Recommended Action: ACCEPT recommendation of Public Works Director to remain neutral in negotiations between Hal Porter Homes and Oak Builders, Incorporated and ACCEPT the improvements for Subdivision 5946 as complete. II. Financial Impact: There will be no financial impact to the County. III. Reasons for Recommendations and Background: Subdivisions 6922 (Oak Builders, Incorporated) and Subdivision 5946 (Hal Porter Homes) were both conditioned to improve the intersection of Highway 4 and Laurel Road to provide a separated left-turn pocket for southbound traffic on Highway 4 and westbound traffic on Laurel Road. The Conditions of Approval for either subdivision did not provide for reimbursement to the other subdivision. Subdivision 6922 constructed the improvements to Highway 4 and would like to be reimbursed by Subdivision 5946. Public Works has maintained that this is a private matter between the two developers. This letter is to draw you attention to item No. 1.9 Subdivision 5946 of the Consent Items - Hal Porter Development Company Inc. (Porter). There has existed a long outstanding dispute between Oak Builders, Inc. (Builders) and Porter regarding the "cost sharing" of the Highway #4 improvements at the intersection of Highway #4 and Laurel Road in Oakley. Under their Conditions of Approval, both developers were required to construct certain common improvements which included widening the Highway #4/Laurel Road intersection to provide a separated left-turn pocket for southbound traffic on Highway #4 and west bound traffic on Laurel Road. The design and configuration was to be reviewed and approved by the Public Works Department and CALTRANS. The Public Works Department recommended that the developers mutually agree on some form of "cost sharing" of these improvements. Builders has completed all of these improvements in accordance with both CALTRANS and Public Works requirements at a cost of $179,715..20. Porter's prorate share is $121,020.22 based upon the total number of units in each developers subdivision. Builders has requested reimbursement from Porter for its (Porter) proportionate share of these costs. Porter initially agreed to pay up the bonded amount of these improvements or approximately $50,000. Currently, however, Porter is refusing to participate In any amount of "cost sharing" related to these improvements. On Agenda item No.1.9 is a request to accept as complete the road Improvement agreement for Subdivision 5946. In conjunction with this acceptance, you would release Porter's corporate surety bond in the amount of $50,900. This bond was required by Porter to Insure that the Highway #4 improvements would be completed. Since Porter did not complete these improvements nor participate In the "cost sharing" with Builders as recommended by Public Works, it is requested that the bond either be retained by the GENERAL CONTRACTOR Page 2 Re: Agenda Item #1.9 Subdivision 5946 - Hal Porter Development Company, Inc.
