Project Nos.: 0672-6R6520 Marsh Creek Road; 0672-6R6521 Blackhawk Road; 0672- 6R6522 Taylor Blvd.; 0672-6R6523 San Pablo Dam Road; 0672-6R6524 Cummings Skyway; 0672-6136525 Kirker Pass Road; 0672-6R6526 Alhambra Valley Road; 0672- 686528 Bollinger Canyon Road. SPECIFIC REQUEST(S) OR RECOMMENDATION(S) &BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute Program Supplement No. 093 which provides$429,767 in Federal Transportation Improvement Funds for the emergency opening of Marsh Creek Road, Blackhawk Road, Bollinger Canyon Road, Taylor Blvd., San Pablo Dam Road, Cummings Skyway, Kirker Pass Road and Alhambra Valley Road. II. Financial Impact: The supplement provides Federal reimbursement for 100% of the County's costs for these projects. III. Reasons for Recommendations and Background: On June 21, 1977 the Board approved County/State Master Agreement No. 04-5928 for the funding of Federal Aid Projects. Due to the storms in January 1993, Contra Costa County was eligible for Federal Highway Administration disaster relief funds. On August 27, 1993, Contra Costa County qualified for Federal funds to pay for the emergency work specified. Reasons for Recommendations and Background: (continue) Caltrans and the Federal Highway Administration have determined that the County can be reimbursed for the County's estimated costs for the projects. IV. Consequences of Negative Action: If this program supplement is not approved the County will have to absorb the entire cost of these projects. Number: 04-927350 FOR FEDERAL-AID PROJECTS NO. 04-5928 ���►� This Program Supplement is hereby incorporated into the Local Agency-State Agreement for Federal Aid which was entered into between the Local Agency and the State on 06/21/77 and is subject to all the terms and conditions thereof. This Program Supplement is adopted in accordance with Paragraph 2 of Article II of the aforementioned Master Agreement under authority of Resolution No. approved by the Local Agency on (See copy attached) . The Local Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with the covenants or remarks setforth on the following pages. The effective date of this agreement is 01/05/93 2 . All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. 3. The Local Agency will advertise, award, and administer this project and will obtain the State's concurrence prior to either award or rejection of the contract. 4. The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2) /Detail Estimate or its modification (PR-2A) or the FNM-76, and accepts any increases in Exchange Funds, State Matching funds, and\or Local Agency. Funds as shown on the Finance or Bid Letter or its modification as prepared by the Division of Local Streets and Roads. 5. All emergency relief work reimbursed at 100% must be completed within 180 days following the storm period from January 5, 1993 thru March 20, 1993 . Local Agency records must clearly identify those costs incurred before and after January 5, 1993 . Incurred costs are defined as disbursements made or in process for goods and services delivered. Emergency relief work completed after September 16, 1993 will be funded at the federal aid reimbursement ratio of 88.53%. The Local Agency will be responsible for the matching requirement. 6. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 7. Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- taut or sub-contractor incurring over $25, 000 on the project. The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22, Allowable Costs. Page 2 of 2
