HomeMy WebLinkAboutMINUTES - 01051993 - 1.83 1 . 83 TO: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Costa DATE: December 29, 1992 xA County SUBJECT: INTEGRATION OF FAMILY SERVICES SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Amend the referral of this matter by the Board of Supervisors on December 15, 1992 to reflect referral to the 1993 Internal Operations Committee, rather than to Supervisors McPeak and Powers . BACKGROUND: On December 15, 1992, the Board of Supervisors received a report from the County Administrator on the "Integration of Family Services" (Determination Item #2 .2) . The report requested the appointment of a member of the Board of Supervisors to work. with the Health Services Department, Social Services Department and Probation Department in discussing with employee organizations the ramification of service integration and the establishment of pilot teams . In response to this recommendation, the Board of Supervisors appointed Supervisors McPeak and Powers for this purpose. However, Supervisor McPeak, who was not present at the Board meeting on December 15, had discussed with Supervisor-elect Jeff Smith the appropriateness of referring this item to the 1993 Internal Operations Committee. Both had agreed that this would be the preferable referral . Supervisor Powers has indicated that he is willing to defer to the wishes of Supervisor-elect Smith in this _ regard and therefore concurs that a referral to the 1993 Internal .Operations Committee is appropriate, rather than a referral to Supervisors McPeak and Powers . The County' s self-insurance program provides for the legal defense of officials and employees pursuant to Government Code. Sec. 825 and payment of all sums which it is obligated to pay by reason of liability imposed by law and arising from their acts or failure to act, excepting exemplary or punitive damages. This protection covers services performed by officers or employees within the scope of their official duties in accordance with the conditions of their employment or services. With respect to workers' compensation benefits, the County provides workers' compensation benefits to all of its employees as required by California State Compensation laws. The self-insurance programs are prefunded to provide funds for payment of claims. Indemnification. The County shall defend, indemnify, save ..and hold harmless the City of E1 Cerrito and its officers and employees from any and all claims, costs and liability for any damages, sickness, death, or injury to persons or property, from any cause whatsoever arising from activities hereunder, save and except claims or litigation arising through the sole willful misconduct of Contra Costa County. County will make good to and reimburse the City of El Cerrito for any expenditures, including reasonable attorneys' fees the City of E1 Cerrito may make by reason of such matters and, if requested by the City of El Cerrito, will defend any such suits at the sole cost and expense of the County.
