NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------------ SUBJECT: Fire District Consolidation The Board considered the recommendations of the County Administrator as set forth in his report dated December 7,1993 , which included making application to the Local Agency Formation Commission (LAFCO) to consolidate the Merit System fire protection districts (Contra Costa County, Orinda, Riverview, and West County) and the Pinole Fire Protection District into one district; and making a second application to LAFCO to consolidate the Paid-On-Call fire districts (Bethel Island, East Diablo and Oakley) into one district separate from the Merit System District. The following persons commented on the proposed recommendations which included costs and staffing levels of the proposed consolidations; approval/disapproval of the recommendations presented; request for one countywide consolidated fire service; request to include Oakley in with the consolidated Merit system fire protection district; and concern that Orinda would not receive an adequate level of fire service: Bobbie Landers, City of Orinda, 25 La Cuesta, Orinda; Sue Noe, Town Council, 23 La Salle Drive, Moraga; Seth Cockrell, Oakley Fire Protection District, 100 Fire Place, Knightsen; Paul Hein, Chief, East Diablo Fire Protection District, 745 First Street, Brentwood; David Wahl, Acting Chief, Bethel Island Fire District, P. Box 623, Bethel Island; Sherri Anderson, Discovery Bay Municipal Advisory Council, (no address given) ; Kevin Morrow, Knightsen Fire Fighters Association, 61 Yula Way, Oakley; Tom Johnson, Oakley Fire Protection District, 300 Lorenz Drive, Oakley; Ray Davis, (no address given) ; Maria L. Algris, City of Pinole, (no address given) ; Jack Shelting, Knightsen Fire Fighters Association, 3071 Doyle Road, Knightsen; and Nick Papadakos, P. O. Box 96, Byron. Henry Warren, United Professional Fire Fighters, Local 1230, 112 Blue Ridge Drive, Martinez, referred to the first recommendation and requested that fire fighters be permitted to participate in the dialogue for development of a seniority list and employee displacement rights in the event of a layoff. In reference to the second recommendation on consolidation of the Paid-on-Call fire districts, Mr. Warren expressed concern with developing a seniority list with personnel both in and outside the Merit System. Henry Warren also spoke on the exclusion of the Moraga Fire Protection District from the consolidation process and expressed his belief that the concerns and protections (Paramedic Service, fire flow tax, etc. ) requested of the Town of Moraga could be addressed. He concluded by saying that a majority of the Moraga fire fighters and Local 1230 as a group support the inclusion of Moraga into the consolidated district if protections can be put in place to retain the services and the special funding currently available in the Moraga fire service. Adopt the attached resolution making application to ' the Local Agency Formation Commission to consolidate the Paid On Call fire districts (Bethel Island, East Diablo and Oakley) into one district separate from the Merit System district. 3 . Direct the County Administrator to continue to meet and confer with relevant employee organizations as appropriate. REASONS FOR RECOMMENDATION/BACKGROUND: On October 26, 1993 , the Board of Supervisors approved the concept of consolidating the Merit System districts and the Paid On Call (POC) , formerly known as volunteer, districts into two separate consolidated districts. Attached are two proposed LAFCO applications which provide the legal framework for initiation of the consolidation process with LAFCO. Box 3010, Martinez, CA 94553 s Fire District Consolidation Page 2 - 12/7/93 The applications deal with the disposition of district assets and liabilities , the dedication of special revenue sources to the areas in which they are currently generated, the assignment of personnel and the maintenance of service levels . As indicated in the LAFCO application for the POC districts, the issue of employee placement has not been resolved. Feasibility of Including Oakley in Merit District Consolidation The Board requested the County Administrator to review the concept of deleting Oakley Fire from the POC consolidation and, instead, consolidating it with the merit system districts . In order to review this proposal, the assumption is made that Oakley would be continued indefinitely as a "volunteer" or reserve district, and that the action would neither improve nor diminish fire service levels in the Oakley Fire District. This option would benefit the consolidated POC district by eliminating the proposed Oakley Fire District daytime staffing cost of approximately $120 , 000 . If the Oakley Fire Protection District was included in the merit district consolidation, such action could raise expectations that inclusion in the merit system