MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: February 23, 1993 SUBJECT: Set Date for Public Hearing to Revise the Oakley/North Brentwood, Discovery Bay and East County Area of Benefit Fee Schedules for Delta Expressway. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: FIX March 23, 1993 at 11:00 AM for a public hearing to revise the Area of Benefit fee schedule for Oakley/N. Brentwood, Discovery Bay, Bethel Island and East County subarea of the East County Area of Benefit to provide adequate funding for the State Route 4 Bypass. DIRECT the Public Works Director to give notice of the hearing and to file a copy of the Engineer's Report on the State Route 4 Bypass Funding Mechanism with the Clerk of the Board in accordance with Government Code Sections 65091, 65962, and 66484. II. Financial Impact: Modifying the Area of Benefit contribution will provide an adequate funding mechanism to design and construct the State Route 4 Bypass which is a major transportation corridor contained in the County's General Plan and the Transportation Authority's Congestion Management Program (CMP). The County is required to implement the CMP in order to receive the allotted funding provided by gas tax revenues. III. Reasons for Recommendations and Background: The existing State Route 4 extends through the downtown areas of Brentwood and the communities of Byron, Oakley, Knightsen, and Discovery Bay. The existing SR4 through the3e communities is an at-grade limited capacity highway, located adjacent to schools, shopping, and numerous residences with direct access to the highway. These communities have realized the complications associated with high traffic volumes and truck traffic mi with local traffic. The State Route 4 "Bypass" will shift regional traffic from local streets a II ited access highway. February 23, 1993 Page 2 III. Reasons for Recommendations and Background:(Cont.) The only viable funding source for the 'Bypass" project is through development fees. Thus, the State Route 4 Bypass Authority recommends that the County Board of Supervisors conduct a public hearing, to modify the Area of Benefit Fee schedules in the general East County region to provide an adequate funding mechanism to design and construct the SR4 Bypass. IV. Consequences of Negative Action: Failure to fix a hearing date would prevent modification of the SR4 Bypass development contribution. As a result, high traffic volumes and truck traffic would continue to be a potential hazard along with increased congestion on the local roads through East County. In addition, the County could not allow any further development within the East County Area.
