January 26, 1993 Contra Costa County Board of Supervisors 651 Pine Street, 1st Floor Martinez, Ca 94553 Dear Board of Supervisors: Enclosed are Contra Costa County Board of Education's Resolutions Nos. 5-92/93 and 6-92/93. These Resolutions comply with the California Health and Safety Code Section 33676 to direct the County Auditor-Controller to allocate increase in assessed valuation up to 2% annually within redevelopment agencies to the County Office of Education. The Resolutions are submitted to the Board of Supervisors in accordance with the California Health and Safety Code Section 33676. /Vetrul y. VW/CORR/RESOLUTIONS IN THE COUNTY BOARD OF EDUCATION AND THE COUNTY SUPERINTENDENT OF SCHOOLS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA In the Matter of Electing to ) Receive Incremental Property Tax ) Revenues as Provided for by Section ) 33676 of the California Health and ) Joint Resolution No. 5-92/93 Safety Code - City of El Cerrito - ) E1 Cerrito Redevelopment Project ) Amendment No. 3 ) WHEREAS, Section 33676 of the California Health and Safety Code provides for the Contra Costa County Board of Education and Contra Costa County Superintendent of Schools, an affected taxing agency, to make certain elections regarding the receipt of incremental property tax revenues to be derived from a proposed redevelopment area; and WHEREAS, the City of E1 Cerrito and the Redevelopment Agency for the City of E1 Cerrito are considering adopting a Redevelopment Plan and have designated a project area for the El Cerrito Redevelopment Project Amendment No. 3 and said Plan provides for tax increment financing pursuant to Section 33670 of the California Health and Safety Code; and WHEREAS, Section 33676 of the California Health and Safety Code requires said election to be made by the Contra Costa County Board of Education and Contra Costa County Superintendent of Schools prior to the City of E1 Cerrito and the Redevelopment Agency adopting the Plan for the E1 Cerrito Redevelopment Project Amendment No. 3; and WHEREAS, the Contra Costa County Board of Education and Contra Costa County Superintendent of Schools have not entered into an agreement with the City of El Cerrito and the Redevelopment Agency for the City of E1 Cerrito pursuant to Section 33401 of the California Health and Safety Code; NOW, THEREFORE, BE IT RESOLVED, FOUND AND DETERMINED by the Contra Costa County Board of Education and Contra Costa County Superintendent of Schools on January 13 ,, 1993, that: The Contra Costa County Board of Education and Contra Costa County Superintendent of Schools elect to receive all of the property tax revenues that would otherwise be allocated to the Redevelopment Agency of the City of E1 Cerrito pursuant to subdivision (b) of Section 33670 of • Page 2 the California Health and Safety Code for the E1 Cerrito Redevelopment Project Amendment No. 3 that are attributable to the following: 1. Increase in the rate of tax imposed for the benefit of the Contra Costa County Board of Education and Contra Costa County Superintendent of Schools which levy occurs after the tax year in which the ordinance adopting the Redevelopment Plan for the E1 Cerrito Redevelopment Project Amendment No. 3 becomes effective; and 2. Increases in the assessed value of the taxable property in the E1 Cerrito Redevelopment Project Amendment No. 3, as the assessed value is established by the assessment roll last equalized prior to the effective date of the ordinance adopting the Redevelopment Plan for the E1 Cerrito Redevelopment Project Amendment No. 3 pursuant to subdivision (a) of Section 33670 of the California Health and Safety Code, which are, or otherwise would be, calculated annually pursuant to subdivision (f) of Section 110.1 of the California Revenue and Taxation Code. BE IT FURTHER RESOLVED AND ORDERED that copies of this Resolution shall be sent by certified mail to the Auditor/Controller and the Tax Collector for the County of Contra Costa and the governing bodies of the City of E1 Cerrito and the Redevelopment Agency of the City of E1 Cerrito.
