NOTICE OF PUBLIC HEARING
Before
THE BOARD OF SUPERVISORS, COUNTY OF CONTRA COSTA
At its regularly scheduled meeting on November 9, 1993 , at
11 a.m. at the Contra Costa County Administration Building, 651
Pine Street, Martinez, California, the Contra Costa County Board
of Supervisors will hold a public hearing concerning the adoption
of a schedule of parking penalties for parking violations, late
payment penalties, administrative fees, and other related charges
for parking violations pursuant to Vehicle Code Section 40203 .5.

SUBJECT: Transition to Civil Parking Penalties
SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
The State Legislature has mandated that traffic violations involving
standing and parked vehicles be transferred from the penal system, administered
by the courts to a civil penalty system administered by the counties and other
local agencies . State law requires that the transition take place before January
1, 1994 and the courts in Contra Costa County have required that the transition
occur on November 10, 1993 . On July 29 , 1993 the Board authorized the Office of
Revenue Collections to enter into agreements with agencies in Contra Costa County
for the collection of parking citations and. on September 21 , 1993, the Board
received the County Administrator' s progress report.
To complete implementation of the transition it is recommended that the
Board adopt the attached urgency ordinance, introduce the attached regular
ordinance, adopt the attached Resolution which maintains the existing court-
mandated violation penalties until December 31 , 1993 and establishes a new civil
penalty schedule effective January 1 , 1994 .

(Urgency Ordinance: Civil Parking Penalties)
The Contra Costa County Board of Supervisors ordains as follows :
SECTION I. SUMMARY. This ordinance is an urgency ordinance
providing for civil penalties for the violation of regulations
governing the standing or parking of vehicles .
SECTION II . Chapter 14-10 is added to Division 14 of Title 1
of the Contra Costa County Ordinance Code, as follows :

Civil Penalties
14-10.002 Violation - Civil Penalties .
Notwithstanding any contrary provision, any violation of an
ordinance code section governing the standing or parking of a
vehicle is subject only to a civil penalty and civil fees and
charges , as provided pursuant to sections 40200 and 40203 . 5 of
the California Vehicle Code.
14-10.004 Civil Penalty Schedules .
The Board of Supervisors shall establish and modify from time to
time, by resolution, schedules of parking penalties for parking
violations, late payment penalties , administrative fees, other
related charges, and civil penalties for standing and parking
violations, as provided in California Vehicle Code section
40203 . 5 or as otherwise provided by law.
SECTION III. URGENCY DECLARATION. This ordinance is an
urgency measure required to implement the transition of standing
and parking vehicle violation sanctions from the penal system
administered by the courts to a civil penalty system administered
by the counties and other local agencies . State law requires
that the transition take place before January 1, 1994 and the
courts in Contra Costa County have required that the transition
occur on November 10, 1993 .

SECTION IV. EFFECTIVE DATE AND EXPIRATION DATES. This
ordinance becomes effective immediately upon passage on November
9, 1993, and shall be operative until February 1, 1994 . Within
15 days of passage, this ordinance shall be published once with
the names of the Supervisors voting for and against it in the
CONTRA COSTA TIMES , a newspaper published in this County.

(Civil Parking Penalties) .
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I. SUMMARY. This ordinance adds chapter 14-10 to
the County Ordinance Code to provide civil penalties for the
violation of regulations governing the standing or parking of
vehicles .
SECTION II. Chapter 14-10 is added to Division 14 of Title 1
of the Contra Costa County Ordinance Code, as follows :

14-10.002 Violation - Civil Penalties .
Notwithstanding any contrary provision, any violation of an
ordinance code section governing the standing or parking of a
vehicle is subject only to a civil penalty and civil fees and
charges , as provided pursuant to sections 40200 and 40203 . 5 of
the California Vehicle Code.
14-10. 004 Civil Penalty Schedules .
The Board of Supervisors shall establish and modify from time to
time, by resolution, schedules of parking penalties for parking
violations, late payment penalties, administrative fees , other
related charges, and civil penalties for standing and parking
violations, as provided in California Vehicle Code section
40203 . 5 or as otherwise provided by law.

30 days after passage, and within 15 days after passage shall be