district would result in the provision of full-time firefighters in the Oakley stations. Those expectations could not be met in the foreseeable future. The County Administrator recommends that consideration of consolidating Oakley Fire with the merit districts be deferred until the initial consolidations are completed and after pending meeting and conferring with Local 1230 is concluded. Bethel Island Request for Inclusion in Merit District Consolidation This Office has received the attached letter from the Bethel Island Fire Commission regarding the consolidation proposal. The letter expressed concern about the proposed reduction of administrative positions. The letter also proposed that Bethel Island fire be included in the consolidation with the merit system districts. In general terms, the Bethel Island Fire District is proposing that it be managed by and as a part of the consolidated merit district and that the traditional Bethel Island staffing pattern of one full-time permanent position on duty 24 hours a day ( for a total of three employees) be maintained for station coverage. The County Administrator recommends that this proposal be dealt with in the same manner as suggested for the Oakley proposal. Code ) §§ 56652, 56428 ) ) The Board of Supervisors of the County of Contra Costa, acting as the governing board of the Contra Costa County, Orinda, Pinole, Riverview and West County Fire Protection Districts, hereby requests that the Local Agency Formation Commission of Contra Costa County concurrently 1) amend the sphere of influence of the Contra Costa County Fire Protection District, 2) approve the annexation of all territory of the Orinda, Pinole, Riverview and West County Fire Protection Districts to the Contra Costa County Fire Protection District, and 3 ) dissolve the Orinda, Pinole, Riverview and West County Fire Protection Districts: 1 . This proposal is made pursuant to the Cortese-Knox Act, Government Code section 56000 et seq. 2 . The nature of this proposal is 1 ) the annexation of the entire territory of the Orinda, Pinole , Riverview and West County Fire Protection Districts to the Contra Costa County Fire Protection district, along with a concurrent amendment of the sphere of influence of the Contra Costa County Fire Protection District to accommodate the annexation, and 2 ) the concurrent dissolution of the Orinda, Pinole, Riverview and West County Fire Protection Districts. It is contemplated that the provision of all fire protection services will be assumed throughout the annexed territory by the Contra Costa County Fire Protection District and that the Orinda, Pinole, Riverview and West County Fire Protection Districts will dissolve and cease operations. 3 . The boundaries of the territory to be annexed, and of the sphere of influence amendment, are set forth in Exhibit A. (map( s) of area) 4 . The terms and conditions proposed for the change of organization are as follows : a. All equipment and other personal property, all real property and all records, funding, rights, liabilities and assets, whether tangible or intangible, shall be transferred from the Orinda, Pinole, Riverview and West County Fire Protection Districts and become the property, rights and obligations of the Contra Costa County Fire Protection District. However, any equipment acquired through donation by a fire district shall continue to be assigned to the area for which the equipment was intended at the time of donation. The Board of Supervisors, as the Governing Board of tha Districts, shall take whatever measures may be necessary to effect these transfers. b. Any special revenues in-luding, but not limited ' ;:'o, banefit assessments or development fees associated with any existing fire district shall be restricted for use in the area of the consolidated district that corresponds to the territory of tha former fire district in which the revenue source was implemented. c. The Chief of the Riverview Fire Protection District will become the acting Chief of the Contra Costa County Fire Protection District. d. All other employees of the Orinda, Riverview and West County Fire Protection Districts will become employees of the Contra Costa County Fire Protection District in the positions they hold at the time of annexation. e. All employees of the Contra Costa County, Orinda, Riverview and West County Fire Protection Districts are employed in identical Merit Systems administered by Contra Costa County. The rules for those Merit Systems are contained in the Personnel Management Regulations which will remain in effect for all employees unchanged for the merged fire service. The terms and conditions of employment of the represented employees of the Contra Costa County, Orinda, Riverview and West County Fire Protection Districts are governed in part by a memorandum of understanding between the respective fire protection districts and United