SUBJECT: Conveyance of Easement to Contra Costa Water District
Buchanan Field Airport/Golf Course

The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired. certain real property by deed recorded on
September 21, 1961, in Book 3957 at page 591, in the Concord area, for use as a
general aviation facility. The Contra Costa Water District has requested an easement over
a portion of said property, described in Exhibit"A" attached hereto, for the installation and
maintenance of a fire hydrant and water service in conjunction with the golf course
improvement project. This Board FINDS that the conveyance of such easement is in the
public interest and will not substantially conflict or interfere with the County's use of the
property.
This Board hereby APPROVES and AUTHORIZES the conveyance of an
easement to Contra Costa Water District, over the property described in Exhibit "A"
attached hereto, pursuant to Government Code Section 25526.6 and the Board Chair is
hereby AUTHORIZED to execute an Easement Agreement on behalf of the County.
The Real Property Division is DIRECTED to cause said Easement Agreement to
be delivered to the grantee.

EASEMENT AGREEMENT
THIS AGREEMENT AND GRANT OF EASEMENT is made by and between
CONTRA COSTA COUNTY, a political subdivision of the State of California
hereinafter called"the Grantor",and CONTRA COSTA WATER DISTRICT,a local governmental agency
of the State of California,hereinafter called"the District".
1. For valuable consideration,the Grantor hereby grants to the District and the District
hereby accepts from the Grantor,a perpetual non-exclusive easement in the real property in the County
of Contra Costa,State of California,described on Exhibit A attached.
2. The purpose of this easement is to install,operate,maintain,repair and replace water
utility materials and equipment,including,without limitation,pipes,valves,meters,meter boxes,fire
hydrants,protecting posts,rectifiers,air releases,blow-offs,backflow prevention devices and
appurtenances.
3. All pipes except risers to meters,fire hydrants or appurtenances shall be installed at
least 18 inches below the surface of the ground.
4. The District will backfill all excavations and restore the ground to a condition equal to
the condition existing prior to the excavation.
5. The Grantor will not permit any structure to be placed on the easement or the access
thereto which will prevent vehicles and equipment from operating anywhere within the easement.
6. The District agrees to defend,indemnify and hold harmless the Grantor,its agents and
employees,of and from any and all claims,demands,costs,damages,losses,actions,causes of action
or judgments which Grantor may pay or be required by reason of any damage,including inverse
condemnation,injury,or death to any person or property suffered by any person,firm or corporation
as a result of the excercise by the District of the rights herein granted to it.
IN WITNESS WHEREOF,the Grantor and the District executed this agreement and grant of easement on
