January 21 , 1993 Contra Costra Board of Supervisors C/O Clerk of Board of Supervisors 651 Pine Street, Room 106 Martinez, CA 94553 ATTENTION: Tom Powers, Jeff Smith, Gayle Bishop, Sunne Mc Peak, Thomas Torlackson Dear Supervisors: Without question, the fatal shooting of two policemen in the City of Richmond is a tragedy. Having read of this sad event, we send our sympathy to all involved. It is unfortunate that your. Board of Supervisors has taken the position that all "assault" weapons should be banned. You know as well as we do that any weapon can be classed as an "assault" weapon, whether it is a rock, a fork, a hammer, a bar of steel, or a hat pin. Let us clear this issue: the adjective "assault" belongs on the criminal who holds the weapon which is used in an unlawful manner, and not on the tool itself. To the observing public the issue is clear: misguided pubic officials are seeking to punish the innocent for crimes commited by the guilty. This is a violation of the Second Amendment (an inalienable right), the Fourth Amendment (unreasonable seizure), the Fifth Amendment (due process of law; nor be deprived of liberty or property), the Eighth Amendment (cruel and unusual punishments inflicted), the Ninth Amendment (certain rights cannot be denied to the people), and the Tenth Amendment (powers not delegated by the Constitution are not authorized for use by public officials). It is the duty of law enforcement to punish criminals, in a manner equal to the crime. The soft policies of law enforcement has contributed to the boldness and daring of criminals. Gc: sherL �Ctly-in¢- 1 The purpose of this letter is to oppose any action of your board which would attempt to influence other public officials, both state and local, that would call for the banning of all (what you call) "assault" weapons. In conclusion, for an appreciation of firearms, please refer to the attached sheet entitled, "Why Do People Want Guns?". I would appreciate a response from your board. Reason No. 1 : People want to maintain their inherent right to liberty. Reason No. 2: Rioters and criminals in general are also a direct threat to the safety of law-abiding people as well as to the police. Reason No. 3: The police have admitted that they can not protect the people. Reason No. 4: The police may need to call upon the law-abiding people, who are trained in the proper use of firearms, for help in case of emergencies. Reason No. 5: It is the people's checK on public officials who have taken an oath of office to obey, support and defend the Constitution. Reason No. 6: Firearms are the keystone of the Bill of Rights which backstop all of the other essential, natural, and inherent rights of the people; all of which for their continued existence, depend upon the very existence of the right of the people to keep and bear arms. Reason No. 7: A free state requires an armed nation to secure it from tyranny from within and invasion from without. Reason No. 8: The people are the militia spoken of in the Constitution in Article I Section 8 ( 1 6) from which the Congress may increase the size of the army for purposes of serving the security of the United States in times of need and for which the people must be previously well-trained in the use of f firearms. Reason No. 9: Servitude is the consequence and the punishment of a disarmed nation. Reason No. 10: People need their firearms more than ever in order to protect themselves against the abuse of public officials who seek to punish the innocent people for the crimes committed by those criminals who use guns.