Professional Firefighters, I .A.F.F. , Local 1230, which has expired but the terms of which are continued by operation of law. Those terms and conditions of employment shall continue to remain in effect as provided in said memorandum of understanding unless and until they are changed by agreement of the parties, or by lawful action by the respective fire protection districts individually so long as they exist, or by the Contra Costa County Fire Protection District; provided that with merger into a single Fire Protection District under a single Fire Chief appointing authority, employee seniority will be merged into a single seniority list for each job classification and employee lay-off displacement rights will include the entire. merged District. f. This application takes into account the fact that the Pinole Fire Protection District has no employees. g. With this change of organization to add territory to the Contra Costa County Fire Protection District, it (the Contra Costa County District) as it now exists shall remain in existence for the purposes and continued application of the Fire Protection District Laws of 1961 and 1987 . 5 . The reason for this proposal is to allow the provision of better and more economic fire protection services to the areas of the five Fire Protection Districts . Upon reorganization of the existing fire districts, the Contra Costa County Fire Protection District will use its best efforts to maintain the following minimum standards of existing service levels: 1 . While allowing for station relocation within a former district, average and maximum response times, as measured from existing fire stations to the area served by those stations, will be maintained. 2 . The existing Incident Command System ( I .C.S. ) , utilizing engine company personnel, chief officers and staff as commonly utilized in the fire service throughout California. 3 . Support services, as measured by inspection and abatement service levels , development plan review service levels and disaster preparedness coordination effort will be maintained. 4 . Emergency medical training, wildlands fire training, hazardous materials training and other specialized training based on local area needs will be provided as necessary within each of the former districts . 5 . Capital equipment and improvements, as measured by existing number of stations, and the response capabilities of existing engines and ambulances will be maintained. Efforts to improve the water supply systems , (hydrants , mains, etc. ) will be continued. Efforts to maintain the standards will be equitably applied throughout the reorganized district and among the former districts. Should funding levels decline from those in existence at the time of reorganization, reduction in standards will be equitably applied throughout the reorganized district and among the former districts. 6 . ' The proposal is not consistent with the present sphere of influence of the Contra Costa County Fire Protection District or the present spheres of influence of the Orinda, Pinole, Riverview and West County Fire Protection Districts but would be consistent with the amended sphere of influence proposed herein for the Contra Costa County Fire Protection District. 7 . Although we support their efforts to streamline fire protection county-wide, we would like to offer a few cautions . Under option 2 of the non-merit system consolidation you propose to reduce the number of active administrative positions from seven to one. (Three "shift" supervisors fill one position. ) Having a single shift supervisor for a battalion the size and complexity of the far East County may just define the term "dumb-sizing" as described by Supervisor Smith many months ago. We are concerned that such a drastic reduction in supervisory fire officers will jeopardize day-to-day, and more importantly, emergency operations . Obviously, we support the elimination of duplicate and redundant administrative positions . We caution you to show some restraint and truly analyze which positions ( and functions) are duplicate and which are not. Add to this that since our efforts in Sacramento were so successful , we can afford to do better for the far East County. Secondly, we understand that Supervisor Torlakson has suggested Oakley and Bethel Island Fire Distircts be included in the consolidation of the merit system districts . Acting Chief Wahl outlined the ramifications of this new option at our November , 4 , 1993 Fire Commission meeting. We tend to support this option based upon the information provided thus far . We also understand that the Supervisor did not include us in the formation of the motion that directed the CAO to pursue this option. . Therefore, we are requesting that our fire district be included and that your office take whatever steps necessary to amend your charge from the Board of Supervisors to allow this to occur.
