REASONS FOR RECOMMENDATION/BACKGROUND: A. Background Last week you considered a report from the County Administrator regarding fire district consolidations. Certain questions and concerns were raised by Board members, fire chiefs, firefighters, commissioners and citizens concerning the proposed application to the Local Agency Formation Commission (LAFCO) to consolidate the Paid On Call (POC) fire districts (Bethel Island, East Diablo and Oakley) into one district separate from the Merit System district. The Board directed the County Administrator to prepare additional information, which is contained in . this report, regarding these issues and questions. B. Responses to Issues and Concerns 1 . To address these questions of concern in more detail, the County Administrator had a meeting on 12/8/93 with the Fire Chiefs and other personnel of the three East County Paid on Call districts as well as administrative representatives of Chief Allen Little. The three East County Fire Chiefs raised a number of concerns about proceeding now with the consolidation of their districts. Two basic objections were stated: 1) the proposed LAFCO application regarding the consolidation of the three Paid On Call districts does not specify the contractual terms and costs if the resulting non-merit district is administered and managed through a functionally integrated agreement with the Merit System and, 2) that the application does not address how current level of services will be maintained. The position of the East County Chiefs was that there were too many unanswered questions regarding the advantages and disadvantages as well as the resulting costs to proceed concurrently with PUC district consolidation in East County. They indicated that they had discussed these issues with their respective fire commissions and firefighters and there was agreement on this position. There was also concern expressed by the Chiefs about the resulting morale degradation that could occur by proceeding at the current time with the proposed consolidation and that this could affect the availability of paid on call and other volunteers wi4hin the three districts. 2. Emergency Dispatching The current functionally integrated dispatching for East County Fire Districts started in May 1991. Cost for dispatching services are apportioned on a common cost basis by the numver of incidents dispatched per District. No additional costs are anticipated with consolidation of fire services and dispatching service and performance levels will be maintained under the present funding levels. Bethel Island, East Diablo and Oakley account for ' .765 or 8. 58% of the 32,214 incidents dispatched per year by contra Costa County Fire Communications Center. The dispatching cost of the combined East County Fire Districts for 1993 is estimated to be $148 ,404 as shown below: 2. Fire Prevention Services Fire prevention services have been provided to the East County districts. Since 1984, a transfer of funds from S.D.A.F. has been made to Riverview Fire District, which when added to inspection fee revenue, has funded prevention services in the three ( 3 ) non-merit districts. Any proposed contract between the new merit district and the three ( 3 ) POC districts would intend to continue the current level of service. No additional costs are anticipated beyond those resulting from inflationary impacts. 4. Management Costs If the Paid On Call (POC) fire districts--Bethel Island, East Diablo and Oakley--were consolidated into one district and then, through functional integration, managed by the separate consolidated Merit System fire district, the consolidated POC district would be responsible for its share of management costs. In 1992-93 the management costs of one Fire Chief and three Assistant Chiefs were determined to be $506,263 . If those costs were allocated on the basis of the 1992-93 budgets, the consolidated POC district would be charged $23, 288 with the balance of $482,975 the responsibility of the newly consolidated Merit System fire district. It should be noted that $506,263 is the minimum amount in management costs that would be subject to allocation on a proportional basis. There has been discussion on including other management positions in the management cost allocation plan. At some point it becomes questionable how many agencies can be absorbed without a concurrent increase in administrative staff, especially as it relates to emergency services. 5. Building and Facilities Maintenance of building and grounds is managed by Support Services Division, which typically utilizes outside services to accomplish capital and preventive maintenance repairs. District workload varies significantly depending upon size and scope of building (generally fire stations) projects, vast array of maintenance needs and condition of structures and facilities. If a POC district requires such preventive maintenance services, that would represent a cost to that district. (This would represent no change from the current situation. ) 6. Vehicle Maintenance Fire apparatus and support vehicle preventive maintenance are currently being accomplished at two shop locations (Antioch and Concord) , fire stations and by private sector shops. 