit an implementable plan for complying with the intent of EPA Clean Water Act (NPDES) for reducing pollutants entering into off-site drainage systems. Said plan shall be submitted to the Flood Control District within 30 days of the use permit approval. 8. We hereby request that the decision of the Zoning Administrator be appealed to the Planning Commission. Enclosed herewith is our check in the amount of $110.00 for purposes of the appeal. We are residential owners who live on the property adjacent to the site. Some of the reasons for the appeal are set forth in Attachment A to this Notice of Appeal and are incorporated herein by reference. In addition thereto, the basis of the appeal will also include failure to appropriately address environmental impacts caused by the project. Those impacts include such items as noise and odor. In addition thereto, the site plan appears to have been designed by an engineering firm of Leptein, Cronin & Cooper. However, this appears to be a false representation. We believe . Leptein, Cronin & Cooper originally performed an ALTA land survey which apparently Valley Waste Management has now taken and drawn a site layout in an attempt to distort the actual feasibility of the site. The existing application by Valley Waste Management states that the property is currently "being used" for a similar purpose. The current site has been used to park approximately ten trucks for the last 1-1/2 years. At no time has that use been permitted by the County.. No current .land use permit is issued for this site. Valley Waste Management's application is for approximately 1180 vehicles". There is no limitation on the number of vehicles that can be operated out of this facility. This site has never been used to store, house, wash or maintain garbage trucks or waste disposal bins. At the time of hearing, we reserve the right to present additional matters to the Planning Commission to demonstrate that this project may have a significant affect on the environment and that an environmental impact report=may be required in order to allow the land use permit to issue. Odors and filth from garbage trucks and container bins (20-30 yard sizes) will attract birds (sea gulls-Hawks) and rodents (rats ' - mice - possums) and flies and mosquitoes which will affect the environment of 150-200 people who work and live- downwind of this lot. 2. Human sickness and disease from chemicals and pesticides especially during temperature inversions and industrial acid rain periods will affectthehuman environment in this area. No EIR has been prepared. 3. Excessive noise and noxious orders will affect allergy and sinus irritations and nausea day and night to area workers and increase workers compensation insurance costs. 4. Discharge of pollutants from the truck wash rack, of Hazmat certified refuse container and hauling vehicles will create the run off of hazardous materials into nearby Walnut Creek since No flood control plan is available. 5. We are disinclined to believe that Chemical and Valley Waste Hanagement will not transport medical and hospital waste along with service station and commercial and industrial contaminated hazardous material in their vehicles. 6. We cannot determine the drainage pattern of oil & diesel surface pollutants into contained remediation facilities before entering Walnut Creek Channel. 7. The negative declaration compares 80 trucks and 80 employee vehicle and 80 waste container roll off boxes and bins to the current and previous tenant operation► of 10 trucks and 10 employee vehicles as being a no change situation - NO Way. 8. The current small septic tank and land field is over 30 years old and handled 10 people previously. Now it cannot handle 100 plus people without health hazards. 9. The trucking ingress and egress iscurrently. inadequate for 100 mixer trucks and welding yard trucks and vehicles. This poorly designed access cannot accommodate 200 additional vehicles in and out day and night. No traffic survey or report has been made. 10. The signal light at the intersection was promised us by Bedford Properties when the North Concord Industrial Park was approved. It's still in limbo . and should now be included in a detailed traffic study to plan future growth and to avoid more of the many accidents and near misses. This should be mandated under EIR requirements. 11. Pesticides - chemicals - paper - hazardous materials and contaminated residues* in trucks and roll off container bins and boxes could be inflammable and explosive and cause hazardous emissions. and airborne pollutants degrading the local environment. 12. The hours of operation have not been addresseCand should be limited to 7AH to 7PH weekdays to control noise and emissions. . 13. This huge operation would deteriorate the air quality in our area. The over crowding of vehicles and bins will not provide adequate access for fire and emergency equipment. - The noxious vapors and emissions and odors would be overwhelming. The contaminated run off and storm water discharge would contaminate the aquifer and many wells in this area. 14. A trashy rubbish operation -in this location could impede and upset the orderly growth of commercial and light industrial development in North Concord. No increased property taxes are proposed. Due to a significant effect on our environment we object to the usage of this site for operating a chemical waste and garbage truck terminal and recycling center and storage and equipment washing facility without an EIR. Since this is not compatible with the' current and past usage of this property we request denial of this land use permit. The air quality is marginal now due to heavy heavy freeway traffic. 15. The Alta survey for this property shows a "clouded" access from Lowe Lane and the entrance to property may be illegal. 16. Dear Ms. Fleming & Mr. Drake.- As you know,, the above-captioned Appeal is scheduled for a hearing before the Contra Costa County Board of Supervisors on Tuesday, January 12, 1993. The Appellants are contesting the issuance by the County of a Land Use Permit 2042-92 to Valley Waste Management ( "Applicant") and MGM Construction Company 00m;Mer1( ) based upon a Negative Declaration under the California Environmental Quality Act. Appellants have asked us to represent them in connection with this Appeal. Apparently they attempted to obtain representation by several other law firms which were unavailable because of potential conflicts of interest and/or scheduling conflicts. Our first meeting with Appellants was yesterday afternoon. Accordingly, we respectfully request that the hearing an the appeal be rescheduled so that we may have adequate time t to prepare'.
