Refer to Public Managers' Association via City Manager BACKGROUND As the City Council is aware, the Contra Costa Library and the Rape Crisis Center among others, has requested financial assistance from the City of San Pablo, Staff, at Council's direction, has considered the request for funding and submits the following:` COUNTY LIBRARY SERVICES . It essential that the City Council not write a check to the County to make up for the cuts the Board of Supervisors made. Often times, the best and most creative solutions to a problem comes when a crisis exist. For example, consider the actions taken by the Board of Supervisors on Functional Integration of the Fire Service. This probably would not have happened if it were not for a funding crisis. If all the cities in the county write a check to fund the library shortfall, then the heat is off and a quick solution will not be at hand. The City of San Pablo has taken concrete and proactive steps to deal with anticipated revenue shortfalls. We have not filled some positions. We have eliminated. others when they became vacant. We have laid off personnel. We reorganized and restructured the organization. We agree that 24 hours a week of the library service may not be adequate. However, the program is not being eliminated. Operating at this level is not fatal. Time should be taken to help the county find a permanent funding solution to the library program. This will undoubtedly require a new revenue source (s), and undoubtedly will require reassessment of what the library service is, how it is delivered, and how much of it the public wants and can afford. The goal should be to determine the long range needs of the public with regard to the service. We should not be driven by the employee layoff date to make a decision. Although sympathetic to their plight of those being laid-off, the concern should be the use of public resources over the long haul. The annual cost of funding the shortfall in San Pablo is $66,580. The City of San Pablo has been, and continues to be, a strong supporter of library services. Services should be run by the county as it has been for years. As a city we should support the county in finding a solution to the problem, we should proceed with deliberate speed to examine essential service delivery costs and to find a permanent revenue source to .ftind it. At the same time, council should direct city staff to look at program options and alternatives for an independent city operated library service in San Pablo, should the effort suggested above fail. In conclusion, the council should support the county in finding a solution to the funding problem with the library. We should not provide interim funding for the reasons outlined above and we should simultaneously look at developing a San Pablo independent library system as a contingency effort, should the county wide effort not produce a satisfactory answer for our community. In light of the foregoing, staff recommends that this item be referred to the Public Managers' Association via the City Manager for further review and discussion. (NOTE: Additional information provided by the Contra Costa Library is attached for Council's Review) RAPE CRISIS CENTER The Rape Crisis Center provided an important and essential service to the community. However, as discussed above, the City should encourage and assist the County in obtaining a permanent source of funding as discussed at the previous Council meeting. Staff recommends that the City Council cil set a policy in response to the numerous requests for funding assistance received and in anticipation of future requests for assistance as funding sources diminish. Therefore, it is recommended that the City Council establish a policy as follows: That the City Council of the City of San Pablo determine not to fund outside agencies until long term funding sources for all Local Government is found. Also present were City Manager Robinson, City Attorney Libow, City Treasurer Nicholas and the City Clerk. ORAL COMMUNICATIONS There was none. CONSENT CALENDAR Councilmember Brown requested the removal of the minutes of August 16, 1993 from the consent calendar. It was moved by Councilmember Vigil, seconded by Councilmember Wysinger, and unanimously passed to adopt all remaining items on the Consent Calendar. PERIODIC REPORTS By adoption of the Consent Calendar, the Treasurer's Report for the month of July, 1993 was ordered received and filed. By adoption of the Consent Calendar, the Vendor Check Register and payment of bills in the amount of$923,264.25 was approved. BOARDS & COMMISSIONS VACANCIES By adoption of the Consent Calendar, vacancies on various Boards and Commissions was ordered received and filed. PROCLAMATIONS By adoption of the Consent Calendar the following proclamations were approved: Proclamation declaring September 6, 1993 as "Try American Day'; Proclamation recognizing Party Time Catering for its dedication to excellence; Proclamation declaring September 25, 1993, as "Building a Drug Free Future Day"; and, Proclamation recognizing Mr. Jimmy Gordon for his dedication to public service. RESOLUTIONS It was moved by Councilmember Vigil, seconded by Councilmember Wysinger, and unanimously passed to adopt Resolution No. 93-89, a Resolution authorizing the City Manager to complete and file the Cable Television Rate Regulation and Certification Forms prepared by the Federal Communications Commissions. It was moved by Councilmember Vigil, seconded by Councilmember Wysinger, and unanimously passed to adopt Resolution No. 93-90, a Resolution certifying its intent to regulate basic tier cable television rates in a manner consistent with applicable Federal regulations. A resolution opposing the School Voucher System (Prop. 174) was presented. Rudy Jenkins, Public Employees Union Local No. 1 spoke in favor of the adoption of the resolution. It was moved by Councilmember Brown, seconded by Councilmember Angela, and unanimously passed to adopt Resolution No. 93-91, a