HomeMy WebLinkAboutMINUTES - 02231993 - S.2 S. 2 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUN'T'Y, CALIFORNIA Adopted this Order on February 23 , 1993 by the following vote: AYES: Supervisors Bishop, McPeak, Torlakson NOES: Supervisor Smith ABSENT: Supervisor Powers ABSTAIN: None -------------------------------------------------------------------- ------------------------------------------------------------------- SUBJECT: Funding for Battered Women' s Alternatives and Rape Crisis Services The Board considered the recommendations of Supervisors Bishop and McPeak relative to funding Battered Women' s Alternatives and Rape Crisis Services for the 1992-93 and 1993-94 fiscal years from the 1993-94 General Fund allocation to the District Attorney' s office. A copy of the complete recommendation is provided in the attached document and made a part of this Board Order. Gary Yancey, District Attorney, advised of the negative impact this allocation would have on his department in light of the fact that all County Departments have been requested to prepare budgets for the 1993-1994 fiscal year reflecting 40 percent reductions. Noting that both Battered Women' s Alternatives and Rape Crisis Services are good programs, he called attention to the fact that they are not mandated programs and that providing the funding as proposed would require him to lay off additional attorneys and clerical staff and further restrict his ability to prosecute and obtain convictions. The following persons spoke in support of funding Battered Women' s Alternatives and Rape Crisis Services: Steven Franklin, (no address) ; Joe Caruso, (no address) ; Kathleen Tabor, Junior League Oakland-Easy Bay, 3685 Mt. Diablo Blvd. , Suite 251, Lafayette; Jim Bonquin, 303 Lennon, Walnut Creek; Patricia Kenbor, Danville-Alamo Association of University Women, 15 Ashford Court, Alamo; Margaret DePriester, 142 Selborne Way, Moraga; Joyce Jones, 45 Rutherford Lane, Pacheco; Susie Kling, 1696 Wardlow Lane, Concord; Jim Hicks, AFSCME, 1000 Court Street, Martinez; and Mary Rocher, (no address) , Antioch. Board members discussed the recommendations and expressed reservations with approving funding for Battered Women' s Alternatives and Rape Crisis Services for the 93-94 fiscal year. Supervisor Bishop proposed amending the recommendation to provide funding to the end of the current fiscal year ( 92-93 ) with direction to the County Administrator to report in two weeks on funding sources available for the continuation of these services. There was general agreement among Board Members to this amendment. Supervisor Jeff Smith advised that he could not support the motion as amended that included approval of any level of funding at this time. He advised that he could support directing the County Administrator to find the money to fund these services and report to the Board in two weeks. He expressed concern in allocating funds from next year' s budget at this time without first having reviewed the budgets prepared by County Departments or having knowledge as to what has been expended or may be available in the County Budget for this current year. Supervisor Bishop responded that it was her understanding that the monies for these services have been placed in the District Attorney' s Budget for the 1992-1993 fiscal year and are a General Fund function of that budget unit. IT IS BY THE BOARD ORDERED that funding for Battered Women' s Alternatives and Rape Crisis Services for the 1992-93 fiscal year are APPROVED with funds allocated from the District Attorney' s budget unless another funding source is identified. For 1992-93, this would result in a 30 percent funding reduction or a funding at the 70 percent level of the 1991-92 contract. The 1993-94 funding level will be determined by the reductions in General Fund revenues reflected in the final budget. Further, direct that the appropriation for these victim assistance services be funded from the 1993-94 General Fund allocation to the District Attorney's office (less any other monies, such as CDBG, that may be identified to support this function). BACKGROUND: Historically the Board of Supervisors allocated funding to Battered Women's Alternatives and Rape Crisis Services from the General Fund because victim assistance services has been a high priority local service. The General Fund appropriation was incorporated into the base allocation of the District Attorney's office. In the course of adopting the 1992-93 budget, the Board of Supervisors did not allocate funding from the DA's office for these services because other options for funding were being pursued, including reallocation of funds in the Health Services Department (subject to Bielensen Hearings) and Measure B. As a matter of fact, interim funding for these victim assistance programs was allocated from the Health Services Department. However, in light of the failure of Measure B and the continuing effort of the Health Services Department to eliminate a shortfall, it is necessary for the Board of Supervisors to find other funds for these victim assistance programs. Since the historical priority for these services was in the DA's base appropriations, this course of action appears to be both reasonable and logical. With reduced revenues and anticipated cutbacks up to 40 percent resulting in possibly reduced resources for prosecution of domestic violence and rape cases, ancillary services provided by Battered Women's Alternatives and Rape Crisis become essential for victim assistance.