3 Routine maintenance is provided by firefighters (paid and volunteer) working on vehicles at fire stations as well as by full- time mechanics at fire district shop facilities in Central and East County. The current fleet of Bethel Island, East Diablo and Oakley consists of slightly over 50 vehicles; this parallels Riverview' s fleet, which requires two ( 2) full-time mechanics for preventive maintenance. The newly functionally integrated fleet servicing has been accomplished by using existing personnel and jobbing out some heavy duty maintenance on a time-and-materials basis. Current workload exceeds present Fire District personnel allocated; this needs to be adjusted as the transitional needs warrant. The East County fleet will require one to two full-time mechanics to provide adequate maintenance in the future. Cost of a full-time mechanic is approximately $58,000. Due to the variety of different types and designs of vehicles, costs tend to be higher than fleets that have been designed around standard specifications and common part purchasing and warehousing. 7 . Level of Service, Budgets and Redevelopment Agencies In 1992-93 the combined budgets of the three POC fire districts was approximately $2. 4 million. The districts operate a total of 9 fire stations. In the Merit System fire districts with full-time firefighters, the cost of operating a fire station is approximately $1 million per year. If staffing in the POC fire districts was equivalent to that in the Merit System fire districts in terms of work schedule and compensation, the obvious question arises as to where the additional revenue needed would come from. Presently, the budgets of the POC districts clearly cannot support full-time firefighters in their fire stations. It is noted that fire districts in Contra Costa County are losing a significant amount of property tax revenue each year to Redevelopment Agencies. In 1992-93 the five Merit System fire districts and three POC fire districts lost a combined total of $4. 8 million. Of that total, approximately $4 million was lost in the Contra Costa County and Riverview fire districts. A review needs to be conducted to determine if it is possible to eliminate or reduce those losses. 8. Training The suggested consolidation of the three Paid On Call districts into the larger Merit System district called for two positions and a clerk in the training function. When the cumulative time currently allocated to training activities by various staff in the three Districts is considered, the two proposed training staff constitute a reduction in full-time equivalent staff time. Until the exact salary level of the proposed training staff is determined, comparison with current costs is not clear. A valid concern, however, does exist as to both the quality and cost effectiveness of an immediate change in the current Paid On Call training activity on top of the changes already contemplated in the Merit System district. 9. Impact of Meet and Confer The County is now involved in a complex meet and confer process with I .A.F.F. , Local #1230 regarding the impact of consolidation of the Merit System districts. Addition of Paid On Call districts to the merit system consolidation proposal brings in to that meet and confer a volume of issues of potential concern to the Merit System 4 employees, over which Local #1230 would have an obligation to meet and confer. The effectiveness of the effort to consolidate the personnel of the Merit system districts will be diluted. The time required to deal with. those issues could greatly delay the Merit System consolidation. At the same time, the County is initiating the first meet and confer with the new Paid On Call bargaining representative which is Teamsters, Local #315. If faced with consolidation with the Merit System districts, Local #315 would have an obligation to meet and confer over some of the very same issues as Local #1230. The County would, therefore, experience two more complex negotiations with two now competing labor organizations. The variability in personnel practices possible between two different districts could be lost. The entire implementation of consolidation of the Merit System districts could well become bogged down in mutually exclusive demands from the two labor organizations. C. Consensus of the three East County Paid on Call Districts Chiefs Based upon the above described concerns of the three East County Paid on Call Districts Chiefs, the following summary can be made: • Each Chief stressed the differences in tradition and operating philosophy that underlies each of the three districts and each of these differences would have to be considered and taken into account before proceeding with any consolidation. • The three East County Chiefs firmly believe that all the issues, questions and concerns detailed above need to be fully addressed and resolved before the Board of Supervisors proceeds to consolidate the three districts and they represent this as the view of both the Fire Commissioners and the firefighters. • The three Chiefs further believe that a more structured and incremental approach makes sense which would begin with exploring further functional integration between merit and non-merit districts. Each of the three Chiefs pledged their support in this effort. • Each of the three Chiefs firmly supports the goal eventually of one County fire district which provides all parts of* the county with a similar level of service. The County should proceed incrementally towards that goal and, in the meantime, should move forward with the merit system district consolidation. Accomplishing this would lay the foundation for further consolidation efforts involving the non-merit system districts and allow