The Board of Supervisors of Contra Costa County RESOLVES THAT:
1. Deputy Clerk - Courtroom Clerk shall be reallocated from Salary Level C5 1785
$2706 - $3290 to salary level C5 1816 $2792 - $3393 effective December 1, 1993.
In lieu of retroactive pay, employees will receive a lump sum payment computed
as follows: Employees'regular pay and overtime pay will be added together for
each applicable pay period to determine the Retro Pay Base. This base will
then be multiplied by 3.1%to arrive at the employees' lump sum payment. This
computation will be for pay periods retroactive to July 1, 1992.
2. In accordance with the County's Court Coordination Plan, certain Municipal
Court judges and their Deputy Clerk - Courtroom Clerks (usually no more
than 2.5 positions at any one point in time) will be assigned to handle Superior
Court matters on a rotational basis.
3. In order to recognize the additional knowledge required of Deputy Clerk -
Courtroom Clerks and their increased responsibilities while on assignment to
the Superior Court, a salary differential of 4.8% shall be paid.
4. The salary differential shall be computed on base pay at the employees'
current salary step and shall commence on the.first day that the Deputy Clerk
Courtroom Clerk and judge are assigned to handle Superior Court matters.
This differential applies only to Superior Court assignments that are at least
two consecutive weeks in duration.
5. The salary differential shall not be included in the employee's base pay for
purposes of computing other differentials or overtime. This differential is
paid only for those days in which employees are assigned to handle Superior
Court matters.
6. The salary differential shall be terminated when Deputy Clerk - Courtroom
Clerks are rotated back to their assignment in the Municipal Court.
7. The salary differential shall be paid to employees who rotate to the Superior
Court assignment on or after January 1, 1993.

SUBJECT: Salary Differential For Deputy Clerk - Courtroom Clerk
RECOMMENDATION(S):
ADOPT the attached resolution to provide for: (1) The reallocation of Deputy Clerk
Courtroom Clerk from salary level C5 1785 $2706 - $3290 to salary level C5 1816 $2792 -
$3393; and (2) A salary differential of 4.8% for Deputy Clerk - Courtroom Clerks in the
Municipal Court who function as courtroom clerks in the Superior Court.
FINANCIAL IMPACT:
It is estimated that the reallocation and salary differential will cost approximately $30,000 on
an annual basis. The Municipal Courts have agreed to absorb this cost as part of the FY 1993-
94 budget plan.
BACKGROUND/REASON(S) FOR RECOMMENDATION(S):
The Trial Court Realignment and Efficiency.Act (AB 1297), inacted in 1991, requires that
Municipal and Superior Courts in each County in California prepare a plan for coordinating
its court operations with at least one other court to achieve maximum utilization of judicial and
other court resources. In accordance with Contra Costa County's Court Coordination Plan,
certain judges in the Municipal Court are functioning as Superior Courtjudges on a rotational
basis.
Deputy Clerk-Courtroom Clerks have been required to become knowledgeable about and to
perform felony sentencing. In addition, they have received training in several other aspects of
work performed in the Superior Court and must be prepared to rotate to the Superior Court
as provided for in the County's Court Coordination Plan. In recognition of this additional
training and knowledge required,the class is being reallocated from salary level C51785 $2706
-$3290 to salary level C5 1816 $2792 - $3393. The increase in the salary range for Deputy

Clerk - Courtroom Clerk will reestablish a long term salary differential which previously
existed between this class and Superior Court Clerk wherein the Superior Court Clerk was paid
4.8% higher than the Courtroom Clerk in the Municipal Court.
When Municipal Court judges are rotated to work in the Superior Court, their courtroom
clerks are rotated with them. Since the Deputy Clerk-Courtroom Clerks will be performing
essentially the same duties as Superior Court Clerks, a salary differential of 4.8%is provided
for in the attached resolution. This differential will be paid only for the time that Deputy Clerk
- Courtoom Clerks spend on assignment with Municipal Court judges who are acting as
Superior Court judges under the Court Coordination Plan.