Resolution opposing the School Voucher Initiative (Proposition 174). It was moved by Councilmember Wysinger, seconded by Councilmember Brown, and unanimously passed to adopt Resolution No. 93-92, a Resolution authorizing the City Manager to perforin functions of the City Council relating to claims against the City. It was moved by Councilmember Vigil, seconded by Councilmember Brown, and unanimously passed to adopt Resolution No. 93-93, a Resolution adopting a Bloodborne Pathogens Policy and Procedure Manual and amending the Community Development Department Budget. WRITTEN COMMUNICATIONS A letter from Nello Bianco, President, BART Board of Directors, urging the Council's support for BART's "Fast Track" proposal was presented. It was moved by Councilmember Brown, seconded by Councilmember Vigil, and unanimously passed to send a letter of support in concept for BART's Fast Track proposal, The communication from the National League of Cities requesting designation of a Voting Delegate and Alternate to the Annual Congress of Cities in Orlando, Florida was presented. It was moved by Councilmember Angela to nominate Councilmember Brown as the Voting Delegate. Councilmember Brown declined the nomination. It was moved by Councilmember Brown, seconded by Councilmember Wysinger to nominate Councilmember Wysinger as the Voting Delegate to the National League of Cities, Congress of Cities. The motion failed by the following vote: AYES: Councilmembers: Angela and Gomes NOES: Councilmembers: Brown and Wysinger ABSTAIN: Councilmembers: Vigil REPORTS City Manager Robinson reported on the request for financial support for Contra Costa County Library Services and Rape Crisis Center and referenced the written staff report dated September 7, 1993 and recommending that the City Council establish a policy in response to numerous requests for funding assistance received and in anticipation of future requests for assistance as funding sources diminish. City Manager Robinson further recommended that the City Council establish a policy not to fund outside agencies until local long term funding sources for all local government is found and further recommended that the issue of the future of library services be referred to the Public Manager's Association via the City Manager. It was moved by Councilmember Vigil, seconded by Councilmember Brown and unanimously passed to establish a policy that the City Council of the City of San Pablo determines not to fund outside agencies until long term funding sources for all local government is found. It was moved by Councilmember Vigil, seconded by Councilmember Brown and unanimously passed to refer to Public Managers' Association via the City Manager the subject of library services in Contra Costa County. PUBLIC HEARINGS. City Manager Robinson reviewed the staff report dated August 18, 1993 regarding the Negative Declaration prepared for the amendments to the Housing Element of the General Plan, and the adoption of the amendments to conform to requirements of State of California Code dealing with Housing Element standards, and recommended that the City Council adopt a resolution approving the Negative Declaration for the amendments to the Housing Element, and adopt by resolution the amendments to the Housing Element for the General Plan of the City of San Pablo, Mayor Gomes declared the public hearing open at 9:55 p.m. to consider the adoption of the Negative Declaration for the amendments to the Housing Element of the General Plan, and the adoption of the amendments to conform to requirements of State of California Code dealing with Housing Element standards. No one spoke for or against the issue. Mayor Gomes declared the public hearing closed at 9:56 p.m. It was moved by Councilmember Brown, seconded by Councilmember Wysinger and unanimously passed to adopt Resolution 93-94, a resolution approving the Negative UDeclaration; and Resolution 93-95, a resolution approving amendments to the Housing Element of the General Plan. City Manager Robinson reviewed the staff report dated September 2, 1993 regarding the appeal of the Planning Commission decision to modify the conditions of approval for use permit #1568 for La Plaza Del Tapatio, 2100 Broadway, San Pablo, California, and recommended that the City Council deny the appeal and uphold the conditions of approval as modified by the Planning Commission. Mayor Gomes declared the Public Hearing open at 10:05 p.m. to consider the appeal of Planning commission decision to modify the conditions of approval for Use Permit No. 1568 for La Plaza Del Tapatio, 2100 Broadway, San Pablo. Robert Bonovich, Attorney for Frank and Maureen Holleran, 2705 21st Street, spoke in opposition to granting the appeal. Jamie Casperez interpreter for applicant Frank Bracamonte and Mr. Bracamonte, 2100 Broadway, spoke in favor of granting the appeal Chuck Baird, 1535 Dover Avenue, San Pablo, spoke in favor of granting the appeal. Simon Ellis, 1637 23rd Street, San Pablo, spoke in favor of granting the appeal. Frank Holleran, 2705 21st Street spoke in opposition to granting the appeal. Maureen Holleran, 2705 21st Street spoke in opposition to granting the appeal. Mayor Gomes declared the Public Hearing closed at 11:05 p.m. It was moved by Councilmember Brown, seconded by Councilmember Vigil and unanimously passed to grant the appeal from the Planning Commission decision and return the matter back to the City Council for consideration in three months. MAYOR AND CITY COUNCIL REPORTS Councilmember Wysinger reported on the West County Mayors' and Supervisors' Meeting of September 1, 1993. Councilmember Angela reported on trees at Riverside School and the Property Maintenance Ordinance. Mayor Gomes reported on the Mayors' Conference of September 2, 1993. Mayor Gomes requested clarification of a July 1993 report from Councilmember Angela regarding West County Fire District communication to the San Pablo City Council. Councilmember Angela reported on the status of the communication.