time for those districts to resolve in a collaborative process the issues discussed above. D. Further information regarding the option of including Oakley in Merit System district consolidation In the 12/7/93 report to the Board, the feasibility of including Oakley in the Merit System district consolidation was discussed. Under this item, the Oakley Fire Protection District would be abolished and would be included as a separate "volunteer" or reserve division within the Merit System district. The 12/7/93 report further discussed the impact of this action upon community expectations to fully professionalize the Oakley fire services and the likelihood of further complicating meet and confer negotiations with Local 1230. The Oakley Fire Protection District is currently served by Station 93 at 215 Second Street in Oakley and Station 94 at 15-A Main Street in Knightsen. The District has three paid administrative staff which includes one Fire Chief and two Assistant Chiefs and for a base salary cost of $64,584. The total budget for the District for FY 1993/94 is $531,209. Eliminating these three positions, however, would raise the question of how the volunteers which provide the firefighting and emergency response services at Stations 93 and 94 would oe supervised. Currently at least one of the three fire managers responds to a call and 5 provides on-site supervision. This might be handled by assigning a Battalion Chief employed by the Merit System district to also include Stations 93 and 94 within that person' s area of responsibility. This would seem, however, to somewhat reduce the level of emergency services to the Merit System stations involved. Paid On Call Option for Oakley Eliminating the three fire manager positions indicated above could save approximately $65,000 per year. This allows the opportunity to begin to introduce a Paid On Call system into the Oakley Fire Protection District. Paid on Call firefighter here refers to a firefighter who is scheduled. to work a 40-hour week which is the current situation in the East Diablo Fire Protection District. Table A illustrates current staffing and workload of Stations 93 and 94 in the Oakley Fire Protection District. In Station 93 (Oakley) , there is an annual call volume of 900 per year with 29 volunteers (who are paid on a per call basis) , 1 Station Operator (a scheduled 40-hour firefighter) , and one Assistant Chief. Station 94 (Knightsen) has a call volume of approximately 250 per year with 22 volunteers, no Station Operator and one Assistant Chief. Table B shows optional staffing which can be financed by eliminating the three management and adding three Paid On Call firefighters. Station 93 would continue to have 29 volunteers, one Station Operator and two newly-added Paid On Call firefighters and no Assistant Chief. Station 93 continues with 22 volunteers, with no Assistant Chief and one Paid On Call firefighter. In addition, the savings would permit the Oakley District to pay approximately $4,600 per year for administration to the Merit System district. It should be noted that with two Paid On Call firefighters and one already existing Station Operator that a 40-hour per week engine company could be formed if desired out of Station 93 . How the Merit System district would provide and pay for timely and adequate fire suppression supervision for Stations 93 and 94 under this scenario would need to be considered. . This represents an issue in costs that would need to be addressed to make this a viable option. Table A - Current Staffing and Workload Annual Call Volume POC Stat. Oper. Asst. If your Board wishes to amend the County Administrator ' s recommendation #1 of the 12/7/93 report such as to abolish the Oakley Fire Protection District and include the Oakley area fire services as a "volunteer" district in the Merit System district, then two issues need to be carefully considered: 1. The longer term costs and financing sources of fully prof essionali zing fire services in Oakley if community and firefighter expectations regarding level of service are raised by virtue of this action, and 2. The extent to which this would further complicate negotiations with Local 1230 since this inclusion would be a meet and confer issue. The potential for delaying the Merit System consolidation would have to be carefully considered. 7 ADDENDUM TO ITEM 2 .A December 14, 1993 The Board discussed the recommendations of the County Administrator contained in the attached December 7, 1993 and December 14, 1993 documents, as well as the December 13, 1993 memorandum entitled Supplemental Information for East County District. The following persons appeared and expressed their views with respect to the above recommendations : Joyce Hawkins, 43 Tappan Lane, Orinda, a member of the Orinda City Council; John Wolf, 820 Main Street, Martinez, representing the Contra Costa Taxpayers ' Association; David Wahl, P. 0. Box 623, Bethel Island, representing the Bethel Island Fire Protection District, who referred to the December 10, 1993 letter from the Bethel Island Fire Protection District attached to the December 7, 1993 recommendations of the County Administrator; Pierre Duquette, 5654 Sunfish Court, Byron; Seth Cockrell, 100 Fire Place, Knightsen, on behalf of the Oakley Fire Protection District; Tom Johnson, 300 Loren Drive, Oakley, on behalf of the East County Firefighters Committee Volunteers; Nick Papadakas, P. 0. Box 96, Byron; Enrico Cinquini, P 0. Box 966, Oakley, representing