RECOMMENDATION:
Adopt a position in SUPPORT of SB 100 by Senator Kopp which
provides a mechanism to fund a program to remove gross-polluting
vehicles from the highways .
BACKGROUND:
Under current law, the Department of Motor Vehicles is required,
upon the renewal of registration of a motor vehicle subject to a
motor vehicle smog inspection program, to require biennially a
valid certificate of compliance issued by a licensed smog check
station.
Senator Kopp has introduced SB 100 which provides a mechanism to
get some of the most polluting vehicles off the highways . SB 100
allows the State Air Resources . Board to subsidize the purchase or
lease of new low-emission vehicles by individuals to replace gross-
polluting vehicles owned by the same individual since January 1,
1992 . Getting these older, heavily polluting vehicles off the road
has been something the Board of Supervisors has been supportive of
in the past.
SB 100 would accomplish this by allowing an individual, when {.
purchasing a new vehicle, to pay a $50 fee. and thereby avoid
getting a smog certificate for four years . These $50 fees would be
forwarded to the State Air Resources Board to fund the subsidy
program. The bill has not yet been fleshed out sufficiently to
provide many details on how the subsidy program would operate.

The thought here probably is that most new vehicles today run
relatively little chance of violating the smog standards during the
first four years of the vehicle' s life. The $50 fee is
approximately what the vehicle owner would pay for the two smog
certificates which are waived. As a result, the vehicle owner
saves little or nothing. The money, instead of going to a mechanic
or service station for an essentially unnecessary inspection, would
be used to fund one method of getting "gross-polluting" vehicles
off the road.
Supervisor Powers has recommended that the Board of Supervisors
take a position on SB 100 . Staff is recommending a support
position, based on the Board' s past position on similar pieces of
legislation.

An act to add Article 5 (commencing with Section 4385 0)
to Chapter 4 of Part 5 of Division 26 of the Health and..Safety
Code, and to add Section 4000.6 to the Vehicle Code, relating
to airpollution, and making an appropriation therefor. .
LEGISLATIVE COUNSEL'S DIGEST
SB 100, as introduced, Kopp. Motor vehicles: air pollution.
Existing law requires the Department of Motor Vehicles,
upon the renewal of registration of a motor vehicle subject to
a motor vehicle smog.. inspection program, to require
biennially a valid certificate of compliance issued by a
licensed smog check station.
This bill would require the department, if a $50 fee is paid
upon the initial registration of a nevi motor vehicle, to issue
a certificate of exemption from those requirements. That
exemption would be valid for 4 years, thus exempting the
vehicle from 2 biennial smog checks.
The department would be required to transmit the fees to
the Controller for deposit in the Motor Vehicle Replacement
Account, which the bill would create in the Air Pollution .
Control Fund. The bill would continuously appropriate funds
in the account to the State Air Resources Board to establish,
administer, and implement a program for the replacement of
gross-polluting vehicles with new low-emission vehicles. As
part of that program, the bill would authorize the state board
to subsidize the purchase or lease of new low-emission
vehicles by individuals to replace gross-polluting vehicles
owned by the same individual since January 1, 1992. The bill
would provide an unspecified definition of "gross-polluting
vehicle" and "low-emission vehicle."

The people of the State of California do enact as follows:
1 -SECTION 1. Article 5 . (commencing with Section
2 43850) is added to Chapter 4 of Part 5 of Division 26 of the
3 Health and Safety Code, to read:

5 Article 5. Replacement of Gross-Polluting Vehicles

7 43850. The Motor Vehicle Replacement Account is
8 hereby created in the Air Pollution. Control Fund.
9 Notwithstanding Section 13340 of the Government Code,
10 all money deposited in the account pursuant to
11 subdivision (b) of Section, 4000.6 of the Vehicle Code is
12 continuously appropriated to the state board, without
13. regard to fiscal years,.. to establish, administer, and
14 . implement a. program for the replacement of
15 gross-polluting vehicles pursuant to this article.
16 43851. The state board shall establish and implement
17 a . program to . . encourage the replacement - of
18 gross-polluting vehicles with new low-emission vehicles.
19 43852. As part of a program for the replacement of
20 gross-polluting vehicles, the state. board may subsidize
21 the purchase or lease of new low-emission vehicles by an J�
22 individual to replace a gross-polluting vehicle owned 'by
23 the same individual since January 1,. 1992.
24 43853. As used in this article, "gross-polluting vehicle"
25 means and "low-emission vehicle" " means

27 SEC. 2. Section 4000.6 is added to the Vehicle Code,
28 to read:
29 4000.6. (a) At the time of application for initial
30 registration of a new motor vehicle subject to Part 5
31 (commencing with Section 43000) of Division 26 of the
32 Health and Safety Code, a fee of fifty dollars ($50) may
33 be paid to the department and, upon receipt of payment,
34 the department shall issue for.the vehicle a certificate of
. 35 exemption from the requirements of subdivision (a) of
36 Section 4000.3. The certificate of exemption shall be valid

1 for four years from the date of initial registration of the
2 vehicle, and shall have. the same force and effect. as a
3 certificate of compliance issued in accordance with
4 Section 44015 of the Health and Safety Code.
5 (b) Payments received by the department pursuant to
6 subdivision (a). shall be transmitted to the Controller for
7 deposit in the Motor Vehicle Replacement Account in
