THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on January 5, 1993 by the following vote:
AYES: Supervisors Powers, Fanden, Schroder, Torlakson and McPeak
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Authorizing the Public Works Director to Arrange for the Securing of Funds
and the Completion of Improvements, Subdivision 7330, Oakley Area.
The Board on October 16, 1990, having approved a Subdivision Agreement with
Hillside Park Partners, a California Limited Partnership for construction of certain
improvements for Subdivision 7330, Oakley area.
The Subdivision Agreement was accompanied by security in the form of a corporate surety
bond, issued by Developers Insurance Company in the amount of $869,500 for faithful
performance and $439,150 for labor and materials with Hillside Park Partners, a California
Limited Partnership as principal.
The Public Works Director having reported that the developer has failed to
satisfactory complete the work as required by said agreement and that the cost to do the
improvements is such that the County cannot fund their construction without first obtaining
monies from the security held with said agreement and recommends that County Counsel
be authorized to secure said funds.
The Public Works Director having recommended that he be authorized to arrange for
completing the work (estimated to be over $750,000, plus the cost of preparing plans and
specification, solicitation of bids, and any cost involved in recovering the necessary funds)
using the $8,800 cash deposit (Auditor's Deposit Permit No. 179756, dated October 1, 1990)
made by California Homes and the bond held by Developers Insurance Company.
IT IS BY THE BOARD ORDERED that the recommendation of the Public Works
Director is APPROVED.
IT IS FURTHER ORDERED that County Counsel is AUTHORIZED to request
payment from, and if necessary, to prosecute legal proceedings against the developer and
Developers Insurance Company to make the funds available to complete said improvements
and to defray County's costs incurred in securing said funds.