the Oakley Municipal Advisory Council . The Board recessed to tour the Contra Costa County Historical Center in Pleasant Hill, as scheduled on today' s agenda for 12 : 00 noon, and thence to Closed Session, and thereafter resumed its discussion on this matter. Supervisor Powers moved, based on the reports before the Board and the previous hearings, to merge the merit districts and Oakley FPD, and to defer action on Bethel Island FPD and East Diablo FPD until more of issues can be resolved. Supervisor Smith advised that he would second the motion with modifications . The motion was seconded by Supervisor Torlakson. Supervisor Smith recommended that the resolution containing the application to LAFCO for the merit districts contain language to make it absolutely clear to the people of Orinda that the Board does not intend to close their stations . Supervisor Torlakson expressed concern that the language not preclude Riverview from relocating stations inasmuch as relocations will be necessary in the future in areas that are growing, but that he supported assuring the Orinda Community that their stations will not be affected by the consolidation effort. Board members agreed to leave the language the way it is and add that it is not the intent to reduce the number of stations in any of the existing districts. Supervisor Bishop stated that she could support a motion with the five merit districts that the Board has been considering, with some form of functional integration for the three remaining paid-on-call districts; but she has problems with the motion as stated, which includes Oakley. Supervisor Torlakson commented that including Oakley in the merit system is in keeping with the desire of the community as expressed by ballot. Supervisor McPeak commented that she thought it a better course of action to take to LAFCO the consolidation of the five merit districts and not include Oakley at this time. Supervisor McPeak moved a substitute motion to pursue the consolidation of the five merit districts, functional integration with both Moraga and Oakley, Oakley remaining separate, and to pursue consolidation of the other two remaining volunteer districts . Chair Torlakson suggested breaking the original motion on the floor into two parts, the first dealing with consolidation of the five merit districts, and then dealing separately with the question of adding Oakley into that. The Chair called for a vote on the consolidation of the five merit systems as recommended by staff. The vote on the motion was unanimous . The Chair then called for a vote on adding Oakley to the five consolidated districts and amending the proposed application to LAFCO to include Oakley. The vote on the motion was : AYES : Supervisors Powers, Smith and Torlakson. NOES : Supervisors Bishop and McPeak. . The Chair declared the motion passed. The Board then discussed functional integration of the remaining two districts, Bethel Island and East Diablo. Supervisor Smith requested that Moraga be included in functional integration. Chair Torlakson stated that the motion would be to direct that functional integration proceed for the Bethel Island, East Diablo and Moraga Fire Protection Districts to be implemented in the next two months; and to address particularly savings in administration, to coordinate carefully the training, recruitment and placement of paid-on-call staff, and to implement school education/fire prevention programs . The vote on the motion was unanimous. Supervisor Torlakson then REQUESTED staff to review the possibility of putting into one district major properties or projects that are now located in two different districts, so as not to split a project, such as the proposed Cypress Lakes project which is now in both the Bethel Island and Oakley Districts, thus facilitating the decision of placement of a fire station. Supervisor Torlakson DIRECTED staff to prepare for meeting, on January 29, 1994 at 10 : 00 a.m, with property owners in areas not served by a fire district in Bradford Island, Jersey Island and Quimby Island to discuss provision of fire services . Chairman Torlakson REQUESTED County Counsel to prepare for Board consideration the appropriate resolution of application to LAFCO. The organizational option for the Oakley Fire District discussed in Section D provides an alternative that Oakley Fire be included in with the Merit System district consolidation as a reserve division. The option also proposed eliminating the three fire manager (chief officer) positions and using the savings to provide three Paid On Call firefighters on a 40-hour per week basis . This Supplement adds detail to the Oakley option including Oakley as a Reserve Division and contemplates a functional integration plan for the remainder of the East county within 120 days. Oakley Fire Consolidation District as a Reserve Division of Merit Place Chief Officers in Merit System "project positions" with the following possible titles : Current Suggested Chief Volunteer Chief/Reserve Coordinator .Asst. Chief Volunteer Asst Chief/Training Coordinator Asst. Chief Volunteer Asst Chief/Training Coordinator Initially, these positions would keep their current duties and be responsible for maintaining the "volunteer" program that currently exists including recruitment and training. A unanimous consensus was reached among those present at the meeting to request that the Board of Supervisors defer any decision on consolidating Oakley with any other fire district