Spooner, Contracts Administrator Costa DATE: February 11, 1993 County SUBJECT: Approval of Memorandum of Affiliation #26-255 with Department of Veterans Affairs Northern California System of Clinics SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the Chair to execute on behalf of the County, Memorandum of Affiliation #26-255 with the Department of Veterans Affairs Northern California System of Clinics, for the period July 1, 1993 through June 30, 1998, for the provision of clinical experience for residents in the County's Merrithew Memorial Hospital Family Practice Training Program. II. FINANCIAL IMPACT: None. This a non-financial agreement. III. REASONS FOR RECOMMENDATIONS/BACKGROUND: Approval of this Memorandum of Affiliation will authorize clinical experiences in Dermatology, Medical Subspecialties, and Surgical Subspecialties at the Department of Veterans Affairs Martinez Outpatient Clinic for the County's Family Practice Residents. The Board Chair should sign five copies of the Memorandum, four of which should be returned to the Contracts and Grants Unit for submission to the Department of Veterans Affairs Northern California System of Clinics. It is mutually agreed by Contra Costa County for its Merrithew Memorial Hospital and Department of Veterans Affairs Northern California System of Clinics, Benicia, CA, that educational experiences will be provided in Dermatology, Medical Subspecialties and Surgical Subspecialties at the VA facility(Martinez OPQ for residents in the County's Merrithew Memorial Hospital Family Practice Training Program. 2. The faculty of the County's Merrithew Memorial Hospital will assume responsibility, in coordination with the VA staff, for the assignment of.residents. There will be coordinated planning by the VA facility and the faculty members. While in the VA facility, residents will be subject to VA rules and regulations. 3. The VA facility will retain full responsibility for the care of patients and will maintain administrative and professional supervision of residents insofar as their presence affects the operation of the facility and/or the direct and indirect care of patients. The faculty is responsible for the supervision of the education of undergraduate and graduate students and residents. 4. Residents will receive an orientation to the facility. Faculty members and facility staff supervisors will evaluate the residents' performance in mutual consultation and according to the guidelines outlined in the approved curriculum. 5. The County complies with Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, section 504 of the Rehabilitation Act of 1973, and Title It of the Older Americans Amendments of 1975, and all related regulations, and assures that it does not, and will not, discriminate against any person on the basis of race, color, sex, creed, national origin, age or handicap under any program or activity receiving Federal financial assistance. 6. Nothing in the agreement is intended to be contrary to State or Federal laws. In the event of conflict between terms of this agreement and any applicable State or Federal law, that State or Federal law will supersede the terms of this agreement. In the event of conflict between State and Federal laws, Federal laws will govern. 7. Protection of faculty members and residents of the affiliated institution from personal liability when furnishing professional services covered by this agreement while at the VA health care facility will be that which is provided under the Federal Tort Claims Act, as implemented by 38 U.S.C. 4116. 8. Except for those activities of participants covered by this Memorandum of Affiliation, each party and its employees, agents and officers shall be indemnified and held harmless by the other party against any and all claims: demands, or causes of action arising out of any act or omission while performing services under this agreement, of any officer, agent, or employee of the other party, or resulting from the condition of any property owned or controlled by the other party. 9. Periodic reviews of programs and policies will be conducted as necessary under the auspices of the Office of Academic Affairs. 10. This Memorandum of Affiliation is effective from July 1, 1993 through June 30, 1998; however, it may be terminated by either party on written notice to the other one hundred twenty days in advance of the next training experience.
