Recommended Action: DIRECT the Public Works Director and the Ambrose Recreation and Park District to amend their current Cooperative Management Agreement (dated December 15, 1992) to include maintenance of existing and future local trails. DIRECT the Public Works Director to examine the County Landscaping District AD-1973-3 (LL-2) and its Bay Point area Zone 9 fees structure to determine what fee increase if any would be required to fund the maintenance of the Bay Point trails. DIRECT the Public Works Director to examine whether Keller Canyon Mitigation fees are an appropriate funding source to pay for the maintenance of the Bay Point trails. II. Financiallmpact: None. III. Reasons for Recommendations and Background: Bay Point Trails - Concepts for a local trail network have been established for the Bay Point area. The general plans for Bay Point and the County encourage such a local trail network. The Board of Supervisors has taken actions requiring subdividers to install sections of this system and has also obtained various grants and funds to build other sections. This local trail network (Bay Point Trails) would serve pedestrian and bicycle traffic for recreation and commuter purposes. Included in the trail network would be a trail along the East Bay Municipal Utility District (EBMUD) right-of-way, at trail to Hill 410, a ridge trail west of Subdivision 7597, a trail along the Contra Costa Canal and other trail segments that would create links between the main trails and local streets with pedestrian facilities. If the trail system is completed, the Bay Point area would have a local trail network that connects to the regional Delta De Anza Trail thus providing local and regional trail benefits to the Bay Point area. Reasons for Recommendations and Background: (Continued) Financial Background - The Public Works Department has been granted Transportation Development Act (TDA) funds for the construction of a trail along the EBMUD right-of-way between Willow Pass Road and Riverside Drive in the Bay Point area. Subdivision 7597, also known as Boeger Ranch, is conditioned to construct a trail within the EBMUD right-of-way from Driftwood Drive to Riverside Drive. The end result will be a continuous trail from Willow Pass Road to Driftwood Drive which would serve Pacifica Park and Riverview Middle School and provide a key link to the regional Delta De Anza Trail. Subdivision 7597 is also conditioned to construct a trail from the development to Hill 410 and a ridge trail. There is $275,000 set aside for trails in the Bay Point area which came from the Navy Mitigation funds which was received to offset the closure of Port Chicago Highway. This mitigation fund would be best used for capital expenditures for additional trail improvements and not for maintenance. Maintenance Requirement -The County must enter into a license agreement with the East Bay Regional Park District (EBRPD) in order for a trail to be built within the EBMUD right-of-way. EBRPD is currently negotiating a license agreement with EBMUD which will allow them to construct and operate the Delta De Anza Trail on the EBMUD right-of-way. The license agreement requires the maintenance of the trail and right-of-way. EBRPD has indicated that their agreement with EBMUD should be executed by the end of December 1993. In order for the County to fulfill its obligations of the proposed license agreement with EBRPD, and for the Bay Point Trails to be adequately maintained, it is imperative that a maintenance agency be designated and a funding source be established for the maintenance of the trails. The most reasonable agency to take on the maintenance responsibilities for the trails is the Ambrose Recreation and Park District since it is currently responsible for the maintenance of Ambrose Park, Anuta Park, Pacifica Park, Ambrose Center, Bailey Road median and sidewalk areas and general maintenance within the Zone 9 limits. The Delta De Anza Trail would be maintained by the EBRPD. The scope of the Bay Point Trail maintenance responsibilities would be determined after futher study. The most reasonable funding source would be the LL-2 Zone 9 Assessment District since the primary beneficiaries of the Bay Point Trails would be residents in that District and this is the current funding source to pay for services provided by the Park District. An amendment to the current Cooperative Agreement between Ambrose Recreation and Park District and an increase in the Zone 9 assessment fees would provide for the most reasonable agency and funding source required for maintenance of the proposed Bay Point Trails. In addition, an application has been submitted requesting that a portion of the Keller Canyon Mitigation Open Space Funds be allocated for trail maintenance. This item has been referred to the Transportation Committee for any input they may want to provide. IV. Consequences of Negative Action: Consequences of negative action are that the Public Works Department will not be able to fulfill the proposed license agreement obligation to maintain the trail within the EBMUD right-of-way and funding from TDA may be lost. In addition, the developer of Subdivision 7597 would not be able to fulfill the condition to construct the trail within the EBMUD right-of-way. Additionally, long term maintenance of the remaining trails will not be provided for potentially resulting in unsafe and unsightly trails due to lack of pavement maintenance, litter, and weed control. cc: M.