until more substantial information regarding the impacts of such a consolidation are available to residents of this district. I have enclosed a copy of a sheet signed by all present attesting to this request. You might note that this request is signed by all members of the Oakley Municipal Advisory Council, two Commissioners of the Oakley Fire Protectection District and a member of the Oakley Union School District Board who were present at last night's meeting. Feasibility of Including Oakley in Merit District Consolidation The Board requested the County Administrator to review the concept of deleting Oakley Fire from the POC consolidation and, instead, consolidating it with the merit system districts. In order to review this proposal, the assumption is made that Oakley would be continued indefinitely as a "volunteer" or reserve district, and that the action would neither improve nor diminish fire service levels in the Oakley Fire District. This option would benefit the consolidated POC district by eliminating the proposed Oakley Fire District daytime staffing cost of approximately $120,000. If the Oakley Fire Protection District was included in the merit district consolidation, such action could raise expectations that inclusion in the merit system district would result in the provision of full-time firefighters in the Oakley stations. Those expectations could not be met in the foreseeable future. The County Administrator recommends that consideration of consolidating Oakley Fire with the merit districts be deferred until the initial consolidations are completed and after pending meeting and conferring with Local 1230 is concluded. Bethel Island Request for Inclusion in Merit District Consolidation This Office has received the attached letter from the Bethel Island Fire Commission regarding the consolidation proposal. The letter expressed concern about the proposed reduction of administrative positions. The letter also proposed that Bethel Island fire be included in the consolidation with the merit system districts. In general terms, the Bethel Island Fire District is proposing that it be managed by and as a part of the consolidated merit district and that the traditional Bethel Island staffing pattern of one full-time permanent position on duty 24 hours a day (for a total of three employees) be maintained for station coverage. The County Administrator recommends that this proposal be dealt with in the same manner as suggested for the Oakley proposal. The rules for those Merit Systems are contained in the Personnel Management Regulations which will remain in effect for all employees unchanged for the merged fire service. The terms and conditions of employment of the represented employees of the Contra Costa County, Orinda, Riverview and West County Fire Protection Districts are governed in part by a memorandum of understanding between the respective fire protection districts and United Professional Firefighters, I.A.F.F. , Local 1230, which has expired but the terms of which are continued by operation of law. Those terms and conditions of employment shall continue to remain in effect as provided in said memorandum of understanding unless and until they are changed by agreement of the parties, or by lawful action by the respective fire protection districts individually so long as they exist, or by the Contra Costa County Fire Protection District; provided that with merger into a single Fire Protection District under a single Fire Chief appointing authority, employee seniority will be merged into a single seniority list for each job classification and employee lay-off displacement rights will include the entire merged District. f. This application takes into account the fact that the Pinole Fire Protection District has no employees. g. With this change of organization to add territory to the Contra Costa County Fire Protection District, it (the Contra Costa County District) as it now exists shall remain in existence for the purposes and continued application of the Fire Protection District Laws of 1961 and 1987. The reason for this proposal is to allow the provision of better and more economic fire protection services to the areas of the five Fire Protection Districts. upon reorganization of the existing fire districts, the Contra Costa County Fire Protection District will use its best efforts to maintain the following minimum standards of existing service levels: 1. While allowing for station relocation within a former district, average and maximum response times, as measured from existing fire stations to the area served by those stations, will be maintained. 2. The existing Incident Command System (I.C.S. ) ,, utilizing engine company personnel, chief officers and staff as commonly utilized in the fire service throughout California. 3. Support services, as measured by inspection and abatement service levels, development plan review service levels and disaster preparedness coordination effort will be maintained. 4. Emergency medical training, wildlands fire training, hazardous materials training and other specialized training based on local area needs will be provided as necessary within each of the former districts. 