We have filed a protest on this job being awarded to the apparent low bidder. A copy of our protest letter is enclosed, for the Boards review. Once we have the opportunity to present our protest to the Board, we believe they will award the project to Valley Crest Landscape, Inc . Director of General Service Architectural Division Office CONTRA COSTA COUNTY 1220 Morello Avenue, Suite 100 Martinez, CA 94553-4711 Re : Crockett Neighborhood Park (Empire Ave, Oakley, CA) ; File No. 340-93011B . 4 . 1; Bid Date November 18, 1993 Dear Sir, Valley Crest Landscape, Inc . was the lowest responsive and responsible bidder on the above referenced project and, therefore, protests the bid of B&B Concrete on the grounds that their bid was not fully responsive and they did not make a bona-fide good faith effort to reach the goal for MBE and WBE on this project . B&B Concrete listed MBE' s totaling on 5 . 80-. and WBE' s totaling 1 . 90, while the advertised goals for each category was 14% and 60 respectively. Therefore, they only managed to achieve about 1/3 of the goal in each category. By comparison, our company achieved 23 .47% and 4 . 48% respectively for each category. That is almost 167% of the MBE goal and about 75% of the WBE goal advertised. How could B&B Concrete have made a good faith effort and only achieve 1/3 of the advertised goals, when our company achieved 1670 of the MBE goal and 75% of the WBE goal? Achieving the percentage goals our company did costs money and affects the bid, because frequently MBE and WBE do not have the absolute lowest prices available on bid day. If we had the percentages of participation of MBE/WBE that B&B Concrete did, we could probably have lowered our total bid enough to get under their price . To allow such low percentages as if it were a good faith effort is, therefore, unfair to those bidders, like our company, who did make the good faith effort . Furthermore, we believe that B&B did not put their seal on their proposal, which brings into question the validity of their entire bid.
