SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS I Continue the decisions on the rezonings, development agreements and the preliminary development plans until March 23 , 1993 . FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The Board of Supervisors on December 22 , 1992 , certified the Final Environmental Impact Report ("FEIR") , which is a tiered FEIR and addressed policy-level planning decisions, including a general plan amendment, specific plan, rezonings, preliminary development plans and development agreements. The Board further approved the General Plan Amendment and Specific Plan. Concurrently, the Board closed the public hearing and continued the rezonings, preliminary development plans and development agreements to February 23, 1993 for decision and directed staff to continue to participate in good faith discussions at the "Roundtable" to "review in detail the proposed rezoning preliminary development plans and development agreements. I.A. , Mt. Diablo Audubon Society, Greenbelt Alliance, Sierra Club and EBMUD challenging the validity of the Environmental Impact Report and planning approvals. In light of the pending litigation, the County's participation in the "Roundtable" meetings was suspended. Staff requests a one month continuance to explore the possibilities for continued informal public participation, such as the "Roundtable" or other forum, to discuss the rezonings, development agreements and the preliminary development plan applications. Staff has contacted the plaintiffs' attorneys, to discuss a wide range of issues and formulate a structure in which the "Roundtable" meetings could continue. In addition, CEQA-mandated settlement meetings are scheduled for March 3 , 1993 . This letter is intended to register the East Bay Municipal Utility District's ("District") objection to the Board's approval of these actions because the County has not yet prepared environmental documentation sufficient to support such an approval nor has it demonstrated that these actions- are ctionsare consistent with the Contra Costa County General Plan ("General Plan") . The District has repeatedly commented that the environmental impact report ("EIR") prepared for the Dougherty Valley project fails to adequately analyze the environmental impacts associated with provision of water to the Dougherty Valley in a sufficient level of detail to permit approval of the general plan amendment, specific plan, rezonings, the preliminary development plan and the devel-opment agreements. On December 22 , 1992 , by Resolution No. 92/868 , the Board approved the Dougherty Valley project general plan amendments and the specific plan and deferred the approval of the rezoning, the preliminary development plan and the development agreements. The Board deferred the approval of these latter three actions with the express intent of continuing the project level planning relating to the development of a program for the provision of services to and the construction, operation and .maintenance of infrastructure for .the Dougherty Valley. 375 ELEVENTH STREET. KATHERINE McKENNEY r" Chairperson Torlakson and Members of the Board of Supervisors February 18, 1993 Page 2 It is our understanding that none of the circumstances surrounding the development of this "services program" have changed since the Board adopted Resolution No. 92/868 nor has the County conducted further environmental review to support the approval of the rezoning, the preliminary development plan and the development agreements. In addition, the County has not taken any action to render the project approvals consistent with the County General Plan. In view of the aforementioned factors, the District respectfully requests that the Board defer any action on the rezonings, the preliminary development plan or the development agreements until such time as a legally adequate EIR is prepared and the County can demonstrate that the Dougherty Valley project is consistent with the General Plan. These items were continued from the Board of Supervisor meeting of December 22, 1992 to the meeting of February 23, 1993. At the December meeting, the Board directed County staff to continue to participate in good faith discussions at the Dougherty Valley "Itoundtable" meetings and. to review in detail the proposed preliminary development plans and development agreements. No "IWOndtable" meetings have taken place since the Board meeting of December 22, 1992. Additionally, we have not be advised as to whether any modifications have been made to the proposed preliminary development plans and / or the development agreements for Dougherty Valley. If the Board is set to take action on these entitlements based on the materials available prior to the December 22, 1992 meeting, then we restate our strong objections to such an action. The materials associated with these entitlement requests were not ready for action at that time and remain inadequate. If new or supplementary materials have been produced since December, 1992, they need to be made available for review and comment by affected agencies and interested parties.