5. Capital equipment and improvements, as measured by existing number of stations, and the response capabilities of existing engines and ambulances will be maintained. Efforts to improve the water supply systems, (hydrants, mains, etc. ) will be continued. Efforts to maintain the standards will be equitably applied throughout the reorganized district and among the former districts. Should funding levels decline from those in existence at the time of reorganization, reduction in standards will be equitably applied throughout the reorganized district and amona the former districts. 6. Although we support their efforts to streamline fire protection county-wide, we would like to offer a few cautions. Under option 2 of the non-merit system consolidation you propose to reduce the number of active administrative positions from seven to one. (Three "shift" supervisors fill one position. ) Having a single shift supervisor for a battalion the size and complexity of the far East County may just define the term "dumb-sizing" as described by Supervisor Smith many months ago. We are concerned that such a drastic reduction in supervisory fire officers will jeopardize day-to-day, and more importantly, emergency operations . Obviously, we support the elimination of duplicate and redundant administrative positions. We caution you to show some restraint and truly analyze which positions (and functions) are duplicate and which are not. Add to this that since our efforts in Sacramento were so successful, we can afford to do better for the far East County. Secondly, we understand that Supervisor Torlakson, has suggested Oakley and Bethel Island Fire Distircts be included in the consolidation of the merit system districts. Acting Chief Wahl outlined the ramifications of this new option at our November • 4, 1993 Fire Commission meeting. We tend to support this option based upon the information provided thus far. We also understand that the Supervisor did not include us in the formation of the motion that directed the CAO to pursue this option. Therefore, we are requesting that our fire district be included and that your office take whatever steps necessary to amend your charge from the Board of Supervisors to allow this to occur. The organizational option for the Oakley Fire District discussed in Section D provides an alternative that Oakley Fire be included in with the Merit System district consolidation as a reserve division. The option also proposed eliminating the three fire manager (chief officer) positions and using the savings to provide three Paid on Call firefighters on a 40-hour per week basis . This Supplement adds detail to the Oakley option including Oakley as a Reserve Division and contemplates a functional integration plan for the remainder of the East county within 120 days . Oakley Fire Consolidation District as a Reserve Division of Merit Place Chief Officers in Merit System "project positions" with the following possible titles : Current Suggested Chief Volunteer Chief/Reserve Coordinator Asst. Chief Volunteer Asst Chief/Training Coordinator Asst. Chief Volunteer Asst Chief/Training Coordinator Initially, these positions would keep their current duties and be responsible for maintaining the "volunteer" program that currently exists including recruitment and training. In the future through functional integration, the positions might also be responsible for the same functions in the East Diablo Fire District and Bethel Island. East Diablo Fire Protection District Under functional integration, the East Diablo Fire Chief would be transitioned into the Merit System fire district. The remaining three full-time positions could become the Shift Supervisors designated in the October 26, 1993 report of the County Administrator. Under this scenario through functional integration, "volunteer" recruitment and training could eventually be provided by the Oakley Reserve Division of the consolidated Merit System district. The savings related to the elimination of the East Diablo Chief position of approximately $115,000 (salary and benefits) could be used to provide an additional 5.5 Scheduled Paid On Call firefighters . Until the following issues can be satisfactorily addressed, we request that the LAFCO application for consolidation of the three non-merit system fire districts be deferred. * Maintenance of existing service levels in each of the three fire districts. * Maintenance of support system for "Volunteer" programs. * Detailed terms and conditions of contract for administrative services. * Feasibility of including Oakley and Bethel Island Fire Districts into the consolidated merit system district. There are ways to provide better and more economical fire protection services to the far east county that have not been fully explored. The recommendation before you does not satisfy either of these goals. We anticipate you will respect the wishes of the Commissions, Chiefs, Firefighters, and citizens of the far east county communities who oppose further consideration of the proposal to consolidate the far east county districts under merit system administration. A unanimous consensus was reached among those present at the meeting to request that the Board of Supervisors defer any decision on consolidating Oakley with any other fire district until more substantial information regarding the impacts of such a consolidation are available to residents of this district. I have enclosed a copy of a sheet signed by all present attesting to this request. You might note that this request is signed by all members of the Oakley Municipal Advisory Council, two Commissioners of the Oakley Fire Protectection District and a member of the Oakley Union School District Board who were present at last night I a meeting.
