SUBJECT: APPROVE PROPOSED WORK PLAN FOR NATIONAL POLLUTANT DISCHARGE
ELIMINATION SYSTEM PERMIT APPLICATION PART.ll, UNINCORPORATED COUNTY
AREA
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION
I. Recommended Action:
APPROVE the proposed five year Work Plan (Attachment A) for the National Pollutant
Discharge Elimination System Permit Application, Part II for the unincorporated county area.
II. Financial Impact:
The NPDES Work Plan shown in Attachment A is estimated to average$803,000 over the five
year term of the permit.
III. Reasons for Recommendations and-Background:
The United States Environmental Protection Agency issued the NPDES Regulations for
stormwater discharges on November 26, 1990. These regulations require Contra Costa
County, its eighteen incorporated cities and the Contra Costa Flood Control and Water
Conservation District to jointly apply for a Municipal NPDES Permit for their stormwater
discharges. The Permit seeks to significantly reduce or eliminate all pollutants from entering
the waters of the San Francisco Bay-Delta Region. Contra Costa County is specifically
identified in the federal regulations as needing the Municipal NPDES Permit. Contra Costa
County chose to collectively participate in the joint effort to obtain the Municipal NPDES
Permit rather than individually obtain the Permit. This decision has required Contra Costa
County to pay only 18.84 percent of all group activity costs versus 100 percent if it chose to
individually apply for the Permit.

Obtaining the Municipal NPDES Permit requires a three step process. The State Water
Resources Control Board and its nine regional bodies are responsible for approving and
implementing the Municipal NPDES Program in California. Part I of the NPDES application
represented the reconnaissance level activities due by May 18, 1992. This application was
submitted and approved by the San Francisco Bay and Central Valley Regional Water Quality
Control Boards. The Part II application is the actual development of a Stormwater
Management Plan which is due to the Regional Boards by May 17, 1993. Staff from
Community Development,Building Inspection,Health,General Services,Administrator's Office,
and Public Works developed the proposed five year plan shown in Attachment A. With Board
approval,this plan will be submitted as the County's proposed Stormwater Management Plan.
If found acceptable by the Regional Water Quality Control Boards, then a joint Municipal
NPDES Permit will be issued by both Boards in the Fall of 1993.
IV. Consequences of Negative Action:
Should Contra Costa County fail to obtain a Municipal NPDES Permit in the aforementioned
timeline, it will be in non-compliance and subject to fines totalling $25,000 per day and all
construction, redevelopment and transportation activities could be stopped immediately
pending resolution.

(1) The Health Department administers this activity. Average annual cost is not available.
(2) The Household Hazardous Waste (HHW) Program annual budget is $1,490,000. The HHW Program
includes incorporated and unincorporated portions of the County and is funded entirely by tipping fees.
